Seconded by Mr. Stephens and motion carried. 2. Mr. Schardt moved that the Board approve a 10% Meritorious Increase for Mr. Willard Stewart) Rodent Control Inspector in view of the broadened range of duties of the Rodent Control Inspector and in anticipation of these added duties being included in the job description in the new classifications under study. Motion seconded by Mr. Falzone and carried. 3. Mr. Stephens moved that the Board approve Director's request to ratify his action in approving the establishment of the following additional positions: 2 Janitor (PPT) 1 Clerk-Typist I 2 Sanitation Driver I 1 Field Housing Inspector Ran~e 31 29:-: 38 52 Salary $180 b/w 171 b/w 213 bfw 298 b/w Central Services Building Utilities-Sanitation Building Motion seconded by Mr. Falzone and carried. 4. Mr. Falzone moved that the Board ratify the Director's action in approving the abolition of the following positions: 1 Electrical Inspector I 1 Janitor (PPT) Range 54 31 Salary $314 b/w 180 b/w Building Central Services~Garage Seconded by Mr. Stephens and motion carried. , j 5. Mr. Blackstone moved that the Board approve request by Personnel Director to establish a new classification of Mobile Home and Trailer Park Inspector in accordance with the City Manager's request, subject to ratification of the job description and salary range at the n~xt regularly scheduled Board meeting. Serina Palumbo, Clerk-Typist I, Planning Department Seconded by Mr. Falzone and motion carried. t 1 ~ Miss Drew, president of the City Employees' Association asked about the situation regarding Mr. Janocha who had been appointed on an Emergency basis as Water Pollution Control Superintendent. Director informed the Board that Mr. Janocha had passed the examination when it was given the second time and he had been certified in the top rive to the Appointing Authority, who subsequently appointed him asa probationary permanent employee from the Eligibility List. Director concurred with this) however) he was of the impression that the matter was satisfactorily settled as a result of the second examination and spplication of the Rule of Five. Director's understanding was based on the discussion at the February meeting by Mr_ Kennedy~ Assistant City Attorney, who related that in the opinion of the Legal Department) the Civil Service Rules and Regulations are consistent with the Civil Service Law and that the Appointing Authority does, in fact, have the right to the Rule of Five. .~ ~ ~ '. ~ I ~./ . ., , , .'ti. c, :! Association, expressed an opinion opposing that of the City (as did the letter from the Attorney General) and it was this opposing opinion that prompted him to vote for the extension of the Emergency Appointment of Mr. Janocha and that, in his opinion, there was no decision made at the February meeting with regard to a permanent appointment for Mr. Janocha. /';, 'r .>, ',' , " ','. ~~:~ The Director stated that there are two separate questions at hand. The Emergency Appointment -- the legality of it -- is one question and the second question is does the Appointing Authority have the right to a Rule of Five? He felt that the . 'consensus of the Board at the February meeting was that Emergency Appointments should not be made when an Eligibility List is in existence, a premise that the Appointing Authority since accepted. Further) based on two points) the belief that the Appointing Authority has the right under the current Rules and Regulations to invoke the Rule of Five and the Board's decision not to effect any changes in the existing rules, he saw "no reason not to sign the personnel action sheet on , Mr. Janocha.t1 The Chainnan stated that there was nO use discussing the matter further unless both attorneys were asked to come to a meeting. Mary Drew, President of the Employees' Association asked that it go on record that the Employees' Association feels Mr. Janocha is holding his position as Water Pollution Control Superintendent illegally. ~. Falzone moved that the Board approve Maternity Leave of Absence for Rita Chernick, Clerk-Typist II) Civil Service Office, beginning April 2, 1973. Second~d by Mr. Stephens and motion carried. Mr_ Ramsey) Chairman of the Civil Service Board submitted his letter of resignation to be effective June 30, 1973 because he will be moving out of town. Director passed out Annual Report of the Civil Service office for the calendar year 1972. This report will be submitted to the City Commission as the Annual Report of the Board.
