The Civil Service Board met in session on May 6, 1981 at 3:30 P.M. in the Personnel
Depar

receive materials relative to the separation of Danny Fivecoat.

Board members discussed the Fivecoat dismissal and the Hearing Officer's Report, as well
as the`City's subsequent action in withdrawing the termination and permitting the
employee to resign. Director noted that Mrs. Herman, unable to attend the meeting, had
submitted a letter which raised several questions. Chairman and members related that
they felt the Board had been by-passed and asked why the City had withdrawn its charges.
Frank Kowalski and Gerald Weimer related that the action enabled the City to achieve
its goal, that of the separation of the employee.
Members also expressed the following two concerns:

the Board.
The investigation of the matter was poor with varying opinions made by City

personnel.
.Frank Kowalski',stated that while the opinions varied as to what disciplinary.
f'action''was appropriate, the facts of 'the case were definite.
Mi. Chenoweth asked-who-initiated the settlement and Mr. Kowalski advised that the City
had "done so'following receipt of the Hearing Officer's Report.
Board Members expressed their consensus feeling that if the City prefers charges
it should.stick with' them.
