Ayres, Secretary The meeting was called to order by Chairman John Batstone at 2:10 P. M. Wednesday, May 6, 1981. The only case on the agenda was a request from Cheezem Corporation' for two structures to be constructed below 100-year flood level at Landmark Towers II, 1250 Gulf Blvd., the second phase of their condominium project. .Mr. Michael Reichard presen' ted the case for•Cheezem as follows: (1) con- struction of a guard house at front, and between entrances, of their project (Landmark Towers'T and Landmark Towers II), and construction'of bath facilities within,75 feet of pool area as required by State Health regulations,, Both structures-to be 14.5 feet below 100--year flood level. In response to questioning, Mr. Reichard advised guard house would ,be on same level as parking lot and only equipment therein would be air conditioning unit and.' control panel for operation of electric gate. Building would also contain small toilet facility. Guard house-and bath house facilities would be separate, independent buildings, not attached to main buildings. After consultation and discussi'on'between board members, motion was made by Mr. Walker to approve request for variance as requested on both structures. Motion seconded by Mr. Logan and carried unanimously. Mr. Reichard was reminded and'eautioned that due,to lower construction level, all electrical outlets, panels, receptacles, etc, must be located at higher level in build- ings, or 12 feet above mean sea level. Mr. Ayres requested the Board's approval on new procedure for handling minutes of board meetings. Unofficial copy of minutes of each meeting will be prepared and sent to each board member,as soon as possible'after every meeting. At subsequent meeting, the minutes would be approved with of with- out amendments/corrections, signed by Mr. Batstone, Board Chairman, and would then become a part of City of Clearwater official records. Further, applicants requesting variance would be advised by letter, written under Mr. Ayres, signature immediately after each meeting as to whether or not their request for variance has been approved. Board members approved of and agreed to new procedure. Minutes of the meeting of Wednesday, March 14, 1981 were approved and signed by Mr. Batstone. Meeting was adjourned at 2:30 P. M., J an M. Ayres, Secretary Also Present: Patti Stough, Code Analyst The meeting was called to order by Chairman John Batstone at 2:15 P. M. Wednesday, July 15, 1981. Minutes of previous meeting of May 6, 1981. were reviewed and approved'as submitted. The first case on the agenda was a request from Metro Development Company to construct toilet facilities adjacent to swimming pool, 7.6 feet below 100-year flood level at Clearwater Point Condominiums, 800 Gulf- view Boulevard. Mr..Earl Cravens of Enterprise Building Corp. presented the case for Metro Development, stating since State Health regulations re- .quire toilet,facilities within 75 feet of pool area, only feasible location. for such facilities in this case was in area 7.6 feet below flood.level. No one spoke in opposition and Mr.'Straub moved that having held this duly constituted hearing that,there are practical difficulties and unnecessary. hardships in carrying out the strict letter of the provisions,of the Flood Control Ordinance'as it affects such structure and that the same can be ' varied within the intent of the Flood Control Ordinance, that such appeal be granted. Motion seconded and carried unanimously. At tYiis'pcint, Mr. Ayres introduced Patti Stough, the City°s new Code Analyst, to'members of the board and briefly outlined her various areas of duties. Mr. Batstone questioned why two'cases were being heard at this July 15th board meeting whereas- he had received•a copy of'the agenda which listed only one case. .-Mr. Batstone was specifically'concerned as to whether the second case had been properly advertised, Mr. Ayres explained that the second case involved a portable building to be placed at 2166 Palmetto Street by Florida Power Corp., to be used as office space by them for a period of'four years. This case had already been before the Zoning Board of Adjustment and .Appeal. This board ruled .favorably on the. portable building being placed;on this property but was not able to rule on the time extension. Because Florida Power had been indirectly led to believe that their variance request could be handled by one board, where-- as only, the Building Board of Adjustment & Appeal could rule on the time element, the City Clerk expedited advertising and we were able to include this case in this July 15th.,Board-meeting, Mr. Tim J. Gelvin presented the'case for Florida Power Corp. Mr. 7-15-81 E , r ' } r 2 ; Board of Adjustment & Appeal Building/'Flood Control July 15,1981 Page 2 Gelvin• explained that he was acting in behalf. of 'Mr.. George A. Tice •who had been called out of town and could not appear at thia hearing,',?loxida Power. has been mandated by the Public Service Cominisston' ,as well. as state and, federal agencies to provide the public. with-'energy, conservation in., formation','and the temporary building is required to house their enexgy, conservation specialists with the'variou8- documentary Files and papers, they accumulate in connection w-itfi_ their various programs. This four year extension beyond normal perioa is to provide 'a..track history, of. their aetivities.so?that they can determine th type 'and size 'of the structure to be permanently constructed at this site at the end of tha four year time period. Mr. Ayres. counselled that having this hearing and granting one four year time period at this time, would,ellminate the possible need for a series of extensions to 5e requested by,, the 'applicant at a later date., No one spoke in, opposition and Mr, Straub. 'moved 'as follows; it appearing after this duly^ constituted hearing that there are practical difficulties and unnecessary, hardships in carrying out-the strict letter of the provisions of.the Building Code as it affects- such.-structure 'and that the same can' be varied within the intent of'the Temporary Building Ordinance, that such 'appeal be granted in accordance with the application submitted herewith.. Dean John Logan Joseph Straub Edward Walker Roy J. Ayres, Secretary The meeting was called to order by Chairman John Batstone at 2:10 P11M. Wednesday,,May 6, 1981. The only' case on the agenda was a request from Cheezem Corporation for two structures to be constructed below 100-year flood level at Landmark Towers II,•1250 Gulf Blvd., the second phase of their condominium project: 'Mr. Michael Reichard presented the case for Cheezem•as follows: (1) con- struction of a guard house at front, and between entrances, of their project (Landmark Towers I and Landmark Towers II)', and construction of bath facilities within 75 feet of pool area as required-by State Health' regulations: Both' structures to be 4.5 feet below 100-year flood level. In response to .questioning, Mr.,Reichard advised guard house would be on same level as parking lot and only equipment therein would be air conditioning unit and control panel for operation of electric gate. Building would.also contain small toilet facility. Guard house and bath house facilities would be separate, independent buildings, not attached to main buildings. After consultation and discussion between board members, motion was made by Mr. Walker to approve request for variance as requested on both structures. Motion seconded by Mr. Logan and carried unanimously, Mr. Reichard was reminded -and cautioned that due to lower construction level, all electrical outlets, panels, receptacles, etc. must be located at higher level in build- ings, or 12 feet above mean sea level. Mr. Ayres requested the Board's approval on new procedure for handling minutes of board meetings. Unofficial copy of minutes of each meeting will be prepared and sent to each board member as soon as possible after every meeting. At subsequent meeting, the minutes.would be approved with of with-- out amendments/corrections, signed by Mr. Batstone, Board-Chairman, and would then become' a part of City of Clearwater official records. Further, applicants requesting variance would be advised by letter, written under Mr. Ayres' signature immediately after each meeting as to whether or not their request for variance has been approved. Board members approved of and,agreed to new procedure. Minutes of the meeting of Wednesday, March 4, 1981 were approved and signed by Mr. Batstone. Meeting was adjourned at 2:30 P. M.
