Meeting commenced at 9:00 A.M. in th~ office of the Training Officer.
The Pension Advisory Committee asked the City Attorney's opinion on several items that
related to problems caused by differences between the old and new pension ordinance,
and the current lawsuit and court litigation. Mr. Bustin recommended that employees
leaving the City (not for retirement) be paid the amount of monies (80% of contri-
bution) employee would have received under the old plan with a commitment that, if
the City's appeal of the Circuit Court ruling is successful, the employee would get
'the additional monite (remaining 20% of contribution) as provided under the new plan.
The City Attorney also recommended that employees hold off using the vested rights
clause of'the new pension ordinance. He further suggested the Pension Advisory
Committee hold up the Pension Advisory Committee election until the litigation was
concluded. After the Committee discussed the problems being encountered in processing
employees for pension, Tony Shoemaker requested that the Personnel Director draft a
letter to Department Directors for his signature regarding processing of employee
retirements. Another letter is to be prepared for employees regarding the current
, litigation explaining that employees will be processed under the new pension procedures
and, if the City loses its appeal, it will refund employee pension contributions made
during their first six months.
Betty, Ward inquired as to whether the widow of John Passer (former Police Officer
killed in a motorcycle accident) should receive pension retroactive to when she
stopped receiving Workman's Compensation payments. After discussion as to the
location of the file on Mr. Passer, Betty Ward moved that action be initiated to
provide widow's pension for Police Officer John Passer's widow and children. Seconded
by Wes Brettel and motion carried unanimously. Mr. Bustin will attempt to locate
Passer's file and review pension rights that are available.
After reviewing medical certificates on Mr. James McKinney, Ray Kaminskas moved that
James McKinney, Electrician I, Traffic En~ineering, be granted a disability pension,
e non-iob connected, effective with his date of resignation.. Seconded-by Wesley:Brette1
and motion passed unanimously.
Pension Advisory Committee recommended that the Trustees accept the following employees
into the Pension Plan.
