Chairman introduced and welcomed Mr. George Linder, recently elected to the Board by the City employees. He also introduced Mr. Don Fisher, Training Officer. Chairman asked for approval of the Minutes of the Board's meetings of June 14, June 29, July 21 and July 26. Mr. Finch moved that the Board accept the Minutes as reflected by the Court Reporter's notes and tapes and Civil Service Tapes rather than to debate the summary that is in these Minutes. Seconded by Mr. Hatchett. Director asked if the Court ReporterCs tapes would be made available to this office and received an affirmative reply. Chairman related that the Board met in a work session with the City Commission on July 21, and at that point it was officially brought up that the Commission would like to adopt rules and procedures of operation for the Board. As a Board Member, Chairman indicated he wrote to the Attorney General in which he requested answers as to: (1) Whether Special Act 21153, 1941 creating Clearwater's Civil Service had been repealed. ,(2) Does the Home Rule Act 1973 have any affect in changing the Civil Service Act to Ordinance Status under Home Rule? (3) Does the City Commission action of July 15 directing the City Attorney to draw up rules and procedures for the Civil Service Board to follow have any legal standing? He received a reply from the Attorney General, dated July 30, stating that opinions are not made to ~ivil Service Boards or individual members. However, the Attorney General did state he knew of no enactment of the legislature which specifically repeals Chapter 21153, 1941 Laws of Florida. Further, the Attorney General enclosed a copy of a decision of Florida's First District Court of Appeals and a previous Attorney General's Opinion (reference: 5-12-75 City of Hallenda1e ~ Municipalities - Effect of Home Rule Act on Chapter 30793, 1955 Laws of Florida Establishing Civil ,Service Board in Hallendale). Chairman read summary of the Attorney General's Opinion to the City Attorney of Hallendale. Mr. Hatchett moved that the order of Agenda items be changed and that the Board start with items 11, 12, 13, 15, 16 and 17 and then revert back to the Agenda order. Seconded by Mr. Finch. Motion passed with Mr. l\atchett, Mr. Finch and Mr. Linder voting aye and Mr. Krause voting nay. The request of the Fire Chief for a meritorious pay increase of 5% for Genevieve Berg, Secretary III, was discussed. Chief Pitts related that Mrs. Berg had an outstand- ing background prior to coming to the City and had performed efficiently with the City. He indicated the request for a meritorious pay increase was made simultaneously with her regular merit increase. Mr. Finch moved to deny the' request, seconded by Mr. Hatchett and motion carried unanimously. The Board suggested that the Chief re-submit his request at a later point The request of the Director relative to clarification of procedures on certification was discussed. Director asked should a new certification be rendered when original appointments have been made and then months later another vacancy occurs. Is the same certification still valid or is a new certification required? Mr. Finch stated the rule was clear, the appointing authority can make the appointment from the certification or he can ask for five names. Motion was made by Mr. Finch that the rule be followed. Seconded by Mr. Hatchett and motion passed unanimously. Board discussed the request. of the City Manager1s office regarding the CEA--CityContract. Ed Sulek, President of the CEA said the contract was a workable agreement evolved over 21 months, passed by an 8 to 1 margin by City Employees and approved by the City Commission. Frank Kowalski said it represents the best either side could obtain in a give and take situation. Director asked Mr. Kowalski whether it was necessary for the Board to affirmatively approve the contract and if it did so, what would be the effect on the Civil Service Rules. Mr. Sulek said there are ramifications as far as the contract along side of Civil Service--in some areas it gives empl'oyees two ways to go. Mr. Hatchett expressed concern that the exceptions to Civil Service Rules were not specifically spelled out and that the application of the contract grievance procedure was a circumvention of Civil Service. Mr. Finch asked if all employees received a copy of the contract. Mr. Sulek said 8.11 employees had had access to the contract through various methods. Mr. Finch said the employees, under law, have the right to bargain and that the Board did not have to approve the contract for it to be valid. He suggested that the Board should not adopt any part of it. Mr. Kowalski stated he did not feel Board approval was needed in order for the contract to be effective. Director responded to question from the Chairman that the Board previously approved the initial contracts with F.O.P. and I.A.F.F. b~t the current !.A.F.F. Contract was not approved