ITEM 1 - THE SHERWIN-WILLIAMS COMPANY paint store, proposed location on the west side of U.S. 19 just north of the U.S. Home Office Building 8 and Countryside Boulevard. Also Present: Gilbert W. Yingling, Sherwin-Williams Real Estate Representa-. tive, and Bill Richards, Sherwin-Williams. Preliminarx Site Plan Paul Rettig: Requested water main be extended along an easement on their north boundary out into the right-af-way of U.S. 19 and set a hydrant there. George Buhmeyer concurred. Meters should be ganged in the west side of the property in the easement or right-of,:,way,. and developer's pl umber to run services in from there to their building so Utilities will not have to main- tain the long 1~1t water service. 'Gas should be connected from rear easement and developer must get easement from existing waterline to his:property. Gilb~rt Yingling stated that the owner of the adjacent property has agreed to provide a 10' water and sewer easement. Mr. Rettig stated Utilities will maintain waterline and hydrant after developer installs. Parking on this plan was figured according to a shopping center definition for the site. Planning interprets this as two retail stores, not a shopping center, and parking should be figured on that basis,and will recommend to the Board of Adjustment and Appeal on Zoning that 64 spaces be required. Need 51 landscaping strip along parking lots facing proposed frontage road and requested plans show 5' ~~ss distance ~t-~ner-~~. Southerly portion of property is shawn as Residential/Office on Land Use Plan and property owner should request PS zoning amendment to have Zoning Atlas conform to Land Use Plan. The larger northerly portion is eTF, which is in compliance with the CP zoning. Don Meerians: Asked whether State had approved design of access to u.s. 19. The center island extending all the way to the edge of the pavement of 19 had not been approved by the State. The center island design was discussed and elimination was suggested. The aisle width shown as 22' behind the bunding should be 241. The 24' roadway scales to be 20' and requires re- design to 24'. The developer agreed to remove the cross-hatched area. The developer stated they have reciprocal rights easement to park on U.S. Home property from 5 p.m. to 10 a.m. and to park approximately 49 cars 300' away in the shopping center. George Buhmeyer: Would require relocation of the fire hydrant to coincide with the utility easement. . Cecil Henderson: Written comments were given to the developer and the secretary and are attached. Regarding Engineering Comment 3, the engineer was, suggesting the two storm drains be made into one. Mr. Henderson reported Chris Cowles I environmental comments which are included on the written com- ments attached. (Page 12.) . John Peddy: Recommended security lighting be high efficiency of 80 lumens per watt, or greater. He said that the east/northeast exposed glass of the front of the building, and the 5'sidewalk, which would not permit much over- hang for an 8' window could be shaded from the summer sun and would ultimately repay its cost. Ream Wilson: No comment. .MOTION: Paula Harvey moved approval of the Sherwin-Williams site plan subject to the following conditions and changes: 1. Variance for onsite parking be approved by the Board of Adjustment and Appeal on Zoning. 2. Easement be provided along the north boundary line and water meters be. placed within that easement. 3. The traffic island, as shown on the access to U.S. 19t be removed. 4. All aisle widths be 24'. 5. The fire hydrant as shown in front of the building be relocated to the northeast corner of the site. 6.' Preliminary Site Plan (Remodeling and Addition) Paul Rettig: No comment. Patti Stough: Sidewalk is required in the front and should be shown on the plan, or a variance requested. Paula Harvey stated they are in the process of annexing. At the public hearing, Planning will include their request for sidewalk waiver for Commission consideration. Paula Harvey: Landscaping is required along boundaries abutting residentially zoned properties. Suggested Chris Cowles, City Forester, approve any land- scaping along the property lines. Don Meerians: Questioned whether lawn parking would be physically designated. The parking has been thus for 20 years. It had been noted on the plan, at Planning's request, merely to show sufficient space. George Buhmeyer: No comment. I"~: ' " . . : i"'-" Community Impact Statement Addendum Paul Rettig: Concerns are easements required for water, sewer, and gas lines; aedication of rightMofMwaYi and looping of the waterline through the project and heading south, extending the waterline from Sunset Point Road south to the eXisting line. Patti Stough: If waiver of sidewalk along Sunset Point Road is needed, developer was informed application is made in the Building Department. Don Meerians questioned whether a waiver would be necessary along P1ne1and Drive, an existing right-ot-way. The Chairman said a waiver must be requested in case street is ever constructed. Paula Harvey: Asked why parkland