RELEASE
KNOW ALL MEN BY THESE PRESENTS that the undersigned CITY OF
CLEARWATER, for and in consideration of the sum of NINE THOUSAND NINE
HUNDRED NINETY FOUR ($9,994.00) DOLLARS, in hand paid, the receipt of
which is hereby acknowledged, does hereby release, acquit and forever
discharge, RONALD T. HIRSCH individually and d/b/a RONALD T. HIRSCH
AND ASSOCIATES, and BENETECH, INC., their servants, agents, employees,
heirs, successors and assigns, of and from any and all claims, demands,
damages, actions, expenses, loss of service and causes of action, arising or
growing out of any matter or thing from the begining of time down to the date
of these presents, and more particularly of and from any and all claims,
demands, damages, actions, expenses, loss of service and causes of action,
arising out of the understatement of City of Clearwater's contribution to the
City Employees Pension Plan based on the report rendered by Ronald T. Hirsch
d/b/a Ronald T. Hirsch and Associates dated December 17th, 1985.
That it is understood that this release constitutes the payment of that
certain claim for damages resulting from said actuarial valuation report.
The undersigned further declares and represents that no promise,
inducement, or agreement not herein expressed has been made to the
undersigned, and that this release contains the entire agreement between the
parties hereto, and that the terms of this release are contractual and not a
mere recital.
We further state that we have read the foregoing release and know the
contents thereof, and we sign the same as our own free act.
