He is opposed to the removal of the restricti~n8. ,However, unless they are removed, he believes the property cannot be d~veloped--so he would recommend removal. Younglove had been aaked to provide some changes in the aite plan because of trees. This has not been done. C. Younglove - will get with Hike Campbell and take care of. Cecil Henderson - opposed to south access. Obvious that project site wa.s 'proposed as an extension of other side, rather than part of residential sub- division. David Healey - has some concerns regarding the deed restrictions. Restric- tions are a matter of record. However, if property is to be used, restric- tions need to be removed. He prefers that property also be connected to the north--in other words, to have access from both north and south. Most ~ould access from the south anyway, and for this reason, he reluctantly supports the removal of the restrictions. P. Rettig - if deed restrictions were ,not removed, what would be possibility of getting property zoned back to single~family. D. Healey said it would he possible, but he does not think the City ought to rezone at present. The ~ legal,'recourse open to the developer is to go to whoever gave them clear title to the property. After the City Commission makes a decision on the matter before them, the City would be free to apply for a rezoning. Don ~~erians - asked if Fairmont owned The Pines at one time. C. Younglove answered that they did. They were given title insurance and the insurance company did not pick up the restrictions. D. Meerians would like people who will be affected to have some knowledge of the possibility of removal of restrictions. MOTION: John Peddy recommended removal of deed restrictions subject to noti- , fication of all property owners facing on Sandy Lane and Rosemont Drive between Pamelia Drive & Highland Avenue. ,G. Buhmeyer amended motion to add: if City Commission denies access on Sandy Lane, he requests the option of moving fire hydrants. Motion carried with Cecil Henderson and Hank St. Jean voting in opposition. Chuck Younglove agreed that it would be fair to have a public hearing. ITEM #2 - Imperial Pines Condominium, Rutenberg Communities, Inc.; located on the northwest corner of Eastland Boulevard and z.tcMullen-Booth Road. Don Meerians - asked developers if they had a new site plan. Affirmative. Asked if access is dir.ectly across from Northwood Plaza. F. Mudano - Yes. They will indicate left-hand turn lane off Eastland Boule- vard when they submit final drawings. D. Meerians - Eastland Boulevard narrows from that point. F. Mudano - If necessary, they will add a lane. They have not removed median from interior part. D. Ms. Wilson explained that the water quality of Bishop Creek would be adversely impacted if drainage water is diverted through retention ponds rather than allowing it to flow down 0 natural stream bed which does considerably more to improve the quality of the water. DER requires a dredge and fill permit. It would be necessary to remove or redesign two buildings and a roadway. In answer to Mr. Rettig's questions, Ms. Wilson stated that in the developer's proposal water would go into a holding area which would be wet at all times. Every effort is being made to prevent violation of the City's water quality ordinances and to up- grade the quality of water in Clearwater. " i,." In the spring of 1979 they developed Imperial Oaks and they were asked to give rer.ognition to a to a SOO-foot piece of creek which was shown on the master land use plan. They were asked to, put storm water into it and turn part of the creek into a retention', pond. They piped about 110 feet of it, had (.: crossing and continued it in a redug and grassed swale. The City was not trying to protect it. Allowed Northwood Plaza to fill in part of it and a lOO~foot' right of way cut it off., Bishop Creek from McMullen-Booth Road eastward toward Tampa Bay is unmaintained and polluted. Figured that out of 556 (eat of creek, 386 feet are left and had been dug out with a backhoe before they purchased the property. Nr. Rutenberg said this creek has been removed from the City's Land Use Plan. D. Healey took exception to Nr. RutenbeI&'s suggestion that the Plan had been altered to remove the creek designation. Previously was indicated by green and while there is a new system now denoting environmental sensitivity, there was no intent to indicate that the creek is unrecognized. K. Wilson said vegetation that had been removed in violnt1on or DER require- ments is growing back and will return to its original stnte. Some discussion regarding a possible entrance on McMullen-Booth Road. T. Johnson stated that there is 25 percent impermeable ground cover on this project which is very low. The developer has been concerned with water quality, and if they have to move buildings the whole balance of thefr proj- ~ct '.gets thrown off. They have cooperated and another postponement will hurt the developers economically. MOTION: Paul Rettig moved to reconsider the preliminary site plan for Imperial Pines Condominium. George Buhmeyer seconded the motion which carried unani- mously. - The MOTION made by Karen Wilson earlier in the meeting carried, with Cecil Henderson and John Peddy voting "nay." Chairman Haeseker stated the City Commission will not need to look at the site plan again if staff concerns are satisfied. Agreed to go around the Committee again so the developer can know exactly what is being required. Paul Rettig said water quality information is needed. Parking underneath the building should be shown; also the guardhouse location. Comments of this meeting should be reflected. Again, the security wall on the right of way is to be non-permanent. Geo.
