Jay Love moved the Minutes of June 6, 1984 be accepted. Seconded by Claude Zukowski and motion carried unanimously. Chairman Zukowski welcomed new member, Charlie Dunn, to the Committee and stated he looked forward to working with him for the next couple of years. Request from LaWYence Dean for vesting his pension rights effective July 14, 1984 with ten years of service. Jay Love moved the Committee accept the request from LaWTence Dean for vesting his pension rights. Seconded by Charlie Dunn and motion carried unanimously. This is based on calculations from the Finance Department. Request from Raleigh Weiler for job connected disability pension based on opinion of two doctors. Mr. Laursen suggested to the Pension Advisory Committee that in cases of requests for job-connected disability pension, the members review the employee's medical file in the Safety Office. This file generally will contain considerable information relating to the employeels basis for job-connected disability pension and medical histories and'status. Jay Love moved that the Committee approve Mr. Weiler for job connected disability pension based on calculations by the Personnel Department and Finance Department. Seconded by Claude Zukowski. Charlie Dunn stated he would have to vote against the motion as he knew nothing about the man and didn't feel that he could make a decision without first having studied the reports by the doctors. Motion ca~ried 2 - 1. Charlie Dunn asked that it be stated in the Minutes that he voted no regarding Mr. Weiler as he, just did not have enough time to study the man's file. He also stated he felt the fi~es' should be given to the Committee Members at least a week or two before the meeting. , In looking over the physicals for the new employees to be accepted into pension, Jay Love stated he did not think there was enough information on Mr. Gary Lutman relative to an indication of some paralysis. The doctor approved him for pension but the Committee. after discussion, decided they would like more information regarding his disability and a decision regarding his acceptance into pension would be held in abeyance until the August meeting. " 11 Public Works - Public Service Public Works - Engineering , Committee rejected Donald K. Mace. Traffic Engineering Aide, based upon recommendation of City physician. Jay Love moved that the Committee approve employees recommended for pension, reject Mr. Donald Mace, and table Mr. Gary Lutman. Seconded by Claude Zukowski and motion carried unanimously. Mr. Dunn stated he felt that th~ doctors who do the pension physicals should give more specific information when an employee is rejected for pension. Chairman Zukowski read letter from Jeff Harper, Asst. Personnel Director, regarding pension pay-back. When he was first hired he was told he could not be under pension and then in 1974 (5 years later) he was sent for a pension physical. Because of this, he lost five years in the pension. Chairman stated that the Committee could do nothing 'about this but that the Committee would request a legal opinion. Chairman also mentioned that Betty Haeseker was required to resign to take a new position. Chairman asked Secretary Laursen to write a memo to the City Attorney requesting a legal opinion on Jeff Harper and Betty Haeseker regarding pension. Charlie Dunn stated he noted that there had been some question by Skip Kroeger regarding Pension physicals. Mr. Laursen advised him that Mr. Kroeger had been referring to the annual physicals and not pre-employment physicals. Secretary Larusen did write a letter to Police Department. Fire Department, and Russ Britton relative to the annual physicals and suggested that the two departments check to see that all employees are given the proper physical as required by contract. Jay Love questioned Carole Greiner regarding pension pay-backs and she stated that the money is being deducted. but she does not know whether or not there is a law suit by employees on this matter. Charlie Dunn stated toat as a new Committee Member, he would like to go on record that he feels it is unfair as fat, as tne interest is concerned (employees having to pay interest on the pension pay-back) and he personally cannot go along with it. Committee discussed, time element on reviewing job-connected disability pension requests. Secretary Laursen offered a recommendation that a time limit not be set but when Chairman receives a request for a job connected disability pension from an employee that he then advise by telephone the other members of the Committee and between that time and the next meeting. all Committee Members stop at the office of the nurse and review those files. Members Love and Dunn noted that there are rumors in their TeRpective departments that a recent Court ruling indicated that the Pension Advisory Committee, not the Trustees approve job-connected disability pensions. They expressed concern that the City had not advised them if this is the case. Members asked Mr. Laursen to write to the City Attorney for a copy of the Court Ruling (Monty Krysko) and to inquire if the City is appealing any such ruling. Mr. Laursen expre~Bed that if there is an appeal to such ,a ruling, the appeal would "stay" the effect of the ruling. Charlie Dunn stated he would like to have the Pension Law written in a form so that the ordinary layman could understand it - written in common language. Carole Greiner advised Mr. Dunn that there is a Statc requirement to send out a financial statement to all people under pension that includes two things - one is a statement or summary of the plan and benefits and the other is a financial statement. The summary has already been done in draft form for the Finance Director and Asst. City Manager to review. The entire benefits package is summarized and condensed in this report. Steve Zimmerman, CWA Representative, City employees who do not understand read a sentence from the Pension Law of the Pension Law. stated there was a great deal of frustration by the wording in the Pension Law.
