Water Division / The meeting' was called to order at 9:34 A.M. . Tom Pudelski moved to approve the minutes of the meeting of March 7. 1990. The motion was duly seconded by Glenn Perry and carried unanimously. Douglas ,Carey, a former Police Officer, addressed the Committee. He had written a letter to the Committee asking for, clarification as to whether he could work as a security guard at Morton Plant Hospiuil and not put his job-connected disability pension in jeopardy. Mr. Nicholson advised Mr. Carey it was his opinion that this job involved work which was similar. to 'what be did as a Police Officer and, therefore, he could not work as a guard. Mr. Laursen stated the Trustees considered this question at their last meeting as it related to William Harvey, a former Firefighter. who wanted to work as a dispatcher for Medic One. At . that meeting, the Trustees placed this before the Pension Advisory Committee for it to develop a proposal for the Trustees to consider. Mr. Harvey was advised he could not work as a dispatcher because he would use knowledge he obtained as a paramedic and he would be perfonning a job similar to what he was doing for the City. A lengtby discussion ensued concerning the type of employment disability pensioners may pursue. Mr.Pudelski and Mr. Perry disagreed with Mr. Nicholson's opinion that someone could not use' knowledge gained while employed with the City in other employment (Le. an electrician could work in an electrical supply store and not jeopardize his pension). At the conclusion of the discussion. it was decided that each Committee member would submit a draft proposal a1\d the Committee would discuss. it at a future meeting. Tom Pudelski moved that this matter be tabled until all members could write their ideas and discuss them at another meeting. The motion was duly seconded by Glenn Perry. Mr. Nicholson suggested they discuss this at the first meeting in May and all members agreed. The Committee considered the request of Edward Voiland, former Building & Maintenance Superintendent, for a job-connected disabiUty pension which was remanded to the Commiltce hy the Trustees. This was remanded for further consideration but a non-job-eonnected disability pension was approved in the meantime. It was indicated a hcaring may need to be held in this matter. Charles Castagna, attorney for Mr. Voiland, addressed the Committee on his behalf. Mr. Castagna stated letters were submitted from Dr. Kedan and Dr. Smitherman which stated Mr. Voiland's medical problems were job-related. The Committee sent Mr. Voiland for an IME which was performed by Dr. Williamson; howevcr, Dr. WiJ1iamson's report was inconclusive since the doctor was not allowed to perform a stress test. Mr. Castagna suggested the Committee allow the IME to be completed; and, if Dr. Williamson is in agreement with the other doctors, no hearing will need to be held. Mr. Nicholson asked about the workers' compensation claims that should have been filed in this case if it was job-connected. Mr. Castagna was not able to address this question. Mr. Laursen stated. there have been cases where employees were granted job-connected disability pensions without having filcd workers' compensation claims. Mr. Perry stated he did not feel the letters from Mr. Voiland's doctors indicated that the condition is job-related. Mr. Nicholson stated the Committee is not questioning whether Mr. Voiland has a disability; therefore, he docs not feel a stress test is necessary because it will not help the doctor determine whether the disability is job-connected. Mr. Voiland advised the Committee a sonogram was performed by Dr. Kedan which may be helpful to Dr. Williamson in reaching a conclusion. A discussion ensued concerning the need for a hearing. At the conclusion it was determined that Mr. Lance would depose Mr. Voiland in order to deteniline exactly what his claims are going to be. In addition, all Mr. Voiland's medical records will be submitted to the Committee for its review. This may eliminate the need for live testimony from the doctors. After the records are received and the deposition is taken, a hearing date can be schedulcd. This hearing will not be held during a regular meeting. Mr. Nicholson will contact Dr. Williamson and ask him to make a determination based on the information he already has. He will also ask the doctor if he would review the sonogram that was perfonned by Dr. Kcdan. Mr. Nicholson will advise Mr. Castagna if Dr. Williamson will look at the sonogram. Deborah Patterson, Meter Reader I, Utilities Finance Division, addressed the Committee regarding her request for a job-connected disability pension. She presented the Committee with a letter from Dr. Slomka dated 1/15/90. She also had a letter from Dr. Abrahamsen which indicated she had reached MMI on 8/19/87. Ms. Patterson recently had an MRI. Mr. Nicholson advised Ms. Patterson to have Dr. Slomka write another letter based on the findings of the MRI and she needs another letter from a doctor who specializes in the field of her injury. Ms. Patterson asked if she could get a leller from a doctor that the City sent her to and she was advised she could. Mr. Nicholson also advised her the Committee takes two meetings to make a determination and this meeting will not be considered as one of the two. I I 1 t , l , I Jacqueline Sulek, former Assistant Purchasing Manager, Purchasing Division, recently spoke to Miles Lancc, Assistant City Attorney. regarding her request for a non~job-connected disability pension. In response to a question raised by the Committee at an earlier time. Mr. Lance had written a memo indicating Ms. Sulek could not change her vested pensio'n to a non-job~connected disability pension which was based on the assumption thai she became incapacitated after she left employment. Ms. Sulek will be coming to thlll arca Bnd will contact Mr. Lance when she arrives. She will need to prove she wns disabled before she left the City in order to be eligible for a disability pension. The Committee considered the request of Wayman Pearson, Sanitation ,Superintendent, Sanitation Division. to vest his pcnsion. Tom Pudelski moved that Mr. Pearson's request be granted. The motion was duly seconded by Glenn Perry and carried unanimously. With respect to the request of John Greiner, Survey Party Chief, PubH.: Works Department. for a job-connected disability pension. a letter from his doctor indicated he reached MMI on 2122/90 but did not give a disability rating. I i t l I Mr. Nicholson stated Mr. Greiner should be advised he must exhaust his workers' compensation hcnefits before he receives a pension. Mr. Lance stated there is nothing in the ordinance that says an employee must apply for workers' compensatioil benefits and these CDses should be handled on an individual basis. Mr. Greiner's letters from his doctors arc not specific enough. He needs to be notified that the Committee needs new letters. Mr. Nicholson asked Mr. Laursen about the memorandum he wrote concerning the phone call he received from a citizen about a fonncr employee on disability who docs not appear to be disabled. The employee was John Ferzola. a former Firefighter. Mr. Nicholson stated he would " like to send Mr. Ferzola a letter or have him appear at a meeting. Mr. Lnnce suggested they ., defer action on this until the next meeting. Tom Pudelski moved that the Committee defer action on this matter until the next meeting.
