Mr. Chenoweth moved to approve the request for a continuance. Seconded by Mr. Hatchett and motion passed unanimously. 5. Board discussed vacation rules and the request of Mrs. Carol Walther for payment of vacation after two years' service. }~s. Walther explained that she, like 23% of other employees hired in the last three months of any calendar year, had to work up to fifteen months to earn their first vacation and then another year for the second vacation. Mrs. Walther indicated she was aware of the Rule and had worked through the CEA to have it changed in negotiations. She also indicated that she believed the Rule had been properly applied. City Attorney advised the Board that she is not eligible for vacation. Mr. Chenoweth reluctantly moved to deny MrS4 Walther's request. Seconded by Mr. Hatchett. Motion passed with Mr. Hatchett, Mr. Chenoweth and Mr. Krause voting aye and Mr. Linder and Mr. Finch voting nay. lwtion was made by Mr. Chenoweth and seconded by Mr. Hatchett that the Director be instructed to review our vacation rule in light of modern day personnel practices, keeping in mind that a person should be eligible after one year from date of employment and upon separation except by dismissal consider the practicality of paying accrued vacation at time of separation. He added that such report should specify what effect his proposal would have on the operation of the City and on the budget. Seconded by Mr. Hatchett. Motion failed 2 - 1 with two abstentions as follows: Mr. Chenoweth and Mr. Hatchett aye, Mr. Krause nay and Mr. Finch and Mr. Linder abstaining. Mr. Hatchett moved to reconsider the motion to deny Mrs. Walther's request. Seconded by Mr. Finch. Mr. Finch moved that Carol Walther's vacation pay be pro-rated based on the part of the year she has worked as covered under paragraph (p) of Rule 13, Section 1. Assistant City Manager advised the Board that monies would be available through unused salaries due to turnover and vacancies. Mr. Chenoweth moved to approve the reclassifications. Seconded by Mr. Hatchett and motion carried unanimously. 8. Board discussed recommendations for pay increases for classes within the Traffic Engineering Department with Mr. Crawford and the Director. Questions were raised as to who had authority to make pay changes for jobs covered under Union contracts and the manner in which job audits should be processed (i.e., through the budget process and then Civil Service or in the opposite manner). Mr. Finch moved that the Board approve the increases as noted subject to approval of the Appointing Authority and the CEA. In discussing recommendations made by the Personnel Department staff for revisions in requirements for Police Officers and Firefighters, Police Chief Frank Daniels and Fire Chief John Pitts stated their view that the maximum age of 38 should be retained. Assistant Director Jeff Harper advised the Board of the background with respect to recommendations and Director provided Board with legal opinion from the City Attorney regarding age requirements which are appropriate if they are a bonafide occupational qualification. Mr. Chenoweth moved to accept the staff recommendations for requirements for Police Officers and Firefighters except that the current maximum age of 38 be retained. Seconded by Mr. Hatchett. Mr. Chenoweth moved to accept Director's report, seconded by Mr. Finch and motion carried unanimously. Mr. Hatchett. advised the Board that he intended to make a request through the Director in several.days to continue hearings on discrimination charges against the Board.
