glass requirements,'with the condition that, should any situation arise
that would change the distances to the other buildings, the owner will
be required to install wired glass. Motion seconded by Mr. Logan; and
motion, as made, passed unanimously.
Inasmuch as Mr. Forrest Watson also represented, and is the
architect for the construction at Pier Pavillion (Case VI on agenda)
this case was,next presented to the Board. Mr. William Alexander'is
lessee of Pier Pavillion - a City owned property -- and requested a
variance to build an addition/replacement. to existing pool facility, at
six feet below ,100-year flood level, where a portion of the structure will
be in seaward portion of Zone 2. Mr. 0. Stephen Thacker, attorney for
Mr. Alexander, and Mr. Andrew M. Nicholson, City of Clearwater Oceanographic
Engineer, assisted'Mr. Watson in presentation of this case. The building
will house restroom facilities, storage area, and a pump room with its,
respective equipment. The design of the building was thoroughly discussed.
Openings in building have been designed for panel installation in event,
of hurricaine. Roof system, walls, and foundation systems, have been
specially designed to withstand storm surge. Mr. Logan moved the*Board
grant the request to Mr. William Alexander to build his addition as e-
signed and situated, six feet below the 100-year flood level. Motion'
seconded by Mr. Dean. Motion passed unanimously.
Case II, Case III and Case IV were presented, to the Board and heard
at one time inasmuch as they are of similar nature, and Frank M. Bosworth
represented each of the three property owners.. In order to comply with
state health regulations requiring restrooms to be located with. 75 feet
of a public pool, oirners required variance to construct said facilities
below 100-year flood level. Structures in all three cases will be _
separate, independent buildings, not attached to main buildings. Mr.
Bosworth supplied information as to the amount of variance required in
each case. Mr. Walker made motion to approve requests for variances.
Motion seconded by Mr. Dean. Motion approved unanimously to allow the
variances hereafter described:

Last case presented to board was Case N, The Harborage-Condo-
ininium, 1631 Gulf Blvd. '. Southeast American`Development Corporation is
owner/developer of the property and Mr. Robert J. Fleck, Assistant Vice,
President, presented case to,the'board. To comply with state health
'regulations requiring; rest room facilities within 75 feet.of a public
pool; owner requested a 3.5 foot variance. The building housing'these'
facilities will be a separate and•independent building, unattached to
main building itself., A motion was made by Mr..Dean that the appeal
be granted in accordance with the application submitted. Motion
seconded-by Mr. Logan. Motion passed unanimously with no•further dis-
cussion.

The only case on the agenda was a request from Cheezem Corporation
for two structures to be constructed below 100-year, flood :Level at Landmark
Towers II, 1250 Gulf Blvd., the second phase of their condominium project.
Mr., Michael Reichard presented the'case for Cheezern as follows: (1) con-
struction of a guard house at front,' and between entrances, of their project
(Landmark Towers.I and Landmark Towers II) ,'and construction of bath„facilitie,
within:75 feet of pool area as required by State Health regulations. Both -
structures to be 4,.5 feet below 100-year flood level. In response to '
questioning, Mr. Reichard advised guard house would be on same level as
parking lot and only equipment therein woul'd'be air conditioning unit and '
control panel fo'r operation of electric gate. Building would also contain
small toilet 'facility. 'Guard house and bath house facilities would be
separate, independent buildings, not, attached to main buildings.. After
consultation and discussion between board members, motion was made by i,r.
Talker to approve request for variance as requested on,.both structures.
Motion seconded by Mr. Logan and carried unanimously. Mr.. Reichard was
reminded and cautioned that due to lower construction level, all electrical
outlets, panels, receptacles, etc, must be located at higher level in build-
ings, or 12 feet above mean sea level. µ
Mr. Ayres requested the Board's approval an new procedure for handling
minutes of board meetings. Unofficial copy of minutes of each meeting will
be prepared and sent to each board member` as soon as.possible after every
meeting. At subsequent meeting, the minutes would be approved with or with-
out amendments/corrections, signed by Mr. Batstone, Board Chairman,' and
would-then become a part of City of Clearwater official records. Further,,
applicants requesting variance-would be advised by letter, written under
Mr. Ayres' signature immediately after each meeting as to whether or not
their request=for variance has been approved. Board members approved of
and agreed to new procedure.
Minutes of the meeting of Wednesday, March 4, 1981 were approved and
signed by Mr. Batstone.

