The moUcn was seconded by David Krieger and carried unanimously. .Chalrman Dunn stated he received a call from Officer John Welch requesting the status on hIs I . pension request. 'Chairman' Dunn Informed Mr. Welch his letters were not valid because they ! n~ed to be updated. He dId not understand since he had sent In a letter very recently. ChaIrman . ,'Dunn Informed him .the letter was Insufficient and he needed letters from two doctors not . ' " assocfat9d In the same practIce. Chairman Dunn suggested to Mr. Welch he may want to seek , . legal counsel for thIs matter. Mr. Welch IndIcated he would contact the Police union's attorney (Gary SlnQletary). to see if he would represent him. Chairman Dunn Informed Mr. Welch action would be'taken as soon as the necessary InformatIon Is receIved. The Committee considered the request of Charles Kimball for a lob-connected disability pension. \~ Chairman Dunn Informed Mr. Kimball he was unable to contact Dr. Schwab to verify the ' ~ Information contained In his letter. There seems to be a disagreement as to what percentage of dlsablllty Mr. Kimball has at thIs point. One doctor stated there Is a 10 percent dlsabllltYt one says 50 percent. and another says 100 percent. Chairman Dunn suggested and the othor CommUtee members concurred that It would be advisable to send Mr. Kimball to the Cllts doctor for an examlnallon In light of these differing opinions and In view of the fact that under the pension plan a person must be totally and permanently disabled. Chairman Dunn questioned Mr. Kimball about his condlllon. Mr. Kimball stated he Is In constant pain whether sitting or standing but walkIng gives some rellof. He has been working the desk at the Countryside sub-station but has not been on patrol. Slltl~g for eight hours is paInful. Chairman Dunn Informed Mr. Kimball he will again try to contact Dr. Schwab and also the nurse will schedule an appointment with the City doctor for him and contact him with the date and time. City Nurse Nancy Degner Informed the Committee the insurance company) Gallagher~Bassett, has written to Tallahassee to see why It Is taking so long to receive the requested Information. John Nicholson requested to see a copy of Mr. Brumage's latest accident report (fall in hole). Chairman Dunn requested the nurse forward to the Committee copies of this accident report and the letter to Tallahassee from Gallagher-Bassett. John Nicholson requested a legal opinion from Miles Lance as to when an employee Is considered to be terminated. Michael Laursen. Secretaryt stated his opinion would be the employee1s last day would be the day before his pension becomes effective. It depends on what date [s established. I.e. date set by Committee, date employee sets on form. or date to be established subject to computations being made by Personnel. It Is generally not the date of the meeting , unless the Committee approves It effective that date. Mr. Nicholson is requesting this Information specifically In regard to all Police Offlcers and Firefighters who received disability pensions since May of this year. Miles Lance stated it should be looked into to be sure there are no discrepancies. The concerns were raised In regard to Firefighters supplemental pension from the State. If an employee Is on pay status he has Insurance and all other benefits. Chairman Dunn stated although he would 11\(8 a legal opinion It would be his opinion the Firefighters are eligible for the supplemental pension as long as they are paid. A question was raised by John Nicholson In relation to the artIcles in the newspaper about whether or not the City Is looking Into reducing disability pensions. Discussion ensued regarding this matter. All suggestions made by the Pension RewrIte Committee are in the hands of the firm hired to review the matter. . Chairman Dunn stated his opinion regarding the "heart" bill as it relates to Police and Fire. He cannot agree with the bill In that it Is presumed If a person does not have something wrong with him at the time of hire and later develops heart disease, cancer, etc., it Is job related. He feels the City should look into having a no smoking policy for employees, new and old. The Fire Department already has such a rule. Chairman Dunn suggested this matter be looked Into very thoroughly with Chief Klein. the City Managert Mr. Weimer. Mr. Laursen and anyone else. Discussion ensued as to whether or not the other Committee members could support such a plan. Chairman Dunn moved to request the City and Police Department look Into establiShing a requirement that all new hires be non-smokers.
