Special Civil Service Board Meeting held July 21, 1976

The Civil Service Board met in special session on Wednesday, July 21, 1976 at
1:3~ P.M. in the City Commission Chambers ~t City Hall with the Clearwater City
Commission. The purpose of the meeting was to discuss items of mutual concern.
Present at the meeting were Joseph Verdi, Tom Chenoweth, Paul Hatchett, Alex Finch
and Robert Krause of the Civil Service Board; Gabriel Cazares, Mayor-Commissioner,
Karlean DeBlaker Bnd Karen Martin, Commissioners; Picot Floyd, City Manager; and
Tom Bustin, City Attorney.
Mayer Cazares called the meeting to order and thanked the members of the Civil Service
Board for the time and effort they put into their work. He stated the purpose of this
informal session is to discuss items of mutual concern, not to find fault with the
past, but to find a solution for the future and to discuss what will be good for the
Civil Service Board and the City.'
Commissioners Martin and DeB1aker questioned the presence of Joseph Verdi at the
meeting, contending that having announced his candidacy for public office, he should
have resigned from the ~~ard. \
Mr. Verdi advised the Commission and Board that he intended to resign at the conclusion
of this meeting. ,He stated that his interpretation of the requirement in the Civil
Service Act differed from that held by the Commission and that he had only announced
that he would seek the nominntion to the Office of the House of Representatives, not
that he was a candidate.
Mr. Hatchett asked for responses from the City Attorney and the Personnel Director as
to the nature of the Board, i.e., is it a chartered board and has there been a
communications breakdown? City Attorney said the Civil Service Board is an
administrative and advisory board set up under Special Act as a department of city
government, and that the Civil Service Act is not per se part of the Charter. Director
stated that he felt there had been an obvious loss of communication between the City
and the Board but he could not define how it occurred.
Mr. Hatchett brought up the matter of attendance at Civil Service Board Meetings by
representatives of the City Manager's office and the City Attorneyfs office. He noted
that in some instances, such representation was not evident. Discussion continued
concerning the need for improving communications and the need to remove emotional
responses from issues under consideration.
Mr. Chenoweth related that he felt a more than average amount of antagonism existed
and perhaps the Board responded to that instead of the issues. Mr. Finch stated that
the problem is the time element which many times is insufficient for proper,review and
consideration.
Discussion concentrated on the Commission~s reported activity towards establishing
rul~s of procedures for' the-;Board to operate under at its meetings and hearings. Mayor
assured the Board Members tha't they would have ample opportunity to counnent on the
proposals .

has problems with any of its rules, the City should let the Board know and they will
consider changing it if it interferes with effective operations. He continued that
the Board is an Administrative Board in all respects. He also said had three
interests: 1. taxpayers, 2. employees, 3. merit system.
Mr. Chenoweth said the Board needed to place more reliance on its own professional
staff and on the advice of the legal department.
Mr. Krause questioned whether the Civil Service Act has been repealed by the Home Rule
Act. City Attorney said it had not been repealed, but that Florida Statutes 166.021,
sub-paragraph 5, Home Rule Amendment, makes the special act creating the Civil Service
Board an ordinance of the City, subject to change by the City Commission, except in
those instances where the particular change encompassed would be taking away an
employee's rights. That isolated instance, as cited by the Attorney Generalis opin~on
must go to referendum, otherwise changes can be made to the act by ordinance.
Mayor summarized some of the points which had been made during the course of discussion,
including that the City Manager should have a representative at each Civil Service
Board meeting, the City Attorney should have a representative at each meeting, that
everyone should avoid undue criticism, that the staff of the Board should he used more
effectively, and that the City Attorney should be used more effectively and
efficiently.
Mayor inquired as to whether Annual Reports had been received from the Board. He was
advised that such reports had been provided. ,
Commiss1.oner DeBlaker stated that the Board should feel it represents all citizens of
Cl~arwater, not selective groups. She noted that in past years, Board Member turnover
had been less frequent than in the past several years and that continuity of the Board
was perhaps part of the problem. A further expression was made that the Boardls
hearings were perhaps too judicial in nature.
Mr. Krause asked the City Commission to consider providing budgetary means for the
Board to employ independent legal counsel. Mayor said the recommendation would be
given consideration.
The City Manager and the City A,ttorney indicated in response to a question by
'Commissioner Martin, they would have r~presentation at Civil Service Board meetings.
Mr. Verdi expressed his belief that significant strides had been made as a result
of this meeting.
Mr. Hatchett asked the Director if notice of the Board's next meeting had been
distributed. Director advised that the notice of a special meeting had not been
distributed, but would be done so after Mr. Hatchett reviewed the draft notice after
this meeting.