and rights-of-way dedication requirements of the annexation agreement had not been met. Alvin Leitman stated that a request for amendment had been discussed with Ream Wilson and asked Mr. Wilson to discuss it. Mr. Leitman did not respond regarding the rightMof-way. Ream Wilson: This was due about 4 or 6 weeks ago--60 days after completion of the annexation. HUD is financing the project and the developer does not want to do anything until financing is accomplished. The exact amount of money for parkland requirement has been determined but a time certain must be established. Mr. Wilson suggested a time prior to issuance of the first building permit or a specific date, whichever occurs first, and not to ~ exceed 6 months from this date and preferably sooner. Don Meerians: No comment. George Buhmeyer: No comment. Cecil Henderson: Right-of-way owned by parties to the annexation agreement should be transferred as soon as possible--Mr. Leitman agreed. Noted that the developer has agreed to build a lift station and will connect to the Marshall Street treatment plant. An adjoining property is developing and, theoretically, they would have to build their own lift station and force main, which seems illogical. This is a complicating fact in the solution. John Peddy: Original objection to the energy conservation statement was not addressed in the addendum or elsewhere. The developer's statement indicated this project would encompass no significant energy conservation measures and is not acceptable. (Also see Mr. Peddy's comment on page 5.) Ream Wilson: Staff has agreed to accept the appraisal of $14,700 an acre but calculated on the 17 acres stipulated in the annexation agreement. The actual amount to be paid the City will be $24,990 and future approvals of the project will be tied with its payment. Mr. Wilson recommended payment prior to City Commission'approval of the site plan. The developer said this would be a hardship. Chairman Haeseker suggested a promisory note prior to City Commission action on the site plan. Mr. Wilson agreed if the note indicates that actual cash will be conveyed prior to issuance of the first building permit or January 1, ~~, whichever occurs first. The developer agreed. MOTION: Paula Harvey moved approval of the Community Impact Statement subject to the following conditions: 1. Specific criteria to be stated by the developer concerning energy conservation measures in the project~ 2. Dedication of all rights-of-way prior to issuance of building penmit for the site plan; and 3. Payment of $24,990 parkland dedication monies to be accomplished prior to issuance of a building permit or prior to January 1, 1982, whichever occurs first. . Motion was seconded by Cecil Henderson. Discussion of the motion ensued. Mr. Peddy withdrew his comment (see page 4) as the consultant's August 4, 1981, memo referring to Page 18, Number 4, had not been included in his packet. Ream Wilson moved to amend the motion to add that the developer prepare a promisory note stipulating that developer would convey to the City of Clearwater $24,990 parkland dedication monies prior to the issuance of the first building permit or prior to January 1, 1982, whichever occurs first, that the promisory note be submitted to the City for approval prior to the site plan and C.l.S. going before the City Commission, and that the developer convey the rights-of-way prior to the same Commission meeting. Motion to amend was seconded by Cecil Henderson and carried unanimously. Motion, as amended, carried unanimously. Revised Preliminary Site Plan Paul Rettig: Easements will be required between buildings to get over to Pineland Drive and over the proposed water loop line and meters shown at each building. Need easements for water, gas, and for picking up garbage. Patti Stough: Requested compliance with Florida state regulation requiring 25% of the units to be designed for barrier-free access (primarily larger doors), without the handicapped provisions in the toilet rooms. This is in addition to the 10% units for handicapped. For further information contact , Phil West on state level. Also requested sidewalks required abutting all rights-of-way be shown on plan. Paula Harvey: Asked Attorney Leitman about the portion of property which is not to be developed and is abutting Sunset Point Road. Mr. Leitman stated that it is not owned by Turnkey and does not know what is anticipated. Don Meerians: The 30' radius rate shown could be 20' and would reduce curb cut. MOTION: Paula Harvey moved approval of the site plan subject to the follow- ing conditions: 1. All waterlines to be shown on site plan; 2. Fire hydrant locations be shown on site plan; ; 3. Easements between buildings to Pinel and Drive, and over water and gas lines be shown on site plan; 4. Indjcation be given that 25% of the accesses to the buildings are barrier free; 5. Sidewalks on required streets be shown on the plan, or a variance obtained; 6. Final design of the drainage and retention system be approved by the Public Works Department; 7. Tree survey be submitted