'Attorney Nail, a resident of the community, introduced other
members of the neighborhood and presented argument s 'against the con-
tinuation of construction of this residence.
Considerable discussion and questioning ensued between Board
members and Mr. Lipman and sample copies of "red tags" and permit
applications were examined by all concerned. It was suggested.that
an opinion from the Legal Department was needed and Mr. Frank
Kowalski, Chief Assistant City Attorney,' was summoned to the hearing.
Mr. Kowalski was apprised of proceedings and after considerable
questioning and discussion, rendered the opinion that because of the
many technical aspects of this case, also the fact that an appeal
to the Zoning BAA has already been denied, that the Building Board of
Adjustment and Appeal does not necessarily have jurisdiction in this
matter.
Before asking for a motion, Mr. Logan commented that in his
opinion Mr. Ayres was using proper authority in revoking the Permit -
and he did not feel it to be within the jurisdiction of the Hoard
to determine this question.
MOTION: A motion was made by Mr. Straub with r.eaard to-the request
for a variance from the Building Director's decision for a structure
located at 116 Smallwood Circle, owned by Norman and Evelyn Alexander,
that the Board does not find it to be within its authority to act
upon the request. The motion was seconded by Mr. Walker and passed
unanimously.
Case II - 640 Gulfview Blvd, Brett's Restaurant -- Owner, Rose
i er - Represen -a ive, r, Kurt oungs -rom. Mr. Youngstrom pre-
sented the case for the owner and discussed the hardship that would
be involved if construction could not be at ground level - or approx-
imately 4.0 ft. below 100-year flood level. The restaurant planned
will 'consist of approximately 2,000 square feet, to seat about 100.
To meet State handicapped requirements would require some 60 ft. of
ramp which would be impractical due to space limitations and also be-
cause of the extremely high cost. Also to construct above flood level
would be aesthetically undesirable, particularly considering surround-
ing structures. Mr. Logan questioned whether the owner had been proper-
ly and completely informed of Federal Flood Regulations and cautioned
that the cost of insurance on this structure would be very high and
there is also the possibility that they would be refused insurance.
The owner had been advised of this fact but intends to investigate
further before final, construction plans are formalized.
MOTION: Mr. Walker moved with regard to the request.for a variance
from the Flood Insurance Regulation for a structure located at 640
Gulfview Boulevard, the Board finds, it to be within its authority, to
act upon the request and hereby grants the 4.0 ft. variance as re-
quested. Motion seconded and passed unanimously.

for the owner, briefly described building and surrounding area and
advised the board that insurance rates have been. checked. Prelimin-
ary information furnished by the Federal Flood Insurance agency has
indicated rates will be high but Ms. Lamb'stated they are prepared to
accept applicable rates. To construct their building at a higher.
level would not be aesthetically acceptable considering already
existing structures in the surrounding area, plus to build at the
11 ft.'`l.evel would not be feasible or practical.
MOTION: A motion by Mr. Cornett regarding this request for a 2.5 ft.
variance from the Flood Insurance Regulations for the structure
located at 3198 Gulf.-to-Bay Blvd., the Board finds it to be within its
authority to 'act upon the request and grants the variance as requested.
Motion, seconded by Mr. Straub and carried unanimously,
Mr. Ayres informed the Board members of a new ordinance currently .
being drafted in the City Attorney's office. The new ordinance will
increase the rate for filing an application` for building%flood variance
from $10.00 to $100.00. Changes also are contemplated in noticelprocedures.-
-Minutes of the November 24, 1982 meeting were reviewed and
approved as submitted.

