William Justice moved to approve the minutes of the meeting of August 19. 1986. The moHon was seconded by
Joseph Carwlss and carried unanimously.
The Board proceeded with the selectlon of a new Chairman. William Justice nominated Dr. Joseph Carwise as
Chairman. The nomination was seconded by David Keyser.
" David Keyser moved to close the nominations for Chairman. The motion was seconded by William Justlce and
~:~:. carried unanimously. .
'~i'::O A vote to appoint Joseph earwise as Chairman was taken. The voting was unanimous.
Discussion ensued regarding Stephen Halloran's appeal of the test rating for the Sanitation Inspector test.
Secretary Laursen gave a brief account of the events leading to this appeal. The generailnstructlons and those
given orally by the test administrator stated those placing theIr name anywhere on the test would be
disqualified. Due' to conflicting instructions on the test, 132 of the 140 candidates for the examination wrote .
. their names on the one part of the test (legal notice). Mr. Halloran's content/on Is those 132 candidates should
be ,disqualified. After carefully chec1dng the tests and consulting with Miles Lance, Assistant City Attorney, it
was determined by the Personnel Department that the validity and Integrity of the examlnatlon were In no way
compromised.
. Tom Chenoweth asked whether or not Mr. Halloran had passed the examInation and, if so, was in the top five
score groups. Jeffrey Harper, Assistant Personnel Director, stated he had passed but was not in the top, five
groups.. He would be if the other 132 applicants were disqualified. Mr. Harper stated 111 of the 140
candidates passed the examination.
There being no further questions, Tom Chenoweth moved that Mr. Halloran's appeal be denied. The motion was
seconded by William Justlce and carried unanimously.
Secretary Laursen reported the proposed revisions to the Civil Service Rules and Regulations were forwarded
to all Departments Directors for their comments. All responses have been received and Mr. Laursen is In the
process of reviewing them. The City Manager will determine which proposals will be adopted.
If any affected party wishes a public hearing on any of the changes, a hearing will be scheduled before the Civil
Service Board.

Sacretary Laursen advised the Board of the status of the DeSantis appeal. This matter was heard by a Hearing
Officer and all hearings have been concluded. At this point. both sides are awalllng a transcript of the
proceedings In order to submit their findings of fact and conclusIons. After the Hearing Officer receives the
findings and conclusions from the attorneys. his/her findings of fact and conclusions of law, together with a
recommended order, will be forwarded to the City.
Secretary Laursen Informed the Board that the bill from Anthony Battaglia for, services rendered In the
Kingsley case Is In the process of being paid. This case Involved a Writ of Prohibition flied by the City
Attorney to restrain the Civil Service Board from hearing Mr. Klngsley's grievance. Upon direction of Judge
Fogle, the Clty Commission authorized the Civil Service Board to hire Independent counsel. The original bill
from Mr.' Battaglia was for $17,960.27 with an adlustment to $5,000.00. Milton Galbraith, City Attorney,
fell this fee was too high for the services rendered and went before Judge Fogle to have the matler settled. A
decisIon was made on October 6. 1986, and Judge Fogle determined that $3,000.00 was a faIr amount for this
case. I
