Mr. Berry had previously been denied due to high blood pressure. and no ~(~/::::< ',there was no indication that it is now under control. Mr. Sanders had a back problem, and :~(:/ ~', ' . th~ Committee wanted more details as to what type of injury it is and whether or not it still ;:.~: ,,' '.' Dr. Paul Wallace's letter was acceptable except lettemead and there was some question as to its validity. ,from Dr. Wallace wriuen on letterhead. Dr. Lyster's letter did not state whether or not Mr. Woodard's injury was permanent. The doctor could Dot make a decision without another CT scan and MRI study being perfonned. Mae BishOp. Pollee Department; Nathaniel Golden. Public Works Department; Edythe Shelton, Police Deportment; and Snowden Baxter. Public Works Department for pensions based on years of servl,ce. Charlie DunD moved to approve these five pensions. Nicholson and carried unanimously. The motion was duly seconded by John Michael Stuan advised the Committee on the outcome of the meeting between the City Commission and the Pension Rewrite Committee. The Commission approved sending to referendum all consensus items. although they did have a few questions that must be answered. On the non-consensus items. they took lhe following actions: 1) the benefit was left at 2 1/2 times; 2)pcnsions still will be figured on last five years of employment: 3) an expression of policy was made concerning the disability definition; 4) the maximum benefit for disability benefits will be 100 percent of final salary; 5) for the first ten (10) years. recipients . of job-connected disability pensions will pay back 30 percent above what the salary would have been if pension was not being received; 6) the Pension Advisory Committee (PAC) will be increased to five (5) members; and 7) the final determination of eligibility (or disability pensions will be made by the PAC and only can be overridden by a 4-1 vote of the Commission. There was discussion concerning the elimination of the 45-year age limit. '\ '1 '"
