Present: Betty Ward, Chairman Ray Knminskas, Member Wes Brettel, Member Mike Laursen, Personnel Director Joyce Bayer1e, City Nurse William Raible, Garage Superintendent // / 1. Chairman solicited data from William Raible, Garage SupeTintendent, relative to his employment with the City and his proposed retirement. Mr. Raible was born 9-24-12, employed by the City on 1-16-56 and requests retirement on 7-17-78. According to Personnel Department computations, Mr. Raible's last actual work day will be 10-31-77 and he will use sick leave, vacation, and bonus days to carry his employment to 7-17-78. Ray Kaminskas moved that:ithe Pension Advisory Committae approve Mr. Raible's request for pension under the City Pension Plan effective 7-17-78. Motion seconded by Wesley Brettel and carried unanimously. 2. Pension Advisory Committee members reviewed a memorandum dated 8-26-77 from City Attorney, Tom Bustin, relative to whether Police Officer David E. Krieger could "buy back" time equivalent to the time he worked with the City at a time prior to his current employment.,. The City Attorney's opinion was that Officer Krieger's request can~ot be granted. Ray Kaminskas,moved that the Pension Advisory Committee accept and agree with ,the City Attorney's Opinion that Officer Krieger cannot "buy back" previous employment time for pension credit and that copies of the correspondence relative to the City Attorney's opinion be trans- mitted to Officer Krieger. Seconded by Wesley Brettel and motion carried unanimously. '3. Pension Advisory Committee members reviewed a Joint Petition Order provided by Firefighter Robert Heup which was executed 8-19-77 in District "E" by Judge of Industrial claims Jonathan Alpert. The Order appears to provide that upon payment of a stipulated lump sum, the liability of the employer for compensation and medical benefits shall be fully discharged. Firefighter Heup was injured on the job and is attempting to obtain a disability pension (See minutes of 4-14,.77). Ray K~minskas moved that a legal opinion be requested from the City Attorney rela- tive to the following: (1) Is the Joint Petition Order sufficient to show that Firefighter Heup is no longer receiving workman's compensation? and (2) What percentage (50% or 75%) will be awarded Firefighter Heup when his pension is authorized? 4. Pension Advisory Committee members discussed the matter of pension for the widow ;.,:-of Dan Gardner, Equipment Operator II, Water Division which was recommended by the P.A.C. on 3-2-77 and approved by the Trustees on 6-16~77 to be effective 10-15-77. Mr. Gardner's last day of work was April 1, 1977 and sick leave and vacation credit continued his employment through 10-14-77. Mr. Gardner passed away prior to his official retirement date. Wes1ey'Brettel moved that Mr. Gardner's pension he granted to his widow and that a letter to that effect be forwarded to the Finance Department. Motion was seconded by Ray Kaminskas and carried unanimously. l\ 5. Chairman reported that the City Commission has requested information regarding employee pension contributions on every retiree and degree of disability of those employees requesting disability pension.