The meeting was called to order by Chairman John.Batstone at 2:15
P. M. Wednesday, July 15, 1981.
Minutes of previous meeting of May 6, 1981 were reviewed and
approved as submitted.
The first case on the.agenda was,a•request from Metro Development
Company to construct toilet facilities adjacent to s'wimming pool, 7.6 feet
below 100-year flood level at Clearwater Point Condominiums, ?00 Gulf-

yj_ew.Boulevard. Mr. Earl Cravens of Enterprise Building Corp., presented
the case for.Me-ro Development, stating since State health regulations re-
quire toilet facilities within 75 feet of pool area, only feasible location
for such facilities in this case was in area 7.6 feet below flood level.
No one spoke in 'opposition and Mr. Straub moved that hav3 ng- held this duly
constituted hearing that there 'are practical difficulties and unnecessary
hardships in carrying out the 'strict letter 'of the provisions of the Flood
Control Ordinance as it affects such structure and that the same can be
varied within the intent of the Flood Control Ordinance, that such appeal
be granted. Motion seconded and carried unanimously. ;
,At this point, Mr. Ayres.introduced Patti. Stough, the City's new
Code Analyst, to members of the-board and briefly outlined her various
areas of duties.
Mr. Batstone questioned why two cases were being heard at this July
` 15th- board meeting whereas he' had received a copy of the agenda which
listed only one case. Mr. 15atstone was specifically concerned as to
whether the second case had been properly advertised, Mr. Ayres explained
that the second case involved a portable building to be placed at 2166
Palmetto Street by- Florida Power Corp., to be used as office space by,
them for a period of four years. This case had already been before the
Zoning Board of Adjustment and Appeal.. This board ruled favorably on the
portable building being placed on this property but was not able to rule
on 'the time extens3.on. Because. Florida Power had been indirectly led to
believe that their variance request could be handled by one board, where-
as only the Building Board of Adjustment & Appeal could rule on the time
element, the City Clerk expedited advertising and we were able to include
this case in this July 15th. Board -meeting. .

CASE NO.' II -- C. D. Carley, Jr., '320 Harbor Passage (Owner)
Representative - Mr. Randall Pickelmann
C. F. Curtis Const., Inc.
Mr. Pickelmann presented case for owner advising size and contour of owner's
lot presented-difficulties in locating a swimming pool but if the 12 ft.
variance requested is granted, a pool could be located between the seawall
and house. A 34 ft. continuous pour deck has been designed by, an engineer,
5 ft. back from seawall, which will provide security to seawall during and
after construction. Also approximately two feet of open area - not con-
creted -- is provided between edge of wall and pool deck to provide for any
needed fill and maintenance. Discussion followed.regarding batter piles
or deadmen to ensure proper bracing of seawall.
MOTION: Mr. Walker moved as follows: "Mr. Chairman: With regard to
the request for a variance from the Building Code for a structure located
at 320 Harbor Passage, I move for a decision by the board as - follows: that
the-board finds it to be within its authority to act upon the request, and
hereby'grants the requested variance, with the following conditions; (1)
that the, engineering of the deadmen and bracing of seawall be approved by
the Engineering Department." The motion was immediately amended to state
that the conditions be waived upon confirmation of Andy Nicholson's
signature on the plans in file.
Motion was duly 'seconded as amended and carried unanimously. Granted'as
requested.

plan in files has been properly approved by Engineering Department),
CASE N0. III - H. G. Hamilton
Lot 5, Bldg.., 10-Bay Esplanade
" With regard to this case, Mr. Ayres stated that because time did not. permit
a thorough examination of plans, there is a possibility that a Zoning
variance might also be required, although prel.ianinary examination-did not
indicate this to be a fact. Mr. Ayres advised, however, that the owner
should be aware of this possibility before the fact, as if a zoning
variance is necessary, the action of this Board today would not cover.such
a variance.
Mr. Hamilton presented. information as to location of this strand steel
building, which will house beach vehicle(s) and 'peach chaires, umbrellas,
etc. Equipment will be stored in building at night and brought out for
beach usage during daylight hours. There is no electricity or plumbing
involved. Will be on grade only slightly higher than present parking area.
Some discussion•followed but no Droblems seen. -
MOTION: Mr: Straub moved as follows: "Mr. Chairman: With regard to
the request for a variance from the Building Code for a structure located
at-10 Bay Esplanade, I move for a decision by the Board as follows:
'Granted as Requested.' The Board finds it to be within its authority to
act upon the request, and.:hereby grants the variance as requested."

Mr. Marich presented the case for the owner. Three, variances were re-- ,
quested as follows:
A. One foot variance to construct Pool 7 ft., below existing grade
so that a pool eight feet in depth can be 'constructed to provide
for safer diving and swimming acc-omodations.
B. Through construction error pile caps 1 ft. 4 inches in depth
rather than 2 ft. as' required. An eight' inch variance requested.