through the Board. Mr. Finch said that parts of Civil Service Rules would be rendered obsolete by this contract and the'employees have that right. After further discussion, Mr. Finch moved that the Board take no action on the proposed Agreement. Seconded by Mr. Hatchett for discussion and motion passed with Mr. Finch, Mr. Linder and Mr. Krause voting aye and Mr. Hatchett abstaining. Board reviewed Director's action in processing Personnel Action Sheets reflecting the promotion of Vernon Washington and the voiding of promotion of William Dioxon. " 'J ;;'0:' I:,,' , "\, , ,:.." - 3 - Civil Service Board Meeting August 9, 1976 Director said he had forwarded a memo to the Board in which he stated that he felt the Personal Action Sheet should be signed and asking for Board input as to whether that would be appropriate. Later, having received no input from the Board, he signed the Personnel Action Sheet Mr. Hatchett asked Director if he was aware that the Board was continuing its investigation in this area. Director said the Boardls investigation was more directed to charges against the Board of discrimination and Sunshine Law violations that to the voiding of the promotion and, in his view, failing to process the appointment could very likely cause another charge of dis- crimination against the Board. Mr. Finch questioned the Director as to his awareness of the Board's vote to reinstate Mr. Dixon, that there had been no change in the order to reinstate Mr. Dixon by vote of the Board, an expiration of 30 days had expired before the Manager attempted to appoint another man to the position, and under what Rule or instruction he certified another man to the job when Dixon had it by order of the Board. Director related that after asking for board input, he proceeded to sign the Personnel Action Sheet as a ministerial act in that the City Manager had already voided the promotion of Mr. Dixon. Mr. Hatchett moved that the Board suspend action on this item #15 until additional information is more concrete and specific. Seconded by Mr. Linder. At the request of the Chairman and with approval of members Hatchett and Linder, motion was amended to include that the issue would be held open until all the facts and figures of the entire situation are in. Motion, as amended, was approved unanimously. Board discussed the Notice of Discrimination Charge filed by Edmond Dillon. Director advi~ed that an original Notice of Discrimination Charge was received on July 22 and an amended Notice was received on July 29 in which Mr. Dillon claimed to be aggrieved by the Board regarding disparity and reprisal. Chairman asked Mr. Kowalski if the Legal Department had looked into this situation as to why the Board was being charged when Mr. Dillon is not an employee in the classified service. Mr. Kowalski said he could not act as legal counsel to the Board in this situation because the other , party is an employee. Jack White advised the Board he had filed a suit asking a declaratory judgment declaring unconstitutional those portions of the City Charter requiring or allowing the City Attorney to represent adversary parties within the City structure and further enjoining the CiA from representing both entities and further requiring the clc to provide funds whereby the CSB can retain its own attorney and further restraining the c/c from attempting to promulgate rules and regulations for the C.S.B. or otherwise interfering with the autonomy of the C.S.B. Chairman asked if Mr. Di1lonls legal advisor was present. No response was received. . Mr. Hatchett asked with what the Board was being charged. Mr. Finch said there i~. no employer~employee relationship between Dillon and the Board, a condition he saw as an integral condition to a charge. He related also that he had written to the E.E.O.C. District Director on August 2 stating the Notice was insufficient, that the Board had powers under an Act to make investigations, and asking for disclosure to the Board all relevant and material information concerning the charge. Chairman asked Mr. Finch to provide copies of the response if available by the next meeting. Mr. White indicated he intended to issue a federal subpoena for the Office Director of E.E.O.C. in Miami requesting that he produce all the material that they had received and such information would be made available to the Board and Mr. Kowalski. Mr. Hatchett moved that the $7500 for Professional Fees be placed in the Budget and shall be expended only under explicit approval of the Board. Seconded by Mr. Linder and motion passed 2-1 with Mr. Hatchett and Mr. Linder voting fort Mr. Finch against and,Mr. Krause abstaining With respect to proposed departmental programs in test validation, Mr. Hatchett suggested that University of South Florida officials be invited to appear before the Board to discuss their possible assistance. Mr. Finch moved to delete $737.00 from the Office Furniture