The Clearwater Civil Service Board met in regular session on Monday evening, January 8, 1973 in the Civil Service Office at City Hall. Members present: William A. Ramsey, Armand Falz.one, Cliff Stephena and Arlie Schardt Visitors: Mary Drew, President of CEA, Wesley Brettel, Fire Department, Bill BTyant, Fire Department, John Anthony, Public Service Department, W. C. Stopher and Paul Rettig, Utilities Department, Gerald Weimer, Asst. City Manager and Attorney Robert Tench Meeting was called to order. Director asked that the Board elect a Chairman for the year 1973. Mr. Falzone requested that he not be considered at this time due to impending surgery. Mr. Stephens expressed appreciation for the outstanding job that Mr. Falzone has done as Chairman and moved that the Board r.ppoint William A. Ramsey as Chairman. Motion was seconded by Mr. Falzone and carried. Mr. Schardt moved the minutes of the meeting held December 13, 1972 be approved. Seconded by Mr. Stephens and motion carried. Director reported on certifications and appointments. Director reported on assembled examinations conducted. Director reported on lay-offs, suspensions and dismissals. No Board action necessary. Mr. Stephens moved that the Board ratify the Director's action in approving establishment of the following additional positions: 1- Clerk-Typist I, Inspections Division, Fire Department, Range 29, Salary $171 hi-weekly. 1- Clerk-Typist I, Utility Accounts Division, Utilities Department, Range 29, Salary $171 bi-weekly. 3. Mr. Falzone moved that the noard ratify the Director's action in approving the following Emergency Appointments: Serina Palumbo, Clerk-Typist I, Planning Department Carolyn Cobb, Clerk-Typist I, Community Relations Division Margaret McDowell, Clerk-Typist I, Utilities Department Charlene Stoley, Communications Clerk I, Central Services Department James Lyle, Electrical Inspector I, Building Department Seconded by Mr. Schardt and motion carried. 4. Mr. Stephens moved that the Board approve City Manager's request to establish two additional positions of Dist. Serviceman I, Range 34, Salary $193 bi- weekly in the Gas Division of the Utilities Department and abolish two positions of Gas Plant Attendant, Range 34. Motion seconded by Mr. Falzone and carried. 5. Mr. Stephens moved that the Board approve request from City Manager to establish one additional position of Distribution Serviceman II, Range 40, Salary $224 bi-weekly in the Gas DiVision, Utilities Department. Seconded by Mr. Falzone. Motion carried. 6. After discussion, Mr. Stephens moved that Christine Morris, Library Assistant II be re-classified to the position of Librarian without examination and that the Personnel Director meet with Mrs. Morris and discuss the salary step into , which, she will be placed in the new classification along with any othex , considerations involved with this re-classificat'ion with step placement subje"ct to ratification by the Board, provided however, that the effective date of the change be not later than January 8, 1973. Seconded by Mr. Falzone. Motion carried. Mr. Weimer, Assistant City Manager, stated that he felt where the City and the Civil Service Board permitted an employee to work out of classification for the period of time provided in Rule 4, Section 7, that the employee should not have to take an examination if the position were' re-classified. The Director asked the Board to clarifY its policy with respect to re-classifications, i.e. whether to require examinations on re-classifications. It was the consensus of the Board that, in future re-classifications, examinations shall be required unless the proposed re-classification involves special considerations, in which instance the Director shall bring forth appropriate details to the Board and they will make a decision as to whether or not an exam will be conducted. , , ," ,,' '(.f, (.. Director reported to the Board that he would like to consider changing Civil Service Rule 5, Section 4, to reduce the timo interval required between eligibility for examination re-takes from the present 90 day to a period in the area of 45 to 60 days and to eliminate the provision restricting ~, applicants to no more than three attempts at any examination,. There being no objections from the Board, the Director stated that he will discuss this Rule with the City Manager's Office and employee groups and bring a formal proposal back to the Board at a subsequent meeting. 8. Director reported to the Board that he would like to ~larify or change portions of Section 3 and/or Section 7 of Rule 13 regarding reserve training duty to eliminate the obligation for the City to pay employees for time off for reserve training duty when said duty results from the voluntary extension of the employee's service period. There being no objections from the Board, the Director stated that he will discuss this Rule with the city Manager's Office and employee groups and bring a formal proposal back to the Board at a subsequent meeting. 9. 'Director read Legal Opinion from Herbert Brown, City Attorney, regarding Division 2, Section 14 of the City Charter and Civil Service Rule 8, Section 5 (b). Robert Tench, Attorney for the City Employees' Association stated his opinion on said Law and Rule. This matter was brought up by the City Employees' Association due to the fact that an applicant was employed on an Emergency Appointment even though an eligibility list with four names was available. The Utilities Director explained to the Board members why the applicant was hired on ,an emergency basis. He thoroughly reviewed the background and qualifications of the eligible applicants and felt that the applicant hired was much better qualified and that there were legitimate reasons for the rejection of those on the eligible list. After lengthy discussion as to what action should be taken, the Director suggested to the Board that no action be taken at this time and that the matter be referred back to the City Attorney for further clarification as to'whether the Civil Service Law is permissive to the extent that the Rule of Five currently provided for through the Rules and Regulations is consistent with the Law and whether the Emergency Appointment is consistent with the Law and Rules. Mr. Schardt moved that this matter be tabled until the next regular meeting. Seconded by Mr. Stephens with the request that a Legal opinion be rendered at that time by the City Attorney as suggested by the Director. Motion passed. 10. Mr. Schardt moved that the Board approve request for extension of Emergency Appointment of Felix Janocha, W.P.C. Supt., Utilities Department for an additional 60 days. Seconded by Mr. Falzone and motion carried. 11. Mr. Stephens moved that the Board approve request for extension of Emergency Appointment of Curtis McCoy, Deputy Community Relations Coordinator, Conununity Relations Department. Seconded by Nr. Mr. Falzone moved the Board approve request to extend Emergency Appointment of Jimmie Waters, Mechanic II, Garage Division, qentral Services Department for an additional 60 days. Seconded by Mr. Stephens and motion carried. 13. Director reported on the progress and the recommendations that have been made by the Civil Service Rules Committee. Mr. Weimer told Board members that he is now in a position to start having Rules Coumdttee meetings again. Director read memos from Mr. Moore and Mr. Wilson regarding recommended pay increase for a Recreation Supervisor I in the Morningside Complex. The Director said that he could not recommend a three-range merit increase and his recommendation would be to refer the matter to Mr. Cody who is doing the classification and salary survey. Mr. Stephens suggested that the matter be discussed further by Mr. Wilson and the Personnel Director. ,Mr. Stephens moved that the Board approve request of City Manager to establish two additional positions of Plumbing Inspector I, Range 54 in the Building Department. Seconded by Mr. Scha~dt and motron carried. Mr. Falzone moved the Board approve City Manager's request to establish two additio~al positions of Police Pat~olrnan and one position of Police Sergeant in the Police Department. Seconded by Mr. Stephens and motion carried. f d 'j ~ , Director discussed letter he had mailed to Board members and spoke specifically about item 3 regarding items brought before the Board. Mr. Stephens moved that items appearing on the Agenda would have to be requested through the Personnel Department no later than the close of the day's work on Wednesday preceding the Board meeting the following Monday. Items not so submitted will not be discussed unless de~med to be of an emergency nature. Seconded by Mr. Falzone and motion carried.
