Tan Chenoweth rroved that the minutes of the rreeting of 11/26/85 be approved. Motion was seconded by AI Vellucci and carried unaniroously. Mary Kane o::xmended Mr. Walsh for his past IDrk as Chainnan of the Board. Mary Kane nominated Nugent Walsh to serve as Chairman of the Civil Service Board for 03.lendar ~ar 1986. Motion was seconded by AI Vellucci and carried unanirrously. Chairman Walsh ooted all rranl:ers had been sent a oopy of the Recamended Order of the Hearing Officer in the Christopher Kingsley grievance. He provided the . following background information to the Board: On Novat1h9r 21st Ju:ige Fogle .entered an order allowing for a state' Hearing Officer in this grievance matter. To comply with the 'Judge' s order to have a speedy resolution to Kingsley's grievance, Chairman indicated he felt the BOard should facilitate the process by considering the Hearing Officer's recommendation as a routine matter. He' related the Civil Service Law provides the Board nay adopt, rrodify, or reject .the Hearing Officer's order. Chairman' sumnarized. findings of the Hearing Officer's report, incluiing that the disciplinary charges against the employee be removed and he receive three-days' back pay. Chairman related the Board might also cons ider that action in this natter would be taken pursuant to the Court Order ana not conceding the requiranents that the City provide five Hearing Offioor nanes to the Board. Tom Chenoweth moved that the Board adopt the Rec:::amendations as the Board 1 s order. Motion was seoonded by Mary Kane and carried unani.Jrously. Chairman asked the Personnel Director to prepare the formal d:>cumentation for this for his signature. Board members oonsidered the Mayor's letter to Chairman Walsh which relates the city Commission has suggested April 8th or April 9th as potential dates for a joint meeting of the Board and ccmitission. Chairman indicated this date appeared to 1E acceptable and furth~r sugggested Director contact Dr. carwise to see if this date is acceptable to him. Director advised the Board rranl:ers the Mayor's letter also related the Commission previously asked the Board to provide a list of items they wished to l:e scheduled for the rreeting. There was no discussion on Agenda Item #5-the City Manager f s letter to Chairman Walsh. Chairman asked Oirector to provide' the background on Agenda Item #6-the requ3st of Tamara Denrta.n to appeal a suspension to the Board. Director advised that Ms. Denman had received a one-day suspension in late January: subse~ntly, she appealed that suspension 'to the city Manager. 'It1e City Manager reviewed the appeal and denied the appeal. Ms. Derman then sul::mitted a letter reqresting to be placed on the Board I s Aganda for this neeting. Director stated the Board needed to cetermine what action was appropriate at this r;x:>int in reference to a Hearing Officer, that is to use a state Hearing Officer or r~st ilie Conunission to provide five narres. Director noted that m:ml:er Vellucci, at an earlier meeting, had requ=sted that the Ccmnission provide a list of narres for future hearings. No namas have l:een provided to the Board for selection of a Hearing Officer. Director indicated that in 'the past he had requ9sted the city Attorney tp initiate contact with the state for the assignnent of a Hearing Officer in appeal cases; however, several rronths ago the Board reqoosted that the Director not take such action prior to bringing requests to their atten'Cion. Chairman stated inasmuch as this natter is under review by the Court, with a decision expected shortly, it ~uld l:e proper to table this rratter until the court has resolved it. Director indicated concurrence with this suggestion. Mrs. . Kane indicated that Mrs. Denman wanted to have this settled as soon as possible. Chairman asked the Director to take the necessary action to facili tate this and, upon the Court I s determination, to go forward in an expeditious nanner. Chairman regtEsted Director read the prop:Jsed Resolution which had l:een prepared for Jane Craig, Administrative Secretary, in recognition of her services over twenty-three years (copy attached). Tan ChenO'i\eth m:wed the Board adopt the resolution. Motion was seconded by Al Vellucci and carried Wlani.roously. Under "Director I s Reports," the Director reviewed his reJ;X)rt, previously provided to the Board by mail, relating to the use of the Eligible List for Administrative Secretary. The Director sumnarized that while there is an Eligible ~ist for Administrative Secretary, which could have l:een used for a vacant position in central services, approval had men given for the voluntary demotion of a Senior Administrative Secretary to this p:>sition. 'Ibis action takes precedence over the use of an Eligible List. Oirector advised that the employee 'would be placed in the sarre step of the lower pay range. Mary Kane expressed dissatisfaction in that several employees took the examination for Administrative Secretary and then were not able to l::e oonsidered for the posi tion because someone else was being voluntarily demoted. Director advised the employees who took the exam for Administrative Secretary had an opportunity for promotion in that they \'.ere intervie\t1ed for the Administrative Secretary l,X>sition in personnel and one anployee was prom::>ted to that p::>sition. ;I:.. ' lW!;';': : "'i.