The meeting was called to order in the Operations Center, City
Hall Annex by Chairman Logan at 2:08 p. m. A short discussion followed
between Board members and Mr. Ayres relative to code interpretations. The
following cases were then heard:
Case I -- Sun Harbor Condominiums, 4.83 E_.___ Shore Drives Mr. Carl Tilly pre-
sented the case for the builder, Alliance Building Corporation. A 2.5 ft.
variance was requested so as to permit installation of laundry appliances
and electrical outlets below flood plain. Condominium consists of eight
units with living units above garage and above flood level. Garage/
utility area will contain one washer, one dryer, one light, one light
switch, one receptacle and will be constructed with break-away walls.
Motion - by Mr. Walker. With regard to the request for a variance from
,the flood insurance regulation for a structure located at 483 E. Shore Dr.
the Board finds it to be within its authority to act upon the request and
hereby grants the variance as requested. Motion seconded and carried
unanimously,
Case II - Island Wa , Island Estates. Mr, Joseph A.,King, owner of the
property, requesting a 5. t. variance to permit construction of a 2.580
ft.' office building below flood plain. To construct meeting flood.height
requirements would present hardship in that stairs would be obstacle for
many of his elderly clients; to ramp would be impractical, and further
such construction would not be aesthetically compatible with surrounding
structures.
Motion - by Mr. Straub. With regard to the request for a variance from
the Flood Insurance,Regul.ation for a structure located on Island Way, the
Board.finds it to be within its authority to act,upon the request and
hereby grants the variance as requested. Motion seconded by Mr: Walker and
carried unanimously.
Cas6-III - U. S. Coast Guard Station,'Sand Key. Mr. Albert P. Renuart,
Architect, Seventh Coast Guard District presented the request for a 4.ft.
variance to permit use of area below 100-year flood level for storage and
repair-shops for minor equipment repair. No problems seen by Board.
Motion,- by Mr. Cornett. With regard to the request for a variance from
the Flood Insurance Regulation for the Coast Guard Station located at Sand
Key, the Board finds it to-be within its authority to act upon the request
and hereby grants the variance as requested. Motion seconded by Mr.
Walker and carried unanimously.

Case IV -- Clearwater Yacht Club, 830 S. Ba a Blvd. Mr. J. R. Pete
Stirling, member of the Board of Directors requesting a 4 ft, variance
to permit enclosure of area beneath existing building with glass doors,
to provide additional required space. Area is approximately 1,500 sq.
feet;-presently contains normal lighting and receptacles, bath facilities,
and will eventually be air conditioned. Economically unsound for club
to expand in any other manner and enclosure of this existing area is
necessary to provide additional space required for their club functions.
Motion - by Mr. Straub. With regard to the request for a variance from
the'Flood insurance Regulation for the structure located at 830 S. Bayway
Blvd. the Board find it to be within its authority to act'upon the request
and hereby grants the variance as requested. Motion seconded by Mr. Cor-
nett and carried unanimously.
Case V - Pelican Restaurant, ??„Mandalay Avenue. - Mr. Wm. Kimpton,
attorney. represented the owner in this request for a 5 ft. variance to.
permit expansion of kitchen area - addition to be constructed at same
level as existing kitchen. Considerable discussion and questioning
followed and it was determined that because the proposed improvement to
the structure would not exceed 50% of the assessed value of the original
structure, this variance could be granted under Coastal Construction Code,
Section 3904.
Motion made by Mr. Walker -- with regard to the request for variance from
the Flood Insurance Regulation for a structure located at 470 Mandalay
Avenue, Clearwater -- Pelican Restaurant - the Board finds it within its
authority to act upon the request and hereby grants the requested variance
under the following conditions - (1) that the variance be granted to match
the existing floor elevations based upon the Board's interpretation that
the addition is not substantial improvement of'the existing restaurant
as defined in Chapter 39 and therefore does not have to conform to the
one foot above street level elevation. Motion seconded by Mr. Straub and
carried unanimously.
Case VI - 783. Bay Es lan? ade?- owner Thomas L. duPont. Representative
Rogers K. Hay on, Jr. requesting a 5 ft, variance to permit construction
of one-story residence, utilizing portion of existing garage as part of
new construction. Because there might appear to be a question as to
this construction being pe3rmitt6W under zoning regulations, Mr. Logan
advised the applicants that the Building/Flood Board dealt with flood and
building code variances only and granting of the flood variance as re-
quested would be contingent upon the-applicant securing a zoning variance
if necessary. Applicant proposes to build new structure to conform with
surrounding homes and 5 ft. variance from flood regulations necessary to
permit construction at same level .as neighboring residences. After
questioning, it was determined that new structure would have to be built
at an elevation'of 8 ft. rather than 7 ft. to conform with one foot above
crown of road elevation requirement.
Motion made by Mr. Walker -- with regard to the request for variance from
the Flood Insurance Regulation for a structure located at 781 Bay Explanade
that the request be granted subject to the elevation being at 8 ft.
rather than 7 ft. Motion seconded by Mr. Cornett and carried unanimously.

