Straub John Logan . Edward Walker Henry St. Jean, Acting Secretary .,The meeting was called to order at 1:30 P.M. by Chairman Batstone. Mr. Richard B116kendorfer, Electrical Inspector,'was also asked-to attend' to provide the board 'technJ cal' background a,s relates to UL acceptance procedures. Mr. David Corter, Mr- Cleland, Jahn Meinberg and George Sumpter also attended. The equipment in question was manufactured by Friedrich and modified by Mr. Cleland for use as swimming pool heaters.- After much discussion, it was determined that the equipment was not UL approved. Mr. Walker made,a motion as follows: "I move that the request for a variance from the decision of the Building Official regarding George Sumpter, owner-Case I, and Dakota . Greenwald, owner Case II, be denied by,this Board." Joseph Straub seconded motion. There were three "nays" b'y Messrs. Batstone, Walker and Straub.-'Mr. Logan voted "aye". Motion denied. Mr. St. Jean advised if they wish they could appeal to the PCCLB. The last'case, Case IV, was attended by Mrs. Rogers,'Contractor, Mr. Fred Barrett, Jr., owner, and Will Alexander, Architect.- This case was for a variance request as there was no fire wall and the waiver was for the allowing of a one hour wall vice three hour wall as required by the table. 'This-store'is Hobbyt-own located'at Countryside Mall adjacent to J. C. Penney's. After.discussion, the board felt the provisions of Table 600 did not adequately cover this type situation. Mr. Straub made the following motion: "Upon consideration of the appeal,of Mr. Fred .J. Barrett, Jr., Space 235 of lower level of Countryside Mall concerning a request for variance'on Table'500 of the Southern Building Code, 1976 edition, as pre-amended and adjusted that this variance be granted with the use of the approved wall by the Fire Marshal." Mr, Walker seconded motion. Motion carried unanimously. Mr. Walker then made a motion that future similar cases at Clear- water and Countryside-Malls-would be handled by polling the board .members., The. BOARD OF ADJUSTMENT &•APPEALS ON BUILDING (FLOOD CONTROL) WEDNESDAY, OCTOBER 10, 1979 MEMBERS PRESENT: John.Batstone Joseph Straub. John Logan Edward Walker Henry St. Jean, Acting Secretary The meeting was called to-order by Chairman Batstone at j 2:45 P.M. j Mr. Ronnie Tzekas, Mr. Vellieux,-Mr. George Moritz and Attorney' McFarland attended the meeting. Mr.. McFarland explained the request. 'They would like•to put an addition on the existing building on 551 Clearwater Pass with•a'variance of 3.3 feet to r a finished floor elevation of 8.70 feet.' It will mean additional. seating 'capacity,for ninety people and two service stations. The addition will be floodproofed with cedar siding. The present building is on concrete pilings. After much discussion; John Logan made'a motion as follows:, "Upon. consideration of the appeal of Dalip Tzekas from the decision of the Building Inspector concerning 551 Clearwater Pass, Clearwater Beach, Florida, it-appearing after this, duly constituted hearing that there are practical difficulties and unnecessary hardships in carrying out the strict letter of the provisions of the Flood Control.0rdinance, I•move that we grant him a ,variance of 3.3 feet below the 12.foot required elevation in accordance,.with the'applica-- tion." Box 4748 Clearwater, Florida 33518 RE: Mechanical Eguipment Dear Mr. Ayres: Discussions have been made-regarding Mechanical Egulp- ment design to heat potable water on residences. These, units have been tested through a U.L. approval to be used under certain conditions. Xf these units are used for any other-purpose than to heat potable water for the residences they would not be, approved for converter installation.. That is,, if a water heater is designed to heat water for bathing, wash- in'g and laundry units it would not be acceptable'to use this heater to heat a Swimming Pool.