A 13 ft. variance requested for construction of swj-Tming pool 5 ft. from
seawall rather than 18 ft. required. Mr. Kimpton and Mr. Laird presented
the"case stating only way pool can be. constructed' on lot' would bring it
within five feet of sealwall. Also second problem exists in location
of pool in relation to existing concrete porch slab. Cannot violate
angle of repose and pool must be-five feet from porch slab. Discussion
and questions ensued regarding engineering confipgurations on placement
of pool. Question as to whether City would accept, engineer's design if
sealed by engineer. Mr.-Ayres stated Building Department would believe
design to be sound, and would accept engineer's sealed drawings.
MOTION By Mr. Walker. "Mr Chairman -- with regard to the request for.
a variance from the building" code/flood insurance" regulation for a
structure located at 265 Bayside Drive, I move 'for "a decision by the..
board as follows: The Board.finds it to be within its authority to act
upon the request, and hereby grants the variance as requested." Motion
seconded by"Mr. Straub and carried unanimously. Request granted."
Some' discussion followed regarding -interpretation of Section,3906 of
the Coastal Construction Code in relation to 18 feet required distance
from seawall for tiebacks. Walt Hilton will pursue this further with Andy
Nicholson and-the matter will"be -discussed at a future Board meeting.

The meeting was called to order by Chairman John Batstone at 2:10 P. M.
in.'the Operations Center. Conference room, City Hall Annex.
Minutes 'of the September ,23, 1981 meeting were reviewed and approved as

First case to be heard - South.,Bay Condominium, located at 1501 and 1551
Gulf Blvd., Clearwater Beach_.' Representing South Bay were;

Mr. Hegner presented the case. Due to contour of construction area,
the southeast corner of the building located at 1501 Gulf Blvd. will en-
croach eight feet within flood plain area. Mr. Hegner explained the
difficulty was in attempting to mitigate the e;'feet of traffic on to
Gulf Blvd. by, having one 'entrance and one exit -,for two buildings. Also
parking requirements had to be considered, as well as•drainage require-
ments to ensure proper drainage to retention areas on the property. In
response to various questions from Mr, Walker, Mr. Hegner elaborated on
designs of building. Drawings have been submitted to and approved by
the City-Engineering Department.
A variance in elevation to permit construction of mechanical rooms three
feet below flood plain, and a variance to-install concrete walls around
the parking area three 'feet below flood plain also were requested for
this building. Several questions were presented 'by the Board and're-
sponded to by Mr. Hegner'.
MOTION: By Mr.,, Logan. With regard to the request for variances from
the Flood Insurance regulation for a structure located at, 1501 Gulf Blvd.,
Sand Hey, Clearwater Beach, the Board finds it to be within its authority
and hereby grants,the variances as requested. Motion duly seconded and

building located at 1551 Gulf Blvd. were presented to the Board. These
are identical to requests for variances at the 1'01 address,
Finally, a request for variance for construction 'of poolside toilet
facilities to be located between 1501 and 1551 was presented to the'
Board. State Health regulations require bath facilities within 75 feet
of pool area and to'comply.with regulations entails construction three
feet below 100--year flood level.. There were no problems or questions
from the board members regarding this 3 ft. variance request.
MOTION: By Mr. Walker. With regard to, request for variance from the
'Flood Insurance regulation for a structure located between 1501 and 1551
and at 1551 Gulf Blvd., items A, B and C, I move for a decision by the
board as follows: that the board find it to be within its authority
to act upon the request.,and hereby grants the variances as requested.
Motion duly seconded and carried unanimously.
Case No. 3. The third item on the agenda was a request' for variance
to permit remodeling and construction of additions to an'existing
residence at 1154 Mandalay Point. Mr. Nelson J. Simmons presented the
case for the owner, Mr. Jack Eckerd. The existing structure setbark.
is within flood plain. The outside of the first floor of the present
structure will remain basically the same. The interior of first floor
will be remodeled and present garage made-into living quarters. A three
car garage will be added on to the, first floor existing -building. The
roof of the present first floor structure will be removed and an entire
.second floor rebuilt with open porches, etc. After considerable dis-
cussion Mr. Batstone called for motion. Notion made by Mr. Logan.
MOTION: With regard to the request for a variance from the Building,Code
and Flood Insurance Regulation for a structure located at 1154 Mandalay
Point, I move for a decision by the Board as follows: the oar `1nJs
it to be withinin its authority to act upon the request, and hereby
grants 'the requested variance,,i.e. $ feet below 12 ft. flood plain, linc
and to change the existing, garage into living quarters with the existing
floor elevation. I Motion seconded by Mr. Walker and'carried unanimously.
Case No. 4 - Anthony Cicotti,,2833 Meadowhil.l Drive, Landmark Woods. 'Case
presented by Mr. Richard Griffith of Griffith Roofing Company., A var•l.ance
from Section 107 requested to permit installation of roof coverings on a
roof slop of 6/12 without the use of nails. Mr. Griffith stated exper-
ience has proven that it is not practical to use nails on this 6/12 pitch
roof as roof will not hold up after being subjected to wind-driven rains
whieh,cause water to enter beneath tales resulting in rust and softening of
sub-roof. Roofing Association is aware of problems presented with this
type of Installation and currently code is being rewritten but in meantime,
variance is required to install roof of this pitch in the more practical
manner, without use of nails.
MOTION: By Mr. Walker. With regard to the request for a variance from
the Building Code for a structure located at 2833 Meadowhi.ll Drive, Land-
mark Woods, I move for a decision by the Board as follows: Granted as re-
quested. The Board finds it to be within its authority to act upon the
request, and hereby grants the-variance as requested. Motion seconded by
Mr. Logan and carried unanimously.