The meeting was called to order in the Operations Center, City Hall Annex
by Chairman Logan at 2:05 p. m. The 'following cases were heard:
Case I -- 25 Causeway_ Blvd., Capt. Anderson II construction of Ticket
office and Administrative office on City owned dock below 100-year flood
level; i.e. variance to construct at surface level equivalent•to sur-
rounding similar structures.
Mr. 'Kenneth Johnson, Express'Construction Company represented the owner
of the cruise boat, Cpt. Phil Henderson. Mr., Johnson referred to a
memorandum from the Building Director which 'itemi zed ntinimum code re-
quirements for the two buildings in question. A ,copy of this memorandum
-is attached hereto and made a part of these mi.niutes. After hearing Mr.
Johnson's presentation it was,the opinion of the Board that the proposed
construction methods met and exceeded code.requiromerits, and that the
Board, therefore, had only to rule on the flood variance.
Further discussion followed between Board members', Mr. Johnson and Mr.
Joe Ryan of Fire Safe Company regarding proposed fire treatment of these
buildings, the fact that the treatment had a two-hour fire resistance
rating, and had been'approved by the fire department.
Regarding the variance from flood elevation, it was the concensus that
it would be prohibitive to build at the flood elevation. Mr. Walker
moved that with regard to the request for a variance from the Flood in-
surance Regulation for a structure located at the City of'Clearwater docks,
Cpt. Anderson II Dinner and Dance Cruise, the Board finds it to be within
its authority to act upon the request for flood variance and hereby grants
the variance as requested. Motion seconded by Mr. Cornett and carried
unanimously.
CaseZI -_295 &ayside, Clearwater Beach - a request for a 3 ft. variance to
permit construction of a two story dwelling to replace existing residence.
Mr. Bob Starr, Architect and Mr. Dennis G. Ruppel, owner attended the hear-
ing and Mr.' Starr presented the case to, the board. Mr. Starr advised that
after extensive investigation it has proven impractical to attempt to reno-
vate or remodel existing residence and are seeking approval to replace this
with a two story home, with the ground floor of the new structure not to
exceed the square footage of the existing structure) with the floor ele-
vation at 9 ft. rather than the present. 7.7 ft., and with new structure

located on-the triangular shaped lot so as to permit installation of swim-
ming pool to meet building code-regulations. In answer to questions from
the Board Mr. Starr.advised that surrounding existing homes are at approxi-
mately-5.5 ft. elevation; crown of road approximately 5.5 ft.; 'existing
house has an area of about- 2,800 square feet and new dwelling will not ex-
ceed 3,000 square feet.
Chairman Logan asked if the applicant was aware of the cost of Federal
Flood Insurance when constructing below 12 f t.'flood elevation and Mr.
Ruppel•responded that he is at present checking this and understands that
the cost of insurance will be considerably higher. Mt. Logan suggested
that'it might be advisable to consider this construction at a i.0 ft. level
rather than the 9 ft. variance requested which might reduce insurance
costs and Mr. Ruppel advised he is securing estimates for several ele-
vations and will then make cost analysis to determine construction -height,
but to go to full 12 ft. elevation would not be feasible.
Motion - by Mr. Straub. With regard to the request for a variance from
the.Flood regulation for a structure located at 295' Bayside,•Clearwater
Beach for permission to construct a two-'story residence with first floor
elevation of 9 ft. minimum replacing the existing residence with a first
floor elevation of 7.78 ft,, the Board finds it to be within its authority
to act.upon the request and hereby grants the variance as requested. Motion
seconded by Mr. Cornett and carried unanimously'.
Referring to the vacancy that still exists on this Board, Mr. Logan asked
whether or not Mr. George Biron had been contacted, and was advised-that
this would be done within the next few 'days.

