Proceedings of the Pension Advisory Committee Meeting held 10-13-75 vi Present: Betty Ward, Chairman, Advisory Committee Ray Kaminskas, Member, Advisory Committee Wesley Brettel," II II Joyce Bayerle, City Nurse Mike Laursen, Personnel Director Meeting commenced at 9:00 A.M. in the office of the Personnel Director. The Advisory Committee reviewed the physical examination forma for those employees listed below in order to determine their recommendations to the Trustees of the Pension Plan. After review of the forms, it was their recommendation that these employees be accepted into the Pension Plan: Stephen Zimmerman Willie L. Billups Edgar E. Padgett Mary L. Stuart Richard Olsen Pricilla L. Williams Clinton W. Cory The Committee reviewed the physical examination report dated 9-25-75 on Mr. Alex Battle, Distribution Serviceman 1, Water Division. Mr. Battle had requested to be reconsidered for entry into the Pension Plan and was referred to the City ~hysician. The City Bhysician did not recommend Mr. Battle for Pension and the Committee concurred with the physician. A legal opinion from City Attorney Tom Bustin was discussed (copy attached). This opi~ion relates to disability retirement and subsequent employment by an employee and was requested by the Committee after receipt of a letter from Russell Riendeau asking what types of employment he could seek without jeopardizing his pension. The substance of the opinion was that if an employee on disability pension status ".....takes a job and it becomes apparent by reason of his activities associated with' that job that the physical or mental incapacity is now gone, then under the first portion of Section 5 of Division 3 he would place his disability pension in jeopardy." It was the opinion of the Committee that Mr. Riendeau should be advised that they recommend he not take a sworn police officer's job. The Committee then discussed the employee response to "Shop Talk1; a feature in the City-~ which gave employees the opportunity to ask questions about the ~ension Plan. Only three questions were received, two made reference to the withholding of 20% of employee contribution when an employee leaves prior to retirement, one asked for a cost of living adjustment.
