Chairman Walsh convened the meeting and introduced the menbers of the Civil Service
Board to the audience.
Chairman noted that Agenda Item HI was "Review of the Hearing Officer's Recommended
Order. City of Clearwater vs. Raymond Parke." Chairman related the following: "This
matter came,before the Civil Service Board on January 15. 1985. with this concerned
Civil Service Board immediately notifying the City Manager and the City of Clearwater
that the employee had been charged and found guilty of the wrong offense. On March
19. 1985. and on May 21. 1985. this matter was properly before the Board, with the
City. the Manager. and the Hearing Officer having over four (4) months to reconcile.
correct. modify, or clarify the City-initiated defectiveness of the offense charged.
The Hearing Officer'a Recommended Order was rejected by a majority vote of this Board.
The City Manager filed suit in Circuit Court. and the Court has found that the City
clearly initially made a scrivenor's error. It was not discovered by the Hearing
Officer and it was remanded to this Board with instructions to adopt the Hearing
Officer's Recommended Order." Chairman asked for a motioll. '
Tom Chenoweth moved that the Recommended Order of the Hearing Officer in the case of
Raymond Parke be approved. The motion was seconded by Dr. Joseph Carwise and carried
unanimously. Chairman provided copies of a typed Order for signature by individual
Board members and. upon completion of signature by members. provid~J the original to
the Director.
Chairman stated he resigned. Board Member Kane resigned from the Board. Board Member
Vellucci resigned. indicating that he had been on the Board about a year and felt the
'Board had done a good job for City employees. not suiting the City Manager or his staff
but the City employees. He related that he had voted his conscience and he felt that
Mr. Walsh and ,Mrs. Kane did the same, and, yet. three judges said the Board members
. acted in a manner that was capricious. unjust and totally irresponsible. He stated he
had always done his best to what was right and then to have the City Attorney sue the
members for doing his work which he gets paid for is ridiculous.
Members who resigned left the meeting. Tom Chenoweth moved the meeting be adjourned.
Due to lack of a quorum. Director declared the meeting adjourned.
