' e s. ?• f F BOARD'OF ADJUSTMENT & APPEALS ON BUILDING WEDNESDAY,'FEBRUARY 7, 1979 MEMBERS PRESENT: John-Batstone Joseph Straub John, Logan Edward Walker Edwin Blanton MEMBERS ABSENT Forest Dean - Excused ALSO PRESENT: Henry St. Jean, Building Inspector The meeting was called to order by Chairman'Batstone at 2:00 P.M. Mr. William Nunamaker, representing himself, explained his request. He proposed to create a watchman's living quarters in an existing storage building. This occupancy was approved by the Zoning Board of Adjustment & Appeals and the City Commission. Section 403-Mixed Occupancy Separation Requirements 'of the Standard Building Code - was interpreted by the Fire Marshall to be a four hour separation., Mr. Nunamaker stated that the principal use of the building was sorage' and the watchman's quarters were accessory to the principal use. -The Board reviewed Section 403.1(c) of the Code-and after much discussion, Mr. Nunamaker agreed to install an audible alarm system and smoke alarm system plus a one hour fire rated wall with 3--5/8" of cellulose fibre all the way to the roof.. A suspended fire rated ceiling with 611'of insulation will be installed in 'living quarters. Mr. Logan made the following motion after considerable discussion and. questioning: "Upon consideration of the appeal of William Nunamaker from the decision of the Building Inspector concerning 625 Grand"Central Avenue, Lot 3, Block 17, Milton Park, Clearwater, Pinellas County, Florida, it appearing after this duly constituted hearing that there are practical difficul•ties'and unnecessary hardships in carrying out the strict letter of the provisions of the Building"Code Ordinance, I move that such appeal be granted in accordance with the application submitted herewith." Mr. Straub seconded`the motion. All members voted yes, except Mr. Batstone"who voted no. Motion carried., Appeal granted. 1 1 .4 r. The second case•was presented by Mr. Louis A.'Vanech concerning his recently`constructed.elevated restaurant at-700 Bayway Boulevard, Lot 24,.Block'•A, Bayside Subdivision #5, Clearwater Beach.. Mr, Vanedh is requesting.a variance from Section 703.1, Paragraph A, Standard Building Codes which requires protected openings when openings are within fifteen feet of the property line. This building P. is constructed ab a three story building with a parking area on the ground level, the restaurant on the second'level and offices on•the third level.' There is a view of the bay from the restaurant level. The.building is seven feet from the property line on one side and twelve feet from the neighbor's building. Mr. Vanech proposed to install wire glass windows in these openings, however, after reviewing ,the various types of wire glass, he was most dissatisfied as the wire glass would obstruct the view of the bay and is inclined to cause patron's discomfort. After considerable discussion by the Board, Mr. Straub made the motion that Mr. Vanech's appeal be granted and Mr. Logan seconded same. There were two'yes votes and two no votes. Therefore, the motion did not carry-. i. , After the decision, the Board then suggested to Mr. Vanech that he contact some major glass manufacturers to find an acceptable wire -glass window.