The meeting was called to order by Chairman John Batstone at.
2:20 P. M; Wednesday, March,4, 1981.
Prior to the first case listed on the agenda, Mr. Ayres polled the
Board relative to a'proposed store to be known as "Kid's Point of View"
adjacent to Maas Brothers.Department Store in Countryside Mall. The
code requires two 3--hour walls between the two stores. Inan almost
identical case heard.by the Board on October '10, 1979, approval was
granted to install metal studs with two layers of gypsum sheetrock
adjacent to the existing 3-hour' wall to serve as a 4-hour wall in lieu
of the two 3-hour walls. The Board stated that it was uncertain as to
whether Board approval was required-for ' the substitution, and that the
Building Official was granted their approval to issue permits for similar
configurations in the future, provided he polled the Board members to
determine if any member felt that the Board should take formal action
on the particular case. The four members bf the Board individually
,concurred that it would not be necessary'for the Board to hear the present
.case, and they would agree in the use of metal studs and two layers of
sheetrock as being necessary and sufficient.
The first case presented to the Board was request for variance to
use regular bronze.plate'glass in lieu of wireglass as required by
Sec.'703.1, SBCC.on property known as Executive Place, located at
2505 Enterprise. Road, Mr. Forrest E. Watson 'represented the owners -
Thomas Eddy and William Hackenberger. Mr. Watson presented views as
.to aesthetic advantage of regular bronze plate,glass and furnished
information-regarding location of this building in relation to surround-
ing properties. Mr. Batstone questioned possibility of future build-
ing in parking areas; that possibility determined to'be remote. .
Motion was made by Mr. Dean to approve the request for a waiver of wired

glass requirements, with the condition that,,should any situation arise
that would change the distances to the other buildings, the owner will
be required to install wired glass. Motion seconded by Mr. Logan; and
motion, as made, passed unanimously.
Znasmuch,as Mr. Forrest Watson also represented, and is the
architect for the construction at Pier Pavillion (Case VI on agenda)
this case was next presented to the Board. Mr. William Alexander is
lessee of Pier Pavillion - a City owned property - and requested a
variance to build an addition/replacement to existing pool facility at
six feet below 100-Year-flood level, where a portion of the structure will
be in seaward portion of Zone 2. Mr. 0. Stephen Thacker, attorney for
Mr. Alexander, and Mr: Andrew M. Nicholson, City of Clearwater 'Oceanographic
Engineer, assisted Mr. Watson-in.presentation of this case. The building
will house restroom facilities, storage area, and a pump room with its
respective equipment. The design of the building was thoroughly discussed.
Openings in building have been designed for panel installation in event
of hurricaine. Roof system, walls, and foundation systems have been
specially designed to withstand storm surge. Mr. Logan moved the Board
grant the request to Mr. William Alexander to build his addition as de-
signed and situated,,six feet below the 100-year flood level. Motion
seconded by Mr. Dean. Motion passed unanimously.
Case II, Case III and Case IV were presented to`the Board and heard
at one time inasmuch as they are of similar nature, and Frank M. Bosworth'
represented each of the three property owners. In order to comply with
$ state health regulations requiring restrooms to be located with 75 feet
of a public pool, owners required variance to construct said facilities
below 100-year flood level. Structures in all three cases will be
separate, independent buildings, not.attached to main buildings. Mr.
Bosworth supplied information as to the amount of variance required in
each case. Mr. Walker made motion to approve requests for variances.
Motion seconded by Mr. Dean. Motion approved unanimouss1y to allow the
variances hereafter described:

President, presented case to the board. To comply with state health
.regulations requiring rest room facilities within 75 feet'of a public
pool, owner requested a 3.5 foot variance., The building housing these.
facilities will be a separate and,independent building, unattached to
main building itself. A motion was made by Mr. Dean that the appeal
be granted in accordance with the application submitted'. Motion'
-seconded by Mr. Logan. Motion passed unanimously with no further dis-
cussion.
