The meeting, was called to order at 9:41 A.M.
Glenn Perry' moved to approve the minutes of the meeting of January 4. 1989. The motion was
duly seconded by Tom Pudelski nnd carried unanimously.

Tom Pudelski moved to accept into membership the three (3) employees listed above. The
motion was duly seconded by Glenn Perry and carried unanimously.
Joe Lain and Daniel Doyle, new employees in Park!; & Recreation, were part.time employees and
are now full-time. Their physical examinations arc over one year old. The Committee
requested they be sent for a new physical.
Tom. Pudelski moved that. from this point on, any employee applying for acceptance in the
Pension Plan whose physical examination is over one year old should be sent for a new
,physical prior to' being accepted. The motion was duly seconded by Glenn Pcrry and carried
. ,unariimously.,
. The Committee discussed Peter Fire's request for a job~connectc:d disability pensio.n;
Glenn Perry' moved that Mr. Fire be granted a job-connected disability pension since all
materials were in order.
Discussion ensued. It is well documented that Mr. Fire's injury was incurred while on official
City, business. However, John Nicholson advise,d the Committee members that it was past
practice to send aU disability pension applicants to another doctor for a third opinion. He also
stated the letter from Dr. Gosch is not (()nclusive in that it says "Ukely permanent" in
reference to Mr. Fire's injury. This letter will need to be more specific.
Glenn, Perry moved that, in light of past practice. Mr. Fire be sent to a third doclor for another
examination. The motion was seconded by Tom Pudelski and carried unanimously.

,The City Nurse will supply Mr. Fire with a list of doctors from which to choose and schedule an
appointment for him.

Mr. Nicholson questioned Secretary Laursen about nn Item In the minutes from the Trustees'
meeting that referred to the dismissal of 11 lawsuit flied In regard to the Pension Plnn. Mr.
Laursen explained this referred to the suit filed by Syd Snair concerning the age 4S
requirement nnd Mr. Snnir's contention this is discrimination. The suit was dismissed on a
technicality nnd Inter reinstated by the court.
The Committee received a request from Earl Stnnford\ Wnter Division, to be acceptcd into the
Pension Plnn under the recent change in the plnn that eliminated the 4S~ycnr age limit.
Mr. Stanford was over the age of 4S when he was hired several ycnfs ago.
Discussion ensued concerning this mntter and what the Committee would like to do about those
employees who were over age 4S at the time of hire and may now wish to enter the Pension.
Plan. Mr. Laursen suggested the Committee members may wish to appoint someone to attend
the next meeting of the Trustees to discuss this matter and come to a consensus as to how this
should be handled. John Nicholson wBl attend this meeting on February 13. 1989. It was the
consensus of the Committee members that 1) the City pick up the cost of the physicals that
would. be required as they do for all new hires nnd 2) a memo be sent to an employees over the
age of 45 at the time of hire giving them a time limit of 90 days from the date of the letter to
apply for acceptance. Mr. Nicholson will advise the Trustees of the Commiuee\s suggestion.
Mr. Laursen stated there may legal questions that ,have to be answered before any action is
taken on this issue. among them being whether or not employces even have an option.
Mr." Perry raised a question regarding the new legislation recently passed enabling employees
to vest their pension after five years of service. He asked that Mr. Laursen request an opinion
from Miles Lance as to whether or not this applies to the City's pension.
. . Mr. Nicholson advised the Committee that be had recently attended the State Convention of
Firefighters., At, the convention. he received material about the firefighters' health project.
This was instituted at the University of Miami and Is an effort to improve the health of the
. State's fire service personnel. He suggested this might be something the City should consider
not only for fire and. police personnel but all employees. He requested a copy of the materials
. be given to the other Committee members. D.S well as the Police and Fire Chiefs.
'Glenn Perry moved the meeting be adjourned. The motion was duly seconded by Torn Pudelski
and' carried unanimously. The meeting adjourned at 10:07 A.M.
