BOARD OF ADJUSTMENT'& APPEALS
ON BUILDING
MEETING - MAX 25, 1976
MEMBERS PRESENT:

Meeting called to order at.2:00 P.M. by Mr. Batstone. Follcwing two cases were heard.
1l. 907 & 909 N. Ft. Harrison Ave., Lot.3, Blk. 3, Ira Nicholson's Addn.
Mr. John M. Anderson represented himself. Mr. Anderson requested permission from
the Board to relocate a Belleair Bluffs Interior Design business in Clearwater
which he stated,would upgrade properties in the N. Ft. Harrison area, which is
presently zoned commercial. This building is a-duplex structure, wood frame
construction,,and he would occupy one-half of the building as his principle'
residence. .A concrete floor is to be placed in.the existing metal garage at
rear of property..
Theapplicant requested to install the Rollins Protective Service Fire Alarm
system`in place of a water sprinklered system, as requested.by the Building
Official and Fire Marshal. This being of wood frame construction and located
in the #1 Fire District, it was felt that better protection could be provided
by a sprinkler system. A representative from the Rollins System was present
and demonstrated its use to the Board. A short discussion followed with questions
i and answers from the members and Marshall Buhmeyer.
Mr. Logan moved that the request for the Rollens Protective System in lieu of
the sprinkling system be approved. Motion seconded by Mr. Dean, with the
provision that if residence is removed and structure is to be used entirely
as commercial, a sprinkling system will be required. Motion carried. Appeal granted.
2. The second case was that of Mr. & Mrs. John A. Sloan. The legal description
of the request is Lot 2, Block 24, Belleair Subdivision, a/k/a 1324 S, Ft. Harrison
Ave., Clearwater. This case was different, in that Mr. & Mrs. Sloan propose to
recover an authentic Clearwater atmosphere for their antique and hand crafted items.
They felt that the ftelli.ng on the edge of the Belleview Biltmore. Gulf Course'
being of 1890 vintage, classified it as "historical". But, being that.the structure
is of wood frame construction and located in the #1 Fire Zone, they felt that in
bringing this building up to code, would no longer classify it as a historical
site.
Mr. Batstone directed the Board members to the fact that he did not feel this
Board was justified in determining whether or not a building was of historical
nature, and stated that he felt the only action the Board should consider was
the requested use of the building, and that the Building and Fire Departments

should require'applicant to bring building as near as possible to.the
-building code. Then if the,owners'wish to disagree with City recommendations,
they aoul&i,appeal the decision to the Board.
Marshall Buhmeyer informed Mr. Sloan that either a sprinkling system or
'_..: Protective Fire Alarm Service, such as Rollens',rbe installed.' Mr. Sloan'
agreed that before any.work was started:on renovation, plans would be
submitted to the Building Department and,Fire Department.for approval.'

FLOOD CONTROL MEETING
MAY 25, 1976

Meeting,called'to order at 3:15 P.M..by Mr. Batstone. Following.two cases
were presented.
1. Lot 13, Block`12, Mandalay Subdivision, Clearwater Beach.
Mr. Ralph Coxhead was present to represent himself. He desires to erect
a single family home, the first floor to be 2-feet below the 12-ft. flood
level. He felt that the 2-'ft. variance was needed to"be in line with
the neighborhood of homes.
He was advised that flood insurance.rates would be increased commensurately
with the extent of the deviating from said 100-year flood standard. Mr.
'. Coxhead assured the Board he had investigated the insurance rates andwas
agreeable.
c? Motion was made by Mr. Walker variance be granted, seconded by Mr. Dean.
/ Appeal granted.
d, 2. The second case to be heard was that of Mr. John Logan, General Contractor,
representing Mr. Wallace Lee, General Manager of the Clearwater Beach
Hotel, 500 Mandalay'Avenue.
Plans are in the Building Department for remodeling the structure at this
time, but Mr. Logan requested a variance in floor elevation in the new 20-
unit building.to be 71-511 and the lobby and office to be 81-511. He felt
the new building and addition to old building should conform to existing
elevations of surrounding buildings and landscaping. The first floor would:
be approximately 4+-611 feet below the 100-year flood level. After a brief
discussion, motion was made by Mr. Dean that variance be granted. Motion
seconded by Mr. Walker. Appeal granted. Meeting adjourned at 4:00 P.M.
