Attorney for John Welch The meeting was called to order at 9:46 A.M. lohn Nicholson moved to approve the minutes of the meeting of January 21, 1988. The motion was duly seconded by Michael Stuart and carried unanimously. John Nicholson stated for the record that Deborah Storey, Police Service Technician, would not be accepted at this time pending the receipt of infonnation which was not contained in her physical regarding her blood pressure. lohn Nicholson read. the namc(s) of the following employee(s) to be accepted into membership in the Pension Plan: Date of PtDP]OYJ1H~nt Pension Elie-. The motion was' duly seconded by Charles Dunn and carried unanimously. lohn Nicholson moved not to approve Deborah Storey for membership until the blood . pressure information is received. When the Committee receives his report they will vote on this matter. Cary Singletary, attorney for John Welch, argued on behalf of his client's request for a job~connected disability pension. He requested the CommiUee vote today to grnnt Mr. Welch a job-connected disability based on the medical information before it. ", A lengthy discussion ensued rcgarding whcther or not any ncw information would bc presented if a full henring were held in this maUer. John Nicholson and Michael Stuart felt they had sufficient evidence before them to vote today on this maUer. Charles Dunn was of the opinion that a hearing was necessary. At the conclusion of this discussion. John Nicholson moved that no hearing would be held in this matter. The motion was duly seconded, by Michael Stuart. A vote was taken on the motion. Iohn Nicholson and Michael Stuart voted "aye;" Charles Dunn voted "nay:l The motion carried. John Nicholson moved that John Welch be granted a job-connected disability pension based on Mr. Welch.s disability that resulted from job circumstances and which is described as psychological. said disability making him permanently unable to perform his job. This disability is documented by medical statements from Dr. Luis C. Gutierrez. dated 9-25-87; Dr. Afield, dated 11-4-87; Dr. F. Kevin Butler. dated 2-3-87; and Dr. Theodore 1. Machler. dated 2<i-87. The motion was duly seconded by Michael Stuart. After B reminder from Secretary Laursen. John Nicholson amended his motion to reflect the . effective date of the pension would be April IS, 1987. Michael Stuart seconded the : amendment. A vote was taken on the motion as amended. John Nicholson and Michael Stuart voted "aye;" Charles Dunn voted "nay.1t The motion carried. No new infonnation has been received on Lenard Dixon. ,Nancy Degner. City Nurse. presented the drafts of two letters to be used to s,end to doctors when pension applicants are requested by the Committee to receive an independent medical examination. Michael Stuart requested copies of the letters be given to the Committee members for their review and later action. . Discussion ensued concerning the content of the letters. At the conclusion of the discussion. Michael Stuart moved the matter be tabled until the next meeting to afford Committee members an opportunity to review the letters and provide their input. The motion was duly seconded by John Nicholson and carried unanimously. John Nicholson asked Secretary Laursen whether a response has been received from the Attorney General for clarification as to whether or not the City Commission can act in a dual position (as Trustees and Commissioners). Secretary Laursen has received no response but will check on this. Discussion ensued with regard to Secretary Laursen's memo of January 20. 1988, in which he suggested standardized dates for the Pension Advisory Committee meetings be established.
