Proceedings of Civil Service Board meeting held December 2, 1974.

The Clearwater Civil Service Board met in special session on Monday evening,
December 2, 1974 in the Civil Service Office) City Hall.
Members present: Glen Vantrease, Glenn Finkenbinder, Helen Peters & Tom Chenoweth
Visitors: Gerald Weimer) Asst. City Manager, Bill Bryant, Firefighter's Union
President and Asst. Fire Chief Dave King
Chairman stated that the special meeting had been called to review the proposed
contracts negotiated in collective bargaining sessions with the Fraternal Order
:of Police, Lodge #10 and with the International Association of Firefighters,
Local {fU58.
Chairman asked for comments on the contracts.
Mr. Chenoweth stated that he had studied both agreements and thought that they
were among the better agreements he had ever seen.
Mr. Bryant stated that he felt it was a very successful negotiation and that the
City of Clearwater needs to be complimented on the expert way in which they handled
the negotiations. The way the executive officers and the Civil Service Director
conducted themselves it was certainly a pleasure to do business with such gentlemen
throughout the entire matter. The firefighters are pleased with the contract and
with the relationship with the City administration and are looking forward to
working under this contract. '
Mr. Weimer said he had no comments other than that the contracts were being
recommended to the City Commission for adoption.
Mr.. Chenoweth moved that the contract with the International Association of
Firefigbters,.Local #1158 be approved and recommended to the City Commission for
adoption. Seconded by Mr. NaIl and motion carried unanimously.
'Ihere were several comments Bnd questions raised regarding the Police Contract
which the Board requested be brought to the attention of the Commission. They were
as follows;
(1) It was pointed out that many labor contracts utilize an outside arbitrator
to resolve grievances arising from the contract whereas in this Contract the
Civil Service Board has the responsibility. Questions raised were (a) Does
the Civil Service Board have the legal.right to act as the arbitrator?
(b) Does the Board have the expertise to perform this function?
(2) It was pointed out that Section 5 of Article IV (Grievance Procedure) begins
"All dismissals, suspensions and demotions and grievances concerning same
may be initiated in the third step of the grievance procedure..." The
question was raised as to whether such wording was correct or whether it
should read "All grievances concerning dismissals, suspensions and demotions
may be initiated in the third step of the grievance procedure..."

It was noted that the Board is willing to serve as the arbitrator on grievances
under the Police Contract. and during the' discussion points were made that:
(1)
The Board now serves as the final and binding arbitrator of grievances
under curr~ Civil Service Rules, including interpretations of those
Rules.
(2)
The Board's history of dealing with employees and/or employee organizations
in the past has shown competence, fairness, and equity.
(3)
The grievance procedure was a product of negotiation, acceptable to the City
and to the F.G.P. in the bargaining process.
(4)
The uae of the Board will reduce costs of arbitration and eliminates bringing
in outside influences.
(5)
The.procedure can be amended io. the next contract negotiations if it does
not prove workable.
Mr~. Peters moved that the Board approve the F.O.P. Contract and recommend it to
the. City Commission for adoption with the comments made at this meeting. Seconded
by Mr. Finkenbinder and motion carried unanimously.
Mr. Vantrease 'concluded the meeting with the comments, "This is indicative of
wha~ts happening in the City of Clearwater. of communication and understanding
between employee groups and City Management and I think this is an outstanding
accomplishment on.both sides even though neither of the three sides got everything
they. .thought they should get, It is a credit to the'leaders of all the
organizations ./1 Mr.. Chenoweth seconded these comments.
