Proceedings of Civil Service Board meeting held January 13, 1975.
The Clearwater Civil Service Board met in regular session on Monday evening.
January 13, 1975 in the Civil Service Office, City Hall.
Members present: Glenn Finkenbinder, Helen Peters, Carroll Nall and
A. D. Finch
Visitors:
Connie Marquardt and Aida Bowen, League of Women Voters;
Gardner Smith, D. L. Hall, A. L. Velong, Paul Kane,
Mary Drew, Virginia Leahy, Wayne Starkey, Carol Sheeler
and Joan Benjamin
In the. absence of a Chairman and up,on the request of the Board Members,
Mr. Finkenbinder assumed the role of Acting Chairman and called the meeting to
order.
Director welcomed Mr. A. D. Finch, new Board Member elected to fill the unexpired
term of Glen Vantrease.
Director advised the Board that the Civil Service Act states that each Board shall
elect annually at the first meeting of each year, one of its members as Chairman.
. Board menmers had asked Glenn Finkenbinder to serve as Acting Chairman of this
meeting and post poned appointment of a permanent Chairman until there is a full
. Board present.
Acting Chairman Finkenbinder stated that if there were no additions or corrections,
'Minutes of December 10, 1974 would stand approved as submitted.
Director pointed out to the Board that there were 12 promotional appointments on
the .Agenda.' He also called attention to the fact that Mrs. Vizbara, Clerk-
Typist II, had been hired on an Elnergency Appointment in the City Clerk
Department to help at election time.
Director cOlmnended Mr. Whitehead, City Clerk, and Mrs. Vizbara who assisted
in setting up and conducting the election,!n cooperation with the three employee
groups, for our Board Member. They did an outstwlding job and this served as a
model for how future elections can be conducted.
Miss Drew advised the Board that it is not necessary to hold an election for a
.Board Member as the Law says all classified employees aha11 select their Board
Members and it does not say how they select them. Miss Drew also commended
Mr. Whitehead on the work he did on the election.

Mrs. Peters moved that the resignations of June C. Jones, Clerk Typist II, Service
and Information Division, City Manager Department, Daniel Rathke, Equipment
Operator., Parks & Recreation Department, Lee J. Virgil110, Maintenance Worker I,
Parks & Recreation Department, Gregory D. Dick, Recreation Leader, Parks &

Secretary I, Police Deportment be approved. Seconded by Nr. Finch and motion
carried.
1. Mr. Nall moved that the Board ratify the Director's action in approving one
additional position of Custodial Worker (PPT), Range 35, Salary $228.85
bi-weekly in the Parks & Recreation Department. Seconded by Mrs. Peters
and motion carried unanimously.
2. Mrs. Peters moved that the Board ratify Director's action in approving the
establishment of four additional positions of Mechanic II, Range 54, Salary
$361.10 bi-weekly in the Garage Division of the Central Services Department.
Seconded by Mr. Na1l and motion carried unanimously.
v3. Mr. NaIl moved that the Board approve the changes of Exempt and Non-Exempt
Classifications under the Fair Labor Standards Act as follows:
Technical Equipment Foreman and Accountant ,I previously listed as exempt
i~tthe Pay Plan (not restricted to hours of work and exempt from the require-
ment of overtime payment) be changed to non exempt; Library Assistant III
and Assistant Harbormaster previously non-exempt be changed to exempt
positions and that in line with these changes, the title of Technical
Equipment Foreman be changed to Technical Equipment Operator. Motion seconded
by Mr. Finch and carried unanimously.
Director gave the Board a verbal report on the Emergency Job Program. This is a
federally funded program under the Comprehensive Employment & Training Act which
was passed by Congress to provide public service jobs solely in an effort to
assist in the problem of unemployment this country now faces. Federal monies up
to a maximum of $10,000 per position are made available to various areas based on
certain formulas. Monies have been made available under this program to Pine11as
County. Pinellas County has some option of determining where these monies go
within the County. They have an initial release of several hundred thousand
dollars in which they are going to employ a nuwber of people effective January 13.
.The federal government will evaluate how these positions have been filled and if
the initial program evaluation is good, they will release the additional 80% of
the money. The total money package to be made available in this area for public
service positions for a period of one year is $1,187,000. The City of Clearwater
was given 12 positions on the proviso that these people were on the job on
January 13. The positions are: 9 Maintenance Worker l's; 2 Custodial Workers;
and 1 Messenger.
Director presented written r.eport on the status of the Housing Project Manager.
after the report there was a general discussion by the members and visitors
Mr. Weimer said that the City will make an appointment from the Eligible List as
certified but .that there is an Agreement with the Housing Authority and the City
would like to h~ve the opportunity to "clean Upl' this original Agreement:: before
making the appointments.
Mr. Finch asked whether the exam for Project Manager was germane to the position.

Director related that the exam was developed in the Personnel Department and
reviewed by the Housing Coordinator and was felt to be fair, reasonable and
job related.
Other visitors made COlmnents or asked questions including:
Mrs. Joan Benjamin: (1) How many women and minorities took the test?
(2) What relationship does the City's Affirmative Action
program have to the Proj~ct Manager situation?
Mrs. Carol Sheeler:
Nrs. McCaskill was "statistically at a disadvantage."
Mrs. Marquardt:
Stated that she knew both Mrs. Leahy and Mrs. McCaskill
and of their sincerity and competence and lIit is
inconceivable to me that the City of Clearwater cannot
find a position for these employees.'.
Mr. J ames Marshall:
Related that there is a law regarding consolidation
between agencies and the protection of employees against
loss of benefits and suggested that the City Attorney review
this statute to see if it would have any bearing on this
question.
Several spokesman of the CEA stated their position that, while sympathetic to the
situation of Mrs. McCaskill) the City must make an appointment of Project Manager
from the Eligible List..
MIs. Virginia Leahy, Secretary I in the Housing Department asked for assurances
that she would be retained by the City.
Mr. Weimer'again recommended that the City follow the Civil Service Act and make
the appointment from the eligible list but give the City time to get back to the
Housing Authority at its meeting in February to get the contract amended so that
it will be in compliance with the Act and then concurrently the City would make
the appointments from the Eligible List.
l'1r. Finch stated .that if this Board is satisfied that they have had a proper
teques~ to bring these people under the classified service; that the job
classification is in line; that the classification is gennane to the duties
expected of this person; and that the exam was given properly and legally) the
Board should have no worries.
Mr.. Finch moved that the Board take no action on the matter of Project Manager
because it has already been done. Seconded by Mr. NaIl and motion carried.
Director proposed to the Board that they grant to the managerial employees in
.~ the Police and Fire Department the same level of economic benefits that are now
enjoy~d by the rank and file members in those respective departments. This
