The Clearwater Civil Service Board met in regular session on Monday evening,
Jaannu-aarry10,. 1977 at 7:30 P.M. in the Civil Service Office, City Ball Annex.
Members present: Robert Krause, Alex Finch, Tom Chenoweth
Visitors: (As signed in) Janice King, Charles Finton, David Perez, Paul Kane,
Mary Kane, Fran Beachler
Mr. Chenoweth moved that Mr. Krause be selected as the Civil Service Board Chairman
;:.i.l.5:•; for the calendar year 1977. Seconded by Mr.-Finch and motion carried unanimously.
Mr. Finch moved the Board utilize an aye-nay vote instead of a roll call vote and
that the Chairman announce whether the motions carry, and if requested a roll call
vote may be called. Seconded by Mr. Chenoweth and motion
passed unanimously.
1. Mr. Chenoweth moved that the Minutes of the meeting of December 13, 1976 be
approved. Seconded by Mr. Finch and motion passed unanimously.
2. Mr. Chenoweth moved that the resignations of Steven J. Luteran, Maintenance
Worker I, Parks & Recreation Department, Richard Westfall, Police Officer, Police
Department, Daryl A. Huber, Equipment Operator I, Public Service Department
and'George Hannah, Night Watchman, Gas Division, Utilities Department be
accepted. Seconded by Mr. Finch and motion passed unanimously.
3. After some discussion on the request of Paul Kane to have a reprimand removed
from his file and actions of the Personnel Director investigated, Mr.:iKbause
passed the gavel to Mr. Chenoweth for the purpose of allowing Mr. Krause to
second a motion offered by Mr. Finch. During discussion on the subject, Attorney
" Jack White asked that the City Attorney not be present attempting to advise the

Board on this issue as he is adverse counsel in the matter. Mr. Finch moved
that at the next regular meeting, and to be listed as item #1, this Board
? investigate the actions of the Personnel Director in connection with the Dixon

matter and that the investigation be made at the next regular meeting and the
Personnel. Director issue subpoenas for what witnesses he wants and that Mr. Kane
and his counsel be put on notice tonight that they will be able to subpoena
witnesses and have records made available to them. Seconded by Mr. Krause and
motion passed with Mr. Finch and Mr. Krause voting aye and Mr. Chenoweth voting
nay. Following the vote, Mr. Krause resumed the Chairmanship.
Attorney White asked the Chairman to ,inquire of the City Attorney if the City
would honor subpoenas issued and if the City would send the City Attorney to
represent the City Manager and one to represent the Board. Board consensus was
that the Board could not answer such questions.

4. Mr. Finch moved that the Board approve the City Manager's request to establish
three additional positions of Systems/Analyst Programmer, Pay Range 58 for the
Data Processing Division of the Central Services Department. Seconded by
Mr, Chenoweth and motion passed unanimously.

w s one additional position of Legal Secretary I, Pay Range 45 in the Legal Department.

one additional position of Recreation Supervisor I, Pay Range 48 and to abolish

the Recreation Division of the Parks & Recreation Department. Seconded by
Mr. Finch and motion passed unanimously.
6.• Mr. Chenoweth moved that the Board accept the legal opinion of the Attorney
General's Office and the City Attorney on the requirement of U.S. Citizenship
for employment and direct the Personnel Director to take action based on the
legal opinions. Seconded by Mr. Finch and motion passed unanimously.
7. Mr. Chenoweth moved that the Board approve the Director's request to ask the
City Commission to authorize an additional Secretary Z position for the
Personnel Department. Seconded by Mr. Finch for discussion. Motion failed
with Mr. Chenoweth voting aye and Mr. Finch and Mr. Krause voting nay.
8. Chief Assistant City Attorney Frank Kowalski gave the Board a verbal legal
opinion on the merit increase date of Vernon Washington. He related that
10-27-75 is the proper date as the City wrongfully, and through no error of
Mr..Waahington, failed to promote him to the position at that date. After
several motions failed to generate a second, the Chairman ruled that this
question died for.the lack of a second to any motion and that no action is
taken.
Director's Reports:
Director advised Board of the forthcoming relocation to City Hall which is anticipated
to occur before the Board's next regularly scheduled meeting. After discussion as to
where.-the Board would hold its future meetings, Chairman directed that the Personnel.
Director.advise the Board as soon as he has a definite date for the move and that
the.Board be polled as to where it will hold its meetings.
Director passed out copies of a memorandum from Picot Floyd to Fred Bolton which
related the City's position on maintaining competitive salary levels.
There being no other Board action and no citizens wishing to be heard, Mr.,Chenoweth
moved the meeting be adjourned. Seconded by Mr. Finch and motion passed unanimously.
