MIke Gust - Would lIke the pDrklng plan to be revised In order to save a 23ft
In diameter Oak tree. Noted that the site plans seemed to shown an 18' orl9lm,1
drIveway whIch now seems to be cut down to IS'. thIs ts not satisfactory. Also
concerned wIth spaces for handicapped parking. Mr. Hickok replied that he had
met with Keith Crawford sortier thts week, and they had decided not to revise the
plans until after the meeting to see If there were any new comments from commIttee
members concerning the tree and other things on the site. He Dlso stated that the
tree Is located 42 1/2' from the west property line, and thaT they would like to
work the perkIng tot around the tree.
MIke Campbell - No comments on 'water quality section of the site plan. As far
as conwnents on the tree, 'he hlls not seen the tree su Ney, so he cannot conment.
ChaIrman Haeseker - QuestIoned whether we need a tree survey. Mr. Hickok replied
that he alreDdy has a tree survey.
George Buhmeyer - No comments.

Paul RettIg - Pointed out that each building Is subject to separate water meters,
and rnent~oned that a gas main is available for use. He also pointed out the need
for a dumpster locatIon which should be approved by the Sanitation Department.
, . ,Dave Hes I y - Brought up the need for access across the entl re property so that
lndlvtdual platted lots have access to proper right of way. There was some
discussion that there needs to be a separation area of 5' between the property
tJne and the first paved parkIng sp~ce. It doesn't appear on the plans that
,there, Is that much area. There was ~!~~ discussIon on the possibility of
problems of the entry Drea beIng too close to the IntersectIon of Chestnut St.
due to It's be I n9 a one way street. Mr. Gust a I so noted that the dr I vaway as
,shown would be most difficult for elderly people to negotla'~ because' of too
many turns.
Chairman Haeseker- Asked about the possibility of the two e~tra perking spaceS
on The plan being somehow revrsed to make the traffic pattern easIer to negotiate.
. MOTION: Cecil Henderson moved for approval of the sIte plan subject to the
following conditions:
I. Site plan be revIsed to indicate that sidewalks are either exIsting
or to be placed on the site.
2. HDndIcapped parkIng spaces are to be Indicated on.rthe plan.
3. That the developer must negotiate with the Traffic Engineering Department

Mr. HIckok questioned whether the requIrements would have to be I1"St before the
plans were sent to the COmmIssIon. He was told It would be put on the agenda,
and If requirements were not met, It would be pulled at the last minute, In this
way giving Mr. DeYoung and the developer time to work on the problems without
undue waste of time.
Paul RettIg - Addressed the Issue of not enough parkIng area, and the possibilIty
of too many buildings on the aree of land. Cecil Henderson ,responded that he found
no problem with the IB' Instead of 24' access ro~d be~use of state roads al I
over the County being only 18' wide and accommodating two lanes of trafflc.
ChairmancH~eseker then called for the vote whlch passed unanimously, subject to
the eforementloned conditions being met.
Bank Area ~ Tract 47-48
PRELIMINARY SITE PLAN
DavId Healy asked the representatives to give ~ brief outline of the revIsIons
from the orIginally approved site plan. Mike Adams noted a number of revisions
from what was originally Included; primarily, redesign of the restaurant and shops
down by the retention lake that Included ,the edditlon of the bank and the buildings
opposite of the Countryside Mall, some reconflguratlon of driveways and parkIng
areas, and also some reconflguration of buildings around the movIe theatre.
Ed Mazur mentIoned that major building changes are Southeast of Albertsons. It
was suggested the last tIme they were before the Committee to try ~nd have
Community Bank and Albertsons mesh the two sites Into one entrance. Mr. Healy
mentioned that since some of the changes 'were major ones, It,seemed to warrant
bringIng ft back before the CommIttee rath~r thantreatlng It' as a-minor plan ammendment.

MIke Campbel I - No comments on watar quellty, end sInce he,hadn't seen a tree
survey, no comment on that. MIke further commented that he would like to see
the wide expanse of asphalt on the plans landscaped, or at least green areas
If Community Bank Is agreeable. Ed Mazur responded thet a tree survey had been
submitted at the last meeting, and.that only two or three trees were Involved.
David Healy'- Asked (f the Committee has e specific policy with respect to the
40' addltlonal right-of-way easement elong Highway 19. Csctl Henderson responded
that they have requl~ed the 40' r'ght-o+-w~y to be set aside. Mr. Healy also
questIoned whether it would be possIble for existIng openrngs to be closed and
the drlvewayp between Denny's and the Community 8~nk made into one." He noted that
the places of entrance and exit seemed to be awkward, at best. Other than that,
the changed building relatIonshIps seem to be flne. There was some general
dIscussIon between MIke Gust and Ed Mazur about entrances and exits, and
about the parkIng area.

meter could not be used. Each store would have to have an IndivIdual mater.
Mike Gust - Asked whether the Committee was reviewIng Just the part of the plan
on parking a~ he noticed several shapes of buildings were changed, as wel I ~5
,some parkIng changes. MIke Adams responded that the main change was accomplished
by giving additional access.

Chelrman Heeseker asked that the mInutes ref'ect that Dave Healy provided the
CommlttAo with background m~terlel on this Item. At this time Chairman
Haeseker teft the meetlng and Paul Rettig chalred the rest of the meetIng.
Cecil Henderson - Presented end dIscussed the written comments prepared by J.W. Pooks,
City Engineer, which are attached as Item #3. Dave Healy revIewed the request
for waiver of CIS. His comment w~s that he felt a Community Impact Statement
would provide considerable InformatIon of value to the City, other than verifyIng
the number of units to be developed, that the CommIttee might otherwise not
know and he would like to see a CIS submitted.
John Peddy - Felt that a Commun\tv Impact Statement Should be performed because
of ereas that need to be eddressed In relation to the energy Impact on surrounding
areas. Also, an Impact statement would br1ng out the developer's 1ntentlon as
to the energy effIciency of his properties.
Alan Smith - No comment.
George Buhmeyer - Also of the opinion that a CIS should be submitted so that we
can gef more Information on the impact throughