(FLOOD CONTROL)
THURSDAY, AUGUST 17, 1978

The-meeting was called to order by Chairman Batstone at 2:00 P.M.
Case I:

Mr. John W. Cornell and his contractor, Burton Lemberg, explained they
were requesting a variance of 21411 to build a residence at floor elevation
818" instead of the required 111, mainly to keep the house at the same
.level as the surrounding houses. Mr. Cornell had pictures of the houses
.on both sides. He said he is aware of the insurance premium increase.
After some discussion, the following motion was made by Mr. Dean: "Upon
consideration'of the appeal of John W,, Cornell from the decision of the
Building Inspector concerning 3137 Downing Street, Lot 11, Downing Sub-
division, it appearing after this duly constituted hearing that there are
practical difficulties and unnecessary hardships in carrying out the strict
letter of the provisions of the, Flood Control. Ordinance as it affects such
structure and that the same can be varied within the intent of the Flood
Control Ordinance, I move that such appeal be granted in accordance with
.the application submitted herewith, Mr. Walker seconded the motion. Motion
i carried unanimously.

Mr. James A. Baxter, Attorney, representing two brothers from Connecticut,
Messrs. James and John Sofronas, requested a variance to build a restaurant,
namel.y,a pizza place, at Lot 79, 80 beginning at Northwest corner of Lot 127
on Gulf Boulevard, Clearwater Beach, The structure is to be two stories.
The first floor will. be below the required 121 Level to be mainly for pick--
up orders, counter and storage and the second floor will, be dining area.
There will be'a double ramp up to meet requirements for the,handicapped'and
any greater rate of ascent would be difficult. After some discussion, Mr.
Logan made-the following motion: "Upon condsideration of the, appeal. of
James and John Sofronas from the decision of the.Building Inspector concern-
ing Lot 795 80 on. Gulf Boulevard, Clearwater Beach, for a variance to build
at 8'feet, it appearing after this duly constituted hearing that there are
practical difficulties and unnecessary hardships in carrying out the strict
letter of the provisions of the Flood Control Ordinance as it affects such
structure and that the same can be varied within the intent of the Flood
Control Ordinance, I move that such appeal be granted in accordance with
the application submitted herewith." Mr. Dean seconded the motion. Mr.
Walker abstained because-he was the architect involved. Motion carried
unanimously.
Meeting adjourned at 2:50 P.M.

Gentlemen:
The City of Clearwater Building Board of Adjustment & Appeal has received
written application requesting a variance from the City of Clearwater Flood ,
Control, Chapter 7, City Code of Ordinances, requiring floor elevations to
be above the 100-year flood level, as designated by the Federal Insurance
Administration.
You are hereby duly notified that there will be a meeting of the Building
Board of Adjustment & Appeal on Thursday, August 17, 1976, at 2:00 P.M. in
the Operation's Center Conference Room, City Hall Annex, 10 South Missouri
Avenue. Applicants must appear'in person or be represented by a duly
authorized agent.
NOTE: In order for the Board to be properly informed, it is recommended
that the following information be furnished:
1. Show existing elevation of seawall cap, street and land where
structure is to be placed.
2. Show approximate proposed elevation of first floor.
3. On isolated lots, snapshots of structure on either side of
property would be helpful.