~:~:~. \' , . !, : ~.'~ , 1.:~'i' , \ Civil Service Board Meeting - 3 - February 18, 1986 Director reported to the Board on the status of cases for which the Board has used attorneys ~ The rrost recent involved Anthony Battaglia W:lO was representing the Board in the Christopher Kingsley case. Mr. Battaglia did represent the Board before Judge Fogle. The other attorney representing the Board is Rog-er Maas, as referenced in the Board Meeting of July 16, 1985, relating to the suit filed against' the Board by the City. Director ooted he had not received anything from Mr. Maas as to his activities and, therefore, does not know what he has done, specifically. Director indicated he understood that Mr. Maas had represented the Board' s posi tion before the three-jt.rlge tribunal. Chainnan asked if the City conmission had authorized attorney's fees on this case, and Director related they had not done so. Director indicated a bill had been received from Mr. Maas for legal services and l:ecause the Department ches not have the necessary funds in the b.1dget for this item, he had referred the bill to the Budget Office for direction. Director indicated the billing was for the DeSantis case, not the Hebert~urphy-Parke case. 'ltle bill was approximately $3,000. 00 with an indication of a 30 % discount. Tom Chenoweth asked if the DeSantis case c::arre after Roger Maas was hired. Director indicated the original suit filed by the City against the Board related to employees Hebert, Murphy, and parke and the Board's minutes reflect Mr. Maas was engaged for that suit. Chairrran indicated the City had settled two of the three enployees' matters in the original suit, but one, apparently, remained and there is still representation for that one. Chairman asked Director to find out the status of the Parke CBse and the DeSantis case. Oirector introduced Deborah Lally, Administrative Secretary, who has been prOil'Oted to replace Jane Craig. Meml:Ers ~lcared her to the Departm:mt. Al Vellucci asked for an indication \ot1en Jlrlge Fogle \muld rule on the pending case. City Attorney Galbraith indicated oral argunents ware made on February 6th and the parties had subsequently sulxnitted rreroorandum and it was up to the Ju:3.ge . City Attorney indicated that would J:e difficult to say and \muld involve a variety of factors, inclu:1ing mether he \\QuId reCOlTlIEnd an appeal. Chairman indicated Mary Kane has asked if the Board could have their rreeting wi th the Commission J:efore the Referendum. Mary Kane asked that the Director contact the City Manager to see if the rreeting CX)uld be scheduled tefore the election. Tom Chenoweth expressed disagrearent with this, indicating a joint meeting had already J:een held on the referendum item. Mary Kane rroved that Mr. Laursen contact the City Manager and the city CCmnission to see if they will be willing to meet with the Civil Service Board prior to March 11th. Mary Kane asked that the record reflect that it oothered her that of those Department Directors who spoke to the City Carrnission and said the Personnel Director w,~ being harassed, only one had attended Civil Service Board rreetings since she has 1:een on the Board (since 1971). Jim Moore, City employee, stated there were no Departroont Directors here tonight. Additionally, he asked for a ruling as to the impact of the three judge decision in the event that an employee'responded late in the appeal process (rather than the city Manager responding late). city Attorney Gllbrai th indicated he would not respond at this neeting to that gmstion. Chairman asked the Director to subnit that question to the city Attorney's office. Gerald Wei.m3r, Assistant city Manager, repOrted to the Board that in response to the Chairman's suggestion at the previous rreeting that the City and the IAFF Union get together and go back to the drawing 1::oard relative to the residency requirement, he had directed a letter to the Union asking if they laAJuld like to meet. He had not received a response. He provided a copy of his letter to the Chaiman for the reex>rd. Fred Ratley, employee of the Building and Maintenance Division, inquired as to why notices of civil service Boa.rd neetings ware not sent out with payroll notices as had been previously suggested. He stated he only found out aOOut tonight's meeting at 3: 30 in the aftern<x>n. Chaiman stated this has reen a continuing problem. He related he had never found a notice on the oolletin board in the Ci ty Hatl break roan. Director advised that notices are sent to each depart:rrent, but they are 'not sent to anyone for posting in a:rrm:>n anployee areas. He also noted that a pre-agenda notice is distributed a ~ek to ten days preceding the regular Notice and Agenda. Mary Kane stated she had checked the bulletin lDards in Personnel (ooth sides) and the City Hall Annex b.1l1etin l:oard and found no notices.
