The Clearwater Civil Service Board met in regular session on Tuesday evening, May 1, 1979 at 7:30 P.M. in the Personnel Department, City Ball. Members present: Tom Chenoweth, Mary Drew Kane, A. D. Finch, Helen Herman, Jeanne Wilder Visitors: Paul Kane, Public Service Director, Jack White, Attorney Representing City Manager: Gerald Weimer, Asst. City Manager Representing City Attorney: Frank Kowalski, Chief Assistant City Attorney Chairman Wilder called meeting to order. Mrs. Herman moved that the Minutes of the meeting of April 19, 1979 be approved as submitted. Seconded by Mr. Chenoweth and motion carried. Mrs. Kane advised the Board that she would abstain on Item #2 of the Agenda. Chairman Wilder asked Mr. Kowalski to enlighten the Board as to the concept of conflict of interest. Mr. Kowalski advised the Board that in such instances a member must declare the conflict of interest, in writing within 10 days and, 2) may, having declared the potential conflict, vote or not vote as the member determines appropriate. ?t.t,....Preceding discussion on item #2, Chairman asked that the discussion be kept to the ??'.''1•::' issue before the Board. Director provided members with copies of a memorandum from the City Manager regarding his views on Mr. Kane's request to have a reprimand removed r.r.; from his file, and a legal opinion from Mr. Kowalski regarding removal of a reprimand from a personnel file. Director advised the Board that, in accordance with the City Manager's views, he had submitted a request to the Department of State, Division of `?_' i,;' '•::. `:_ ' . • Archives, to remove the reprimand from Mr. Kane's file and that such requests averaged ' 30 days for a reply. Following Board discussion, Mr. Chenoweth moved that the Board approve the City Manager's action. Motion was seconded by Mrs. Herman and motion carried 4-0 with Mrs. Kane abstaining. c'.. Board heard Charles Selby, Fire Lieutenant regarding his appeal that the Personnel Department erred in the process of applying seniority points on a recent Fire Captain's examination. After considerable discussion of the rules and procedure used for the examination, Mr. Chenoweth moved that the Board approve the manner in which seniority 4 ;:.;=;. •.. paints were handled and, therefore, reject Mr. Selby's appeal -reluctantly. Mr, Finch offered an amendment to the motion, accepted by Mr. Chenoweth, that the ?::•`:•.. ?• Board approve the manner in which seniority paints were handled in that the exam was routine and that it has been given before for the same position, that the written exam has been approved by the Chief as being germane to the duties and that the scoring was done an this exam as on all other exams for the same position and that ' there has been no error in the calculations or computation. The amended motion was ?'??°•;??,.-?, : seconded by Mrs. Herman and passed on a 4-1 vote with Mrs. Kane voting nay. ??`.'. • Mr. Finch moved that Mike Laursen be appointed as Director of Personnel.