The meeting was called to order by Chairman Logan at 2:10 p. m:
The Board proceeded to hear the cases before them.
Case I - Aegean Sands Motel -- S. Gulfview- Blvd. -- Lil7Lo Properties.
Mr. John'Co.rnett declared a conflict of interest and advised he would
refrain from participating in this particular case. Mr..' Mark Lapham,
General Manager/Partner, presented the-case in behalf of Aegean Sands .
Resorts. Agean Sands now consists of two separate structures on
either side, of a vacant lot. Owner wishes to'construct a 20' x 30'
building on the lot to house much needed storage area as well. as coin-'
operated laundry facilities for the use of their guests.' A 6 ft. ?
variance requested to p'er'mit construction of,new building at same 1
level as existing buildings'-- to build 'at higher level would mean
ramping or stairs necessary which would not be practical and would'
be hardship as far as moving of equipment in and out of storage area .
and 'access to 'laundry, f acilities. is concerned - and. could present
problems due to water run-off from higher new building to existing
lower buildings. 'Mr. Lapham advised the Board that he dial not plan,
to apply for flood insurance for the new building. A discussion
followed regarding flood insurance. Mr. Biron questioned whether one
building on a property could be' excluded or be exempt from flood in-
surance when other buildings ware already covered,by flood insurance.
Mx. Lapham was advised by Chairman Logan and other Board members that
he should check into this very thoroughly as he could risk his flood
'insurance becoming invalid by not including new building in flood
coverage. Questions were raised regarding electrical receptacles' and
outlets as well as placement of washers/dryers in the new building,
George Owens was summoned to the. hearing at this point to answer various
questions in this regard. Consensus was Beard's approval of variance
as requested included approval of not just shell of building but also
all electrical, plumbing, mechanical installations and in this case,
installation of washers and dryers.,

There were no further questions and Mr. Straub moved with regard to
this request for variance from the Flood Insurance Regulation for ,a
structure located at 421 S. Gulfview Blvd., that the 6 ft. variance
be granted as requested. The 'motion was duly seconded. Messrs.,
Logan, Straub and Biron voted "aye". Mr. Cornett abstained from
the vote. Motion carried.
Case 21- Beach Bar, 454 Mandalay Avenue.
Mr. Henry Cruise, owner, and son, James attended meeting: Mr. Don
Williams presented the case for the owner. Mr. Williams described
the addition to the existing building as it has been designed and
pointed out how impractical 'it would be to construct above flood,
level.. Granting of the 2.62 ft. variance as requested would permit
all.floor levels to be the same. Mr. Logan advised Mr. Cruise to
investigate the increased flood insurance costs this addition would
represent.
Mr. Ayres entered meeting.
Before polling board members,, Chairman Logan asked that the Minutes
reflect a possible conflict of interest between Chairman Logan and Mr.
John Cornett. Mr.Cornett moved with regard to the request for a variance
from the Flood insurance Regulation for a structure located at 454
Mandalay Avenue, the Board finds it to be within its authority to act
upon the request and grants the variance as requested. Motion seconded
by Mr.,Straub and carried unanimously.
Case 111 - 781 Bay Esplanade - requesting an 8'ft.' variance to permit
construction of swimming pool within 18 ft. of existing seawall. Mr.
C. F. Curtis of Curtis Construction requesting variance for owner, Mr.
Rogers K. Haydon, Jr., who was also present at hearing. In response
to Mr. Biron's question, bir. Curtis stated pool to be. 35' along sea-
wall.. Spacing of pilings 1016" sufficient for deadmen, tiebacks, and
for maintenance. There being no further questions,-Mr. Straub moved
with regard to the request for variance from the Building Code for a

The meeting was called to order•by Chairman Logan at 205 p.m.
One case to be heard.
Pinellas_Co_unty Board•of County Commissioners W 315 Court. Street.
Requesting a.3 ft., variance from Federal Flood Regulations so 'as to ;
build bath house facilities at Sand Key Park at 10 ft. elevation
rather than' at 13 ft. level designated b)7 7ood regulations. Mr. Jim
Terry presented the case for the County, advising that building at
lower elevation would permit better access to the facility, particularly
for,the handicapped, elderly and infirm. Also building at lower ele-
vation will permit incorporation of the -facility into surrounding sand
dunes,•with variety of plantings, including sea oats and other beach
vegetation, making the facility more aesthetically pleasing. County.
will not-be applying`for Federal Flood Insurance "'they are self-
insured. In response to Mr. Biron's question regarding the elevation
of the area surrounding the proposed structure, 'Mr. Terry advised would,
be graded somewhere'in the area of 6' to S' - and the area from lower
elevation to 3.0 ft. elevation of bathhouse facilities would be ramped..
To-ramp to any higher elevation,than.10 ft.,would necessitate longer
ramps, at,greater expense to County. Facilities will contain electrical
wiring for- lighting pui.poses only - no air clonditioning or heating
facilities are proposed. Structure, of course, will be unoccupied.
Add'ition'al structures and-facilities are proposed for Sand'Key Park some
time in the future and these will be processed through the City's-regular
site plan procedure.as each construction phase develops.

