Upon consideration of a letter fran Dr. Merkel stating Mr. Billups is r;ermanently disabled, a vote was taken 00 this request. Chairman Dunn and John Nicholson voted unanirnoosly to approve this request . The Committee considered the request of Chris Kingsley for a job-conne::ted disability pension due to a knee injury. Upen consideration of the statements of two doctors, a motion was made to vote 00 this request. Chairman Dunn and John Nicholson voted in favor of approval of this request. Discussion ensued regarding this request and the fact the Fire Dep:irtment was offering Mr. Kingsley the opfOrtunity to return to work as a Fire preventioo Inspector witoout the neerl to climb stairs and ladders. Chief Davidson assured Mr. Kingsley and the Committee tlBt Mr. Kingsley would never re required to fight fires or do any climbing.. See retary Laur sen stated Mr. Kingsley would maintain his tazarCbus duty status as provided in the pension ordinance as being retirement after 20 years of seLVic\~ . See retary Iaurse.n reminded the Canrnittee of a similar situation involving RdJert Noonan, a Utilities Department employee. Con:essioos were made 00 the part of this department so Mr. Noonan would not have to nove applian:::es or do le3.vy lifting. The situations are similar in that neither anployee would be required to do everything in his job desc ri peicn. It was anphasized Mr. Kingsley would remain in his current job classificatioo of Fire Prevention Inspec:tor. The Fire Dep;lrtment would make allatJan:::es for Mr. Kingsley's injury by not requiring him to climb stairs and ladders during the course of his duties. Chairman Dunn questiooed Mr. Kingsley as to what he could and could not <h. Mr. Kingsley stated he could not 00 his job. Ie stated Chief Davidsion was never a Fire Inspector and, therefore, does not knOiJ excctly what the job entails. Chairman Dunn asked Mr. Kingsley if he could 00 the job with the allaY'arces the Fire Department is willing to make. B; stated 00 feels it would be h3.nnful to his knee. ,John Nicholson stated he feels they should consider the light duty prop:lsalj and, in the event Mr. Kingsley canoot do the job, the pe.nsioo should be granted. If the Fire Department is willing to work with Mr. Kingsley, it should be considered. Chairman Dunn stated he will 1) get b:lck with Mr. Kingsley's doctor to detennine from the doctor's viewpoint whether this profOsal should be considered and 2) check with the City Manager to re sure the Fire Department has the authority to make such a pro{X)sal. If the Cbctor (bes not feel Mr. Kingsley can work under these conditiCX1s, Mr. Dunn will vote to approve the pmsion. i' . The Carmittee considered. the request of Henry Wright, Sanitation Divisioo, for a non-job-connected disability p;msion. The ChaiIIl1al1 stated the Ccmnittee tilll require statements fran tlrio ortoopaedic surgeeons. Wayman Pearson, Sanitation Superintendent, will relay this ~st to Mr. Wright. UfXXl receipt of the d::x:tors' statanents, the Canmitt.ee will consider this request. The committee considered the request of steve Varner, Firefighter, for a job-connected disability ~nsion. The CIBinnan in fanned Richard Griesinger, attorney for Mr. Varner, they would not accept the statement from the chiropractor. Tb3y will require statenents fran two ortoop3ed.ic surgeons. Th9y w ill, however, accept the statement fran the Workers' Canpmsation d::x:::tor who will perform an independent Iredical examinatioo 00 Mr. Varner. After receipt of the reports, they will consider the request. The meeting recessed fran 11:10 to 11:40 A.M. to allaq Chairman Dunn to speak with 'Elizabeth Haeseker, Acting city Manager, and Mr. Kingsley's Cbctor regarding his pmsioo reqoost. Upon rec onven i ng, C ha i rman Dunn stated a::xording to the kting City Manager, Chief, Davidson does have the right to nake assignments and to change toose assignments as he, sees fit. The Chairman also re[.Orted it was Dr. Crosar opinion that he would approve Mr. Kingsley's returning to work provided he did not have to climb ladders and stairs. T~ dxtor would like a letter fran Chief Davidson stating exactly what Mr. Kingsley would be cbing. Dr. Cross will sign the letter as to approval or disapproval of the prop:>sal. Chairman Dunn stated they will deny the reqoost at this time but the denial is not permanent. If the job roes not work rot, the carmittee will vote again on the pensioo.