to the Environmental section of the Public Works Department at the time bUilding permit is requested; and 8. Al.l parkland dedication monies be paid prior to the issuance of an initial building penmit or by January 1, 1982, whichever comes first. . Motion was seconded by Cecil Henderson. Following discussion, Paul Rettig moved to amend the motion to remove reference of the tree survey and Public Works' approval of the drainage; and to add to the motion, "easements for access of the sanitation vehicles; and gas mains to be shown on site plan.1I Motion to amend was seconded by Cecil Henderson and carried unanimously. Motion, as amended, carried unanimously. Paula Harvey informed the developer that,the revised site plan must be submitted by August 21, 1981. ITEM 4 - CLEAR BAY-TERRACE, CLEARWATER VOLUNTEERS OF AMERICA ELDERLY HOUSING, INC~~ located at the northwest corner of Betty and Sandy Lanes. 'Also Present: Jim Anderson and Richard Zwolak, Environmental Science and Engineering, Inc.; Jim Spear, Simmons Contracting, Sarasota; Jamie Lassiter, Parker, .Croston Associates, architectural firm from Ft. Worth; and Diana McIver, Conroy and McIver, housing consultants for Volunteers of America. Community Impact Statement Paul Rettig: Does not know for a fact that we have gotten rights-of-way as stated on Page 2-2 of the C.1.5. ("Recent dedication of right-of-way for Betty Lane and proposed dedication of 301 right-of-way for Pineland........ Betty Lane contains 701........). Mr. Hend~rson said they are not facts. Page 2-23, Itthe potable water will be an a" main which is to be constructed in the Betty lane right-of-way"-we want a water main from Sunset Point Road south to the existing 4" line, at no expense to the City. Under 2 (h) (3), cannot under- stand how HUD project can be built without using natural gas. the best energy source and available from the City. Patti StouQh: Requested additional statement that developer will abide by the State of Florida energy requirements in effect at time of submission. Paula Harvey: Page 2-13, stating liThe proposed development exceeds maximum density limits imposed by the City and County Land Use Plans and the City Zoning Ordinances for the project site. However, under agreement with the City the dwelling unit density was calculated as a total unit and total net acreage for Clear Bay Terrace and the proposed unit north of the Clear Bay site.1I We are unaware of any such agreement. This project is separate from the other project in terms of design and density. Density must comply with amount of acreage ownership, current or proposed. We are bound by County approval of any change on our Land Use Plan. Density was contingent upon a higher LUP classification and when the County disapproved the City's recom- mendation of medium-density residential, the City was bound to revert to low-density, which it is now, restricting it to 8 units per acre. .A joint site plan covering the entire parcel which was annexed could be submitted or you could acquire more property or that another part of the tract which was annexed be dedicated to this project, are options available to justify the 101 proposed units. This site plan is about 30 units over allowable density. Planning will be glad to work with the developer but the plan cannot go to the Commission in its present form. .. The C.I.S. mentions connecting into a proposed lift station which was not noted as being sized to accommodate. It has been Max Battle's policy on a lift station serving more than one owner, to be sized and built to conform to a regional concept. This must be resolved with Max Battle before the item can go before the Commission. The drainage design has some unacceptable items to be discussed with the site plan. .Environmental comments (attached) were noted. (.Page 15.) John Peddy: Pleased with the development of efficient units. r \ Ream Wilson: Page 2-26, regarding parkland dedication, reference of 9.9-acre site, legal descriptions total 10.34 acres. Developer had deleted'right-of- way and Mr. Wilson explained t~e process and noted that parkland dedication is $21,000 calculated on the purchase price of the entire lO.34-acre tract, or on 10% of the MAl appraisal, and is due November 7~ 1981, in accordance with the annexation agreement. ' . ......) \',., \~ Preliminary Site Plan Paul Rettig: Recommended waterline be located straight east and west in easement rather than angled. If this is an 8" water main loop through this property and has hydrants and the City assumes its maintenance, a double line is unnecessary. Each building must have a separate meter. Dumpster should be relocated near the main driveway for better access. Suggested they seriously look into use of natural gas. Would also like a 10' easement connecting Jade Avenue to the south of this project into the waterline. Current plan shows 101 units and requires 152 parking spaces. RM-8 zoning permits a maximum building height of 25 feet. If this requirement cannot be met a variance must be approved by the Board of Adjustment and Appeal on Zoning.
