Mr. Davidson commented that they had the State DER on site and Pinel1as
County Env1ronmental,and they basically didn't have a problem with what
the developer proposed for the development of the property.

Mr./WeAae~seR further commented that the roadway pavement must be 241 wide
rather than 20'.
The developer questioned if there would be any problem with altering the
center line to avoid removing two trees, one of which is a 3611 oak tree.
Mr. Crawford responded that this would not cause any problems.
Kei th Crawford: Tra ffi c Engi neeri ng' s convnents were as follows:
1. Questioned how service and emergency vehicles will enter the
subdivision since it will require a card for entry, and how
service vehicles will turn around as the cut in the median is
not large enough for a car to turn around.
2. On the platting of lots, it is the City's policy on private streets
for the property line of lots to come out to the center of the ROW
so that somebody owns the property.
3. Detention area that is basically someone's side yard, questioned
what would prevent someone from filling the detention area in?
Mr. Davidson replied that it is under easement that is addressed
in the deed to the lot.
Cecil Henderson: Presented written comments prepared by the Utilities
Department (Attachment #2). Additionally, the Utilities Department would
want a la' easemenVup to and including all hydrants and meters.

John Richter: There needs to be a through access somewhere. Ideally it
should be on a boundary line between two subdivisions.
It is Planning's concern that some of the lots would not be buildable by
the time setbacks would be applied to the property. If lots are to be
16,000 square feet, that being the case, the City's zoning that would apply
to the property would be nothing less than RS-100. RS-100 zoning requires
a 3D' setback from the streets, 20' from rear property lines and a mininum
width of 80' measured at the setback line.
Also would like to see lot line dimensions, setback lines, and lot dimensions.

Bob Maran: Presented written comments prepared by Engineering (Attachment #5).
Additionally commented that one of the retention ponds appears to be on the
highest ground on the site and asked that the developer review this.
Keith Crawford: Thought this plan had been approved several months ago and
questioned why the plan was back before the Committee. Mr. Waitz responded
that it had gone to a hearing officer at the applicant's request and the
hearing officer approved the plan as presented. Mr. Crawford had requested
the entrance to be off Daniels Street and the request was denied by the
hearing officer. Mr. Crawford felt he' should have been present at the
hearing to present his reasons for the request.
The part of the property on Daniels Street is in residential zoning and
that part of the property can't be used as a parking lot unless a special Adjustment and
exception is granted. This request went before the Board of/dtist Appeali ~ . .
and they denied the use of the property for parking. This decision was
then taken before a hearing officer. Mr. Crawford felt he should also have .
been present at the Board of/~t Appeal~ hearing to present his position~djustmentand
Mr. Crawford restated the reason for his request to have the main entrance
off Dan;els Street was that it is directly across from Countryside High
School which is already a highly congested area and he felt there was no
reason to add to the already high traffic in this area.
It is Mr. Crawford and the Board's feeling that when the zoning in this area
is changed from residential this should be looked into again.
Mr. Waitz felt the developer would be more than happy to have the entrance
off Daniels Street if there would be any way for it to be done.
Mr. . Crawford further commented that dimensions for parking are missing, but
when he scales it he feels the area is short. Also, parking spaces are
marked 18' and that needs to be changed to 19'.
Cecil Henderson: This project is in a County water service area, and county
water is available. The dumpster location appears to be fine.

John Richter: Requests the plan to show where the sign for the development
will be placed. Landscaping will be necessary between S.R. 580 and the
parking spaces. Under notes - land use classification on lots 2-5 is
residential office instead of commercial tourist. Also, parking spaces
need tQ be 19' deep rather than 181.

MOTION: Cecil Henderson moved to recommend approval of the final site plan
for TreeD Office Complex based on the finding of this committee that the
plan confonns with the design guidelines for site plan review subject to
the following conditions:
1. Retention ponds be redesigned to meet City standards as required
by the Public Works Director.
2. That parking stalls be correctly indicated to meet City minimum
standards as required by the Traffic Engineering Director.
3. That the location of the sign for this complex be shown on the
plan.
4. That landscaping as required between S.R. 580 and the parking lot
be indicated an the plan.
5. That the loading space be correctly indicated at 300 square feet
minimum.

6. That the notes be corrected for the land use classification for
lots 2-5 to indicate the correct residential office designation.
7. That the developer be required to pay the open space assessment
prior to the City certification of the site plan. "
8. That the requisite initial building permits be issued within six
months from the date of approval of the final site plan~ and
all requisite certificates of occupancy be issued within two years
from the date of issuance of the initial building permit.
Motion was seconded by Ream Wilson and carried unanimously.
There being no further business before the Board, the meeting was adjourned
at 10:15 a.m.
