Finance Director Glenn Perry, Parks & Recrcation/CW A UnIon Representative The meeting was called to order at 9:30 A.M. John Nicholson moved to approve the minutes of the mceting of April 20, 1988. The motion was duly seconded by Charles Dunn and carried unanimously. With regard to John Welch, all the letters from the doctors have not yet been received so no action can be taken. The Committee considcred the request of Charles J. Cooper, Police Officer. Pollee Dcpartmcnt. . for a pension based on his years of service. Charles Dunn moved to approve the rcquest of Charles Cooper. The motion was duly seconded by John Nicholson and carried unanimously. John NIcholson moved to approve the request of , Dorothy Donley. The motion was duly seconded by Charles Dunn and carried unanimously. " " , r Charles Dunn advised that Michael Stuart has resigned from the Police Department thereby creating a vacancy on the Pension Advisory Committee. Therefore, two vacancies must be filled at the' election in June. The date for the election is June 23, 1988. from 7:00 A.M. to 7:00 P.M. Nominations must be received by 3:00 P.M. on June 3, 1988. Nominees must be members of the Pension Plan. Said individuals must be nominated by another member of the Pension Plan via a nomination form or memo to the Payroll Division. Absentee ballots must be submitted by June 20, 1988. Poll workers must be supplied by the three unions. It also was suggested each union be represented (vhi poll workers) at all times throughout election day. " " :;\ 'Chairman DUDn would like something put in City Reflections upcoming ejection. ~ light of recent newspaper articles, John Nicholson raised the question of the possibility of eliminating the option of using sick leave to extend onets retirement date. Secretary Laursen stated the City Manager has indicated a need to review the rules to see if modifications or changes arc needed to ensure there will be no inappropriate use of sick leave. notifying employees of the : ,', !' ~. ", Discussion ensued regarding the use of sick leave. John Nicholson and Secretary Laursen agreed ;,', ' ,there has been no problem with this procedure thus far. Mr. Laursen advised nothing could be '. lc . done unilaterally due to current contract provisions and the procedure that must be followed in ,;',' , ,order, to change the Civil Service Rules and Regulations. ::,:'<:;)John Nicholson questioned the settlement agreement reached between the City and ;;',>,' Steve Zimmerman. This agreement settled a lawsuit concerning Mr. Zimmerman's membership in ,,(,;, the Pension Plan which was filed by him after he was re-employed. Mr. Zimmerman was \~/, originally employed in 1975. He was fired in 1984 but was rehired in 1985 after an arbitrator ruled '{~, ' ,.....,., ' '~~ ~ " ~, . At the time he was dismissed. he withdrew his pensIon monics , '-",.,., because he understood he had no other optlon. The lawsuit was filed against the City seeking credit for the yeBrs of service hc lost when he withdrcw th,c monies. Discussion ensued concerning the cost of this agreement. The Committee was advised by the Payroll Serviccs Manager and the Finance Director that no exact amount could be determined as to the cost. . When Mr. Zimmennan left the manics paid by the City into the Pcnsion Plan for him were left in the fund unassigned to any particular individual. By the terms of the settlement and the use of a Finance Departmcnt prepared ratio of employee-to-employcr contributions, Mr. Zimmcnnan has been given a pension benefits date of Iune 19, 1979. Chairman Dunn requested a letter from D. R. Perkins. Payroll Services Manager. explaining bow this was done. I~~;:: ~'~~~ :)'(1 ,l'~< " :~ ., '":.< 10hn Nicholson stated his objection to the City Commission allowing Steve Zimmcnnan to entcr thc pension as of June 19, 1979, instead of the date in 1985 when he was rc-employed. The Pension Advisory Committce already made a recommendation regarding this individual. Mr. Nicholson feels this situation points out his concern with the City Commission also serving as Trustees of the Pension Plan. " , , , ~~.': ., t~ ,". The question was raised conccrning Lois Maroon's rcquest to be admitted to thc Pension Plan and the status of her request. The Committee members feJt these two situations are similar. It was explained ,by Miles Lance, Assistant City Attorney J that Ms. Maroon left voluntarily and was over age 45, when she was re-employed and cach situation must be looked at individually. One slight :factor will makc the' difference as to what action can be taken. ;.','" <GD.;aniel Deignan. Financ'e Dircctor J advised the Committee that in light of" Michael Stuart's ;',:'"',, resignation, they would need to appoint someone else to serve on the committee fonned to select another actuary. The Committee appointcd 10hn Nicholson to replace Mr. Stuart.
