'Claude Zukowski related that the primary purpose of this meeting was to consider the
request of ,Mike Arata to vest his pension and that since his last day on payroll is
September 22, 1983. time is of the essence. He stated that he felt the action of the
Trustees in approving the PACts recommendation relative to allowing employees the
opportunity to pay-back into tbe Pension Plan for their first six months of employment
indicates their intent to permit such actions as this vesting. Accordingly, he moved
that Mike Arata be given vested rights benefits under the Pension Plan based on his
paying into the Pension Plan the amount due plus interest. when the "pay-back" plan is
approved by the Trustees. Seconded by Ray Kaminskas.
During discussion, Secretary Laursen related two points for consideration by the PAC:
first, when the Pension Advisory Committee finds it necessary to hold a special meeting
such as this one, it is important that appropriate notice be provided consistent with
'provisions,of the Sunshine Act, and secondly, he expressed concern over whether the
Pension Advisory Committee could approve the vesting before Arata has the time that is
required by 'the Pension Ordinance. Motion carried.
Chairman Zukowski asked Mr. Laursen, Secretary to PAC, to draft a letter to the Legal
Department requesting a, legal opinion as to whether a new physical examination would be
'required for the ten employees identified by payroll who have either resigned and
withdrawn their resignation or who resigned and were rehired. This draft will be
. submitted to the PAC at the next regular meeting for consideration and approval.