Code. Seconded by Mr. Linder and motion passed unanimously. Mr. Hatchett moved for approval of the Personnel Department Budget as corrected and deleted by previous motions. Seconded by Mr. Finch and motion carried unanimously. Director asked Board if incumbents of reclassified positions must take competitive examinations or could they be "grandfathered-in" and are reclassifications treated , as promotions or are incumbents given credit for time served out of proper classi- fication. Director referred Board to Rule 4, Section 7 and to the Act, Section 9, Division 2, Article XVI (City Charter). After considerable discussion Tegarding this subject, Attorney Kowalski advised the Board that where, over a period of time in conformity with the Rule, an individual's duties undergo tTansfoTmation, .it is, lawful and proper to reclassify that individual to the classification which is in conformity with the duties that the person is then performing. He further related that the Board had to determine in each instance if the facts support that each of the four criteria in the. Rule has been met. Following continued discussion as to whether factual evidence existed as to each of the four criteria listed in Section 7 of Rule for each proposed reclassification, the following actions were taken: a. Based on representations by the Personnel Director and sufficient evidence in the record to support that the conditions in Rule 4, Section 7 have been met, Mr. Hatchett moved for the recognition of higher level status of Alice Drain, Library Assistant II to Library Acquisitions Control Clerk, Range 43. Seconded by Mr. Linder. Motion carried with Mr. Hatchett, Mr. Linder and Mr. Finch voting aye and Mr. Krause abstaining. b. Based on representations by Mr. Paul Rettig that the conditions in Rule 4, Section 7 have been met, Mr. Hatchett moved for the recognition of higher level status of employees performing container maintenance work to Container Maintenance Worker, Range 45. Seconded by Mr. Linder. Seconded by Mr. Finch and motion carried unanimously. Mr. Hatchett moved to postpone Item #14. Seconded by Mr. Finch and motion carried with Hr. Hatchett, Mr. Finch and Mr. Linder voting aye and Mr. Krause abstaining. Mr. Hatchett moved to postpone consideration of Item #18 until the next regularly scheduled meeting. Seconded by Mr. Linder. Mr. Finch passed out material relating to proposed changes in examination monitoring, veteran's preference points and applicant referral form. Motion passed unanimously. . Director reported that Mr. Larry Black had forwarded a letter to the Chairman of the Civil Service Board asking that his earlier request to appear before the Board relative to Mr. William Dixon be withdrawn. Director asked Board about the temporary assignment of a Sanitation Driver II to work with the Training Officer in the formulation of training programs in the division and whether six-month rotational assignments could be made without violating civil service procedures. Mr. Finch inquired as to whether this was an Agenda Itemt and as it was not a listed itemt that it be considered at the next meeting. Mr. Finch asked that the Board return to Item #15, Review of Director's action. He read from Rule 15 which reflects that in grievance matters the determination of the Board is final and binding. He related that the Employee's letter in writing was a direct appeal to the Board, the Board acted and did not hear any- thing from the Manager until the time had expired; therefore, the Director was outside of hiB authority. Mr. Finch moved that the Director be suspended for thirty days without pay. Seconded by Mr. Hatchett for discussion purposes. Mr. Finch said he believed the Director signed the Personnel Action Sheets to add validity to the Manager's position. Director related that his action was based on (1) an indication to the Board on July 16, 1976 that he felt the Personnel Action Sheet should. be signed unless he received objections from the Board and then receiving no response from the Board and (2) his desire to eliminate further charges of'discrimination against the Board or the City with respect to Mr. Washington. He stated that signing the Personnel Action Sheets was a ministerial act, the voiding of Mr. Dixon's promotion having previously been effected by the Manager, including loss of pay. Mr. Krause related that he was disturbed by the Director's action. Mr_ Hatchett suggested postponing action on the suspension until September because of the need of the Director to coordinate the Board's scheduled investigatory hearing on August 23rd. Upon call for the question, Mr. Finch vot~~ for the motion. Mr_ Hatchett voted naYt and Mr. Linder and Mr. Krause abstained. Chairman directed that the situation of Mr. Laursen and his overall behavior as far as the Board is concerned over the last three'months of activities and preferably the past year, will be on the September Agenda. .
