Walker Joseph Straub Re: NOTICE OF HEARING - August 3, 1978 Chapter 7 - City Code of Ordinances (Flood Control) 231 Bayside Drive - Lot G -- Block 2 Gentlemen: The, City of Clearwater Building Board of Adjustment & Appeal has received written application requesting a-variance from the City of Clearwater Flood Control, Chapter 7, City Code of Ordinances, requiring floor eleva- tions to be above the 100 year flood level, as designated by the Federal Insurance Administration. You are hereby duly notified that there will be a meeting of the Building Board of Adjustment & Appeal on Thursday, August 3, 1978, at 2:00 P.M. in the Operation's Center Conference Room, City Hall Annex, 10 South Missouri Avenue. Applicants must appear in person or be represented by a duly authorized agent. NOTE: In order for the Board to be properly informed, it is recommended that the following information be furnished: 1. Show existing elevation of seawall cap, street and land where structure is to be placed. 2. Show approximate proposed elevation of first floor. 3. BOARD'OF ADJUSTMENT & 'APPEALS ON BUILDING (FLOOD CONTROL) MINUTES OF MEETING _ AUGUST 3, 1978 MEMBERS PRESENT: John Batstone, Chairman Joseph Straub Edward Walker t William Tripp,.Acting.Secretary 'ABSENT: Forest Dean John Logan The meeting was called to.order by Chairman Batstone at 2:15•P.M. Attorney Donald 0. McFarland, representing Mr-. Dalip 0. Tzekas, requested a variance from the flood plane requirement to allow construction at 8' foot elevation. There was much discussion and it was noted that the surrounding properties, except for one side, were owned by Mr. Tzekas' father, and they were all at the same level as that requested. The first floor of the proposed structure was changed from 3 feet to 4 feet below the 100-year flood level designated by the Federal Insurance. Administration on the owner's acknow- ledgement letter. Mr. McFarland stated his client was well aware that the flood insurance was required. Mr. Walker made the following motion: "Upon consideration of the appeal of Dalip 0. Tzekas from the decision of the Building Inspector concerning 231 Bayside Drive, Lot G, Block "21', Unit'A of Bayside Subdivision No. 4. It appearing after this duly constituted hearing that there are practical difficulties and unnecessary hardships in carrying out the strict letter of the provisions of the Flood'Control Ordinance as it affects such structure and that the same can be varied within the intent of the Flood Control' Ordinance, I move that such appeal'be granted in accordance with the appli- cation submitted-herewith. Mr. Straub seconded the motion. Motion carried unanimously. Meeting adjourned at 2:45 P.M. W lliam E.
