Chairman moved that Mr. Carrell be granted a regular pension based on continuous service with the City for a period of more than twenty years and his age ,exceeding 55 years. to be effective upon the date determined by Personnel and Finance computations. Seconded by Ray Kaminskas and motion carried. Chairman Zukowski stated that the Pension Advisory Committee had met with Mr. Peter Dubbeld regarding the status of Police Officer Bernard Donahue and that the recommendation of the PAC for a job-connected disability pension must stand at this time based on the materials previously provided to the Committee. However, he noted that the issue of job- relatedness. disability may be decided by a Court Ruling and that if it is ruled non-job connected the Pension Advisory Committee would have to follow that ruling. Ray Kaminskas stated that Officer Donahue has not yet submitted a resignation to the City upon the advice of his attorney, and that the recommendation of the Pension Advisory Committee can't go in front of the Commission. He stated that if this matter does not go before the Commission, City staff will probably recommend Donahue be granted a non-job connected disability pension until the ruling is made by the Industrial Claims Judge. Carole Greiner related that Mr. Leroy Floyd, who had no spouse or dependent children, had passed away several days ago and that there is no form for a Return of Pension Contri-' butions for a deceased employee. Committee discussed the manner in which a pension refund - should' be made and to whom. It was decided that this matter should be referred to ,the Legal Department for development of an appropriate form and requirements. Chairman Zukowski asked Mr. Laursen if a legal determination had been received relative to those employees who had quit and then .came back to work and were put back under pension as far as deductions. (These employees did not have a new physical upon their return to work and to the pension). Mr. Laursen advised that he was still reviewing the list and nc determination had been made. .Committee discussed the need for, contact with Emergency Walk-In Clinic which was awarded the contract to perform various City physical examinations (pre-employment/ pension) annual police and fire; special physicals, etc.) during fiscal year 1983-84. There is a need for criteria to be established and provided to the Clinic for their 'r' guidance in making recommendations to the Pension Advisory Committee. Committee members and others discussed the problems associated with employees changing positions, after being admitted into the Pension Plan; the ramifications of establishing one standard for all employees as to their participation in the Pension Plan; and the extent to which the Pension Advisory Committee could involve itself in requesting that p'hysical exams be required when an employee promotes or transfers. Consensus of the PAC members was that they should work with other representatives of the City (Safety Officer/City Nurse/Personnel/Affirmative Action/City Manager/tegal) in dealing with these problems. It was also determined that the Pension Advisory Committee would set an appointment with the staff of the Emergency Walk~ln Clinic (Thursday, October 13, 1983 at 10:00 A.M.) to give the clinic some guidance as to the nature of those physical problems which might preclude an employee's acceptance into the Pension Plan. , , Jay Love asked the Committee for clarification of Section 2-49 (2-56) as it relates to.the acceptance of employment. Specifically, he noted that Dan Safos who worked in, the ~ombat Division of' the Fire Department (and is receiving disability pen~ion) is looking into the area of administrative wo~k. Pension Advisory Committee members acknowledged that they saw no problem with this provided that the job did not include ,those, things which, are part of firefighting duties. Jay Love asked that a copy of the Minutes. of this meeting be provided to Dan Safos showing that he can accept adminis- trative work in the same line.