There were no further questions and Mr. Logan asked for a motion. Mr.
Walker moved with regard to the request for variance from Flood Insurance
Regulations" for a structure located at'Sand Key Park consisting of a bath
house, the board finds it to•be within its authority,to act-upon the re-
quest and hereby grants the variance: as requested. Motion seconded by
Mr. Cornett and carried unanimously. Variance granted.

Mr.' Christiansen asked to be heard with 'reference to a problem on-
countered at 781 Bay Esplanade. On April 13, 1983 the Board had granted
the now owner of the property a 9 ft. variance so as to construct a one
story residence attached to an-existing garage on'the property, at an ele-
vation of 8 ft., compatible with the existing garage and surrounding proper-
ties. The Building'Aepartment has placed a stop-work order on the con-
struction as it has been found that the existing,garage was rased and con-
struction of'the new residence was started from scratch. The Building
Department maintains the flood variance was `granted bas'dd on`adding on to
the existing structure; the property owner contends this was not.a con-
dition of the-variance; and the Board is being asked to clarify.
After a lengthy discussion and review of,the minutes, the Board ruled
that the variance was granted based on' the new construction being attached
to existing construction and the consensus was that,the owner should re-
apply for an entirely new variance based on construction as it is now
planned 'without the existing garage. Mr. Christ:ia'nsen was asked to convey
this decisi.on-to the owner and'his attorney, who were waiting outside.
Mr. Rogers Haydon, property owner, and his attorney, Mr. John
Blakely, entered the meeting and asked to be heard. Mr. Haydon informed
the board that it,,was his.intent when he applied for.the variance to incor-
porate part of the existing structure,into the new construction. This also
was his intent after the variance was granted buf it.was never `his belief
that the variance was granted contingent to attaching to already C-xisting
construction. He purchased the lot only after being granted the variance.
and it was later that it'was determined to be economir.ally impracticable
to use any'of the original building. At that time a.-demolition permit was
produr,ed., Mr. Iiaydon expressed concern that to reapply for another variance
at this time would in effect be admitting that he did not have a proper
variance to begin with when it is his contention that he did have a legitimate
variance.
Mr.`Blakely addressed the board and contended if it was the board's
intent that the variance be granted with a condition, it'should have been
so stated in the motion. Further plans were submitted showing construction
without .the use ` of the existing garage and a permit Vas issued.' Also a
demolition permit was secured.. Mr. Blakely advised that mention of the
garage in the initial application for variance was to establish compatibility
with surrounding structures, and he could not advise Mr. Haydon to risk re-
applying for a•vari.ance for fear that it would be-denied and he would have
abandoned his rights to the variance'he feels he already has. The situation
now is that he has purchased the lot, constructed a swimming pool, and
poured the foundation for the new residence and, without the variance he`is
faced with a tremendous loss.
More discussion,followed between the board members,, the applicant,and
his attorney. 'Mr. Logan repeated that it would be to the best interests of

a'11 concerned for the board to hear the application again, and it was f'inal-
lly agreed that Mr. Haydon•would re-apply for the variance stipulating on
his application that fie 'was not.waiving his rights under the 'variance pre-
viously granted.. Mr. Haydon will proceed on that basis and upon receipt.
of his new application,' arrangements will be made so that the.Board may
hear his case as quickly 'as possible.' Mr. liaydon and Mr. Blakely left
the meeting.
Mr. Logan brought up question'of how board should grant variances to
build below flood control level where electric light switches, outlets, con-
outlets, air conditioners, etc. are involved. Florida Power will
,not raise their transformer or,service drops above a certain height. Mr..
Tripp stated plugs and outlets are not.a major concern as there are devices
to protect these - the service entrance is the problem. Mr. Walker. felt
?A;•.•',that residential construction is not a problem under existing regulations -.'

between board members. regarding vague federal rlood regu'lati6ns -consensus.
is that board can grant variances of a certain elevation but mot'idn should,
