The Clearwater Civil Service Board met in regular session on Monday evening,
February 12, 1973 in the Civil Service Office at City Hall.

Members present: William A. Ramsey, Arlie Schardt, and Cliff Stephens
Visitors: Guy Kennedy, City Attorney, Gerald Weimer, Asst. City Manager
Mary Drew, Pres. of Employees' Association, Wesley Brettel,

Chairman Ramsey called meeting to order.
Mr. Schardt moved that the minutes of the meeting of January 8, 1973 be approved.
Seconded by Mr. Stephens and motion carried.
Director reported on certifications and appointments.
Director reported on assembled examinations conducted.
Director reported on lay-offs, suspensions and dismissals. "No Board action
necessary.

Sanitation Workers, Sonitation Divinion, Utilities Department, Charles F. Crane, Jr.,
Incinerator Attendant, Sanitation Division, Utilities Department and Alphonza Robinson,
Laborer, Water Division, Utilitiofl Dopartment, be accepted. Seconded by Mr. Stephens.

Board reviewed portions of the Civil Service Act and Civil Service Rules and
Regulations with respect to Emergency Appointments and the "Rule of Five.1I
Mary Drew, President of the Employees' Association read letter from the
Attorney General rcgarding Emergency Appointments and stated that the
Association felt that the Civil Service Law regarding these appointments
supersedes the Rules.
Asst. City Attorney Guy Kennedy gave opinion as follows:
nThe question that has been raised of our Department - The Legal Department -
is: Is there a definite and an essential inconsistency between the Rules and
Regulations and the Statute itself? It is the opinion of the Legal Department
that, when you look at the overall intent of the basic legislation and the
Rules and Regulations that have been prepared and compiled by the Director and
adoptedJ approved and enacted by the Board, that they are not inconsistent.
The Board docs have the proper authority and it has properly exercised this
authority in enacting the Rules."
After a lengthy discussion regarding the Civil Service Law and Rules pertaining
to Emergency Appointments, the Director stated he felt confident that as a
result of the discussions, even though he could not speak for the Appointing
Authority, there probably would not be any future Emergency Appointments made
when there is an Eligibility List.
Mr. Weimer stated that he could speak for the City Manager and assured the Board
that there would be no Emergency Appointments made of an applicant who had failed
an examination when there were other applicants on the Eligibility List.
Director asked Board Members whether or not they felt that the rules regarding
Emergency Appointments should be changed at this time. The Board agreed that
a formal change in the rules should not be made until the Rules Committee had
finished their recommendations on changes in the Rules.

approving the establishment of the following additional positions be approved.

Mr. Schardt moved that the Board approve City Manager's request to establish
a new classification of Property Clerk, Rangc 40, Salary $224 bi~weekly in the
Services Division of the Police Department with an initial complement of one
position therein. Seconded by Mr. Stephens and motion carried.
Mr. Schardt moved that the Board approve request from City Manager for a 5%
Meritorious Pay Increase for Mrs. Dorothy Roth, Secretary III in the City Manager
Department. Seconded by Mr. Stephens and motion carried.
Mr. Stephens mov~d that the Board approve request from Larry P. Kelley, former
Electrician-Lineman I, to withdraw his resignation. Seconded by Mr. Schardt.
Motion carried.
~. Schardt moved that the Board approve the placement of Christine Morris,
Librarian, in Step 8 of Range 46, effective January 8, 1973. Seconded by
Mr. Stephens. Motion carried.
Mr. Schardt made a motioll to approve Director's recommendation to promote Jimmy
Waters, Emergency Mechanic II, Garage DiviSion to Mechanic II without an examination
based 'on his job performance in the last 11 months. Seconded by Mr. Stephens,
'for discussion purposes. After ,discussion, Mr. Schardt withdrew his motion and
Director stated he would schedule an assembled writte~ and oral examination for'
Mechanic II which would be advertised in a routine manner.
Mr. Schardt moved that the Board approve extens~on of Emergency Appointment of
Michael paroby, Central Services Director. Seconded by Mr. Stephens and motion
carried.
Mr.. Stephens moved the meeting be adjourned.
