WHEREAS, it has become necessary for the City Commission of the
City of Clearwater, Florida, to recognize certain low elevation areas of

the City as flood hazard, areas; and

Administration in order for the City residents to receive flood insurance
coverage;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY ;
COMMISSION OF THE CITY OF CLEARkVAT?C-R, FLORIDA:
Section 1, Section 7-•9 of Article I, In General, of Chapter 7, Buildings,
of the Code of Ordinances of the City of Clearwate'r, Florida, 1962, is hereby
repealed, and there is enacted new Sections 7•-9 and 7-•10 of said Chapter 7
to read as follows: ?.
Section 7-9• No building shall be erected in areas designated
as flood hazard areas by the U. S. Army Corps of Engineers
unless constructed in such a manner that would meet tlee following
criteria established by the Federal Irisuran?-e Administration:

1. New construction or substantial irnpi•ovements of
residcntial structures shall have the lowest floor
(including bascn-lent) elevated to the base flood level
of the 100 year flood as designated by the 1''ederal
Insurance Admirnistration. .
2. Now construction or substantial irnproverlionls to

Section 7•-10. Any person, persons or corporate entity may seek relief
from the terms and provisions of this ordinance by making application
to t:hd Board of Adjustments and Appeals on Building of the City of
Clearwater, as provided in Sections 111 through 115, inclusive, of
the Southern Standard Buildinp`Cor?e, which may grant variances to
the provisions contained in this ordinance.
Section 2, This ordinance "shall take precedence over all ordinances or
j: parts of ordinances in conflict: herewith to the extent of s•uelr conflict.
Section 3. Any person, organization, sGciety, association or coxporatiop
or any agent or represczitati,,c thereof, who shall violate the provisions of this

Ordinance shall be subject, upon conviction in the Municipal Court, to a fine,

not exceeding the sum of7iie 14undred'Dollars'($500. 00), -or''irnprisonment in
the City Jail for not exceeding sixty (60) days, or by both such fine aiid imprison
ment in the discretion of the Municipal Judne;
Section 4. Should any part or p 'ovision of this ordinance be declared by
y a court of competent jurisdiction to be invalid, the same shall not'uffect the
.validity of the ordinance as a whole, or any part thereof other than the part
declared to be invalid.
Section 5, This ordinance shall fiecomc effective immediately upon
• its passage. ,

The City of Clearwater Building Board.of Adjustment & Appeal has received written
applications requesting a variance from the'City of Clearwater Flood Control,
Ordinance #1426, requiring floor elevations to be above the 100-year flood level.

You are hereby duly notified that there will be a meeting of the Building Board
of Adjustment & Appeal to hold hearing Wednesday, 2:00 P.M., .April, ll,,1973':
in the City Commission Room, 3rd floor, City Hall. Applicants must appear in
person or be represented by a duly authorized agent,
NOTE:
In order for the Board to be properly informed, it is recommended that the following
information must be furnished.
1. Show existing elevation of seawall cap, street and land where 'structure
is to be placed.
2. Show approximate proposed elevation of first floor,
?3. On isolated lots, snap-shots of structure on either side of subject
property.would be helpful. ;
It will be necessary for you to complete and sign the enclosed Board of Appeals
form before the'hearing.
