The Clearwater Civil Service Board met in regular session on Monday evening,
October 13, 1975 at 7:30 P.M. in the Civil Service Office, City Hall Annex.

of the Board and the audience of the unofficial agreement to make every effort to
adjourn the meeting by or before 9:00 o'clock. Towards that end he stated he hoped
that each person talking would be as brief and to the point as possible and relate
his remarks to the Agenda item that is being discussed.

provide additional funds to our regular budget for this purpose. If they do not,
funds will be provided from monies budgeted for test validation studies.
Mr. Finch moved the request tor employment of an Attorney to represent the
Civil Service Board be denied, the reason being that the Act specifically states
that the City Attorney will advise the Board. Motion died for lack of a second.
After discussion, Mr. Verdi moved the Board hire Mr. Stephen NaIl as an independent
counsel for this Board in accordance with motion passed at the special meeting of
September 30, 1975. Motion seconded by Mr. Hatchett and passed with a 4 to 1 vote -
Mr. Vinch voting no.
Ohairman Chenoweth suggested that appropriate action might be made to receive the
appeals formally and to direct the Secretary, Mr. Laursen and Attorney NaIl to make
preliminary arrangements for the hearings, discussing this with the parties involved
and after preliminary arrangements are made to call a special meeting for the Board's
approval of the arrangements.
Mr. Finch said a date should be set now for each of the appeals and then if there
is a good cause shown, they can be changed.
Mr. Verdi moved that this Board accept the appeal of Bobby Garretson in that it was
filed within the time limit prescribed by the Civil Service Act, that the hearing
be scheduled for October 20, and that the Board's Secretary and its newly appointed
Attorney seek advice from the Attorney General as to whether the Sunshine Law
supersedes the Civil Service Statute. and if it does, what should be the nature of
the hearings - preliminary or public? Seconded by Mr. NaIl. Motion carried with

Mr. Hatchett abstaining.
Mr. Verdi moved that this Board accept the appeal of William Stopher in that it
was filed within the time limit prescribed by the Civil Service Act, that the
hearing be scheduled for October 27, and that the same question with respect to
the application of the Sunshine Law to the hearings be followed as provided in the
previous motion, Seconded by Mr. Nall. Motion carried with Mr. Hatchett abstaining.
Mr. Verdi moved that the Board accept the appeal of Max G. Battle in that it was
filed within the time limit prescribed by the Civil Service Act and that the dates
for the hearing of the appeal be established in accordance with a stipulation to
be drawn waiving the requirement for a hearing within 30 days, said stipulation to
provide that no appeal can be based on the grounds that said hearing was not held
, within 30 days; further that said stipulation be executed and received wlthin five
days. Seconded by Mr. Hatchett and motion carried unanimously.
5-6. Mr. Hatchett moved that Item #5 and #6 regarding meritorious increases for
, William Burns, Dispatcher II, Utilities Department and Robert Schlegel, Grounds-
keeper, Parks & Recreation Department be tabled until action is taken to change
'the Rules regarding meritorious increases. Seconded by Mr, Verdi and motion
carried.

Mr. Verdi moved the Board approve changes in uRules for Administering City of
Clearwater Pay Plan" to comply with Fair Labor Standards Act as provided in the
Director's memo of October 9, 1975.
A. Pay Plan paragraph 6b - incentive work week changed to provide overtime
after 40 hours of work.
C. Pay Plan paragraph 6h - hours specified in job description to be deleted.
Motion seconded by Mr. Hatchet and carried with Mr. Finch voting no.
Mr. Hatchett moved the Board approve Director's recomm~ndation for changing
paragraph 6d of the Pay Plan Rules from providing straight time for supervisory
personnel to providing time and one-half for overtime if approved by the
Appointing Authority. Said change to be effective October I. Seconded by
Mr. Verdi and motion carried unanimously.

Mr. Verdi moved that discussion of the Agenda Item on the Pros & Cons of Eligibility
List and Certification Procedures be deferred until the next regular meeting.
Seconded by Mr. Hatchett and motion carried unanimously.

Bob Clark~ President of Fraternal Order of Police spoke on Police Sergeant Minimum
Experience Requirements. Chief Daniels and Officer Robert Walker also expressed
their opinions on experience requirements for Police Sergeant. After discussion,
Mr. Verdi m~ved the Board approve 4 minimum experience requirement of three years
for eligibility for promotion and for taking the Police Sergeant exam. Seconded
by Mr. NaIl. Motion carried with Mr. Finch voting no.

Director passed out Operations Manual (proposed revisions) from the Police Department.
Mr. Verdi moved the Board receive this manual for study and defer action until the
Appointing Authority and Personnel Director have approved the manual. 'Seconded by
Mr. Finch and motion carried unanimously. .

After discussion of request from City Manager for waiver of the application of
Rule S~ Section 3 as it applied to Mrs. Gloria Burgess (former Municipal Court
employee), Mr. Finch moved that Rule 5 be amended so that an employee in this
situation will be replaced at the same pay regardless.
