CWA) The meeting was called to order at 9:36 A.M. John Nicholson moved to approve the minutes of the meeting of September 3, 1986. The motion was seconded by John Nicholson and carried unanimously. " The CommUtee considered the request of Donald Swim. Firefighter. for a job-connected disability pension. Chairman Dunn spoke with his doctors, and they are both of the opinion that Mr. Swim c~n no longer continue to perform his duties as a Firefighter. jCD Charles Dunn moved to approve the request for a job-connected disability pension. The motion - was seconded by John Nicholson and carried unanimously. . Dr. Nach and Or. Ferderlgos. The two doctors agree that In both Instances the men are unable to continue In their present poslllons. The motion was duly seconded by John Nicholson and carried unanimously. ^ij C"P --_.".~_.-~'" David Krieger arrived at 9:40 A.M. In regard to Mark Brumage's request for a Job.connected disability pensIon. they are stili waiting for more Information. The paperwork has not yet been received. Chairman Dunn presented to the other Committee members copies of Charles Kimball's request for a job.connected dlsablllty pension. They will review the material and take action at the next \ meeting. ~ Chairman Dunn reported he received a calt from Cary Singletary. attorney for Walter Kosiba. Pollee Officer, who was previously approved for a non-job.connected disability pension and Is appealing this decision. Charles Dunn stated Mr. Singletary requested another hearing on this matter. Mr. Singletary Is to contact Secretary Laursen to find out the date for the hearing. Chairman Dunn stated the need may arise to have Mr. KosIba examIned by a heart specialist to determine what the cause of his problems is. Chairman Dunn would like the Legal Department to find out If the members of the Committee can be sued. Miles Lance, Assistant City Attorney. stated anyone In a posltlon where they make decisions can be sued. However, he does not see any financial harm to any Committee member. Chairman Dunn requested Mr. Lance put his opinion in writing. Discussion ensued regarding a copy of a statute pertaining to police. The statute states If someone is hired without heart problems. etc., and later develops one. It should be assumed this is work' related. Chairman Dunn stated there are extenuating circumstances to this. i. e. smoking, etc. Chairman Dunn reported a meeting was held at the Police Department regarding the changes the Pension Rewrite Committee would like to make. There were approximately 50 people In attendance and they all agreed with all the changes. All those In attendance 1) would be willlng to cut back on the disability pensions In order to have an escalator clause and 2) felt the disability pension was too lucrative and no one should be able to receive more than 100 percent of, their salary. ' Steve Zimmerman requested a copy of a lIst of all City employees. except those in the Police and Fire Departments. ,He was Informed he would have to contact Mr. Weimer's office for the list. The Committee considered the request of Fred W. Lewis for a regular retirement pension. Mr. Lewis' benefit date is August 20, 1957. His date of hire is August 20. 1956.
