The Clearwater Civil Service Board met in regular session on Monday evening, June 13, 1977 at 7:30 P.M. in the City Hall., City Commission Auditorium, Clearwater. f; Members present: .: *";,:! r>Y, Tom Chenoweth, Helen Herman, A. D. Finch, Jack Turnbull, Jeanne Wilder Visitors: David Perez, F.O.P. Representing City Attorney: Frank Kowalski, Chief Assistant City Attorney Representing City Manager: Anthony Shoemaker, City Manager The meeting was opened with a discussion as to a Hearing conducted under Section.2-38 of Ordinance 1643 concerning employee Waymon Spencer. Mr. Kowalski related that to provide the employee with a speedy deliberation, it was agreed contractually between the empla,pA's counsel and the City to proceed with the Hearing Officer rather than wait for the Appeal Court to rule on the Referendum Suit. Mr. Chenoweth, serving as temporary Chairman, inquired as to the status of the Board. Mx. Kowalski advised that this Board is the Civil Service Board as constituted under Ordinance 1643 and can only operate under that Ordinance. Further explanation was made regarding the effect of the City's appeal of the Circuit Court's decision setting aside the February Referendum which established Ordinance 1643. The City's appeal of the Circuit Court decision "stays" the order of the lower court during the appeal and the City is entitled to operate under the new law during further discussion centered around the validity of the Board actions if the appeal is subsequently lost. The Attorney noted that the City Attorney and the City Manager have adopted the policy that,.wherever possible, the City will attempt to carry out its action in accordance with both laws. ?4ru Members Turnbull and Finch questioned whether the Civil Service Board can operate at all being that the appointment method for members is different under the former Civil Service Act and new Ordinance 1643. Mr. Turnbull suggested that the Board should avoid any actions. The Board continued discussion on the listed Agenda items and whether there was an urgency in proceeding. ..Mr. Turnbull moved that in view of the attorney's view and in view of the fact that nothing of an emergency nature is facing the Board at this time that the Board will remain in effect, that the Personnel Director we have now will remain as an Interim Personnel, Director and that the Civil Service Rules in force will remain the Civil Service Rules in force and that this Board take no action on any items on the Agenda. Seconded by Mr. Finch. Motion carried with members Finch, Turnbull, and Wilder voting affirmative and members Chenoweth and Herman voting negative.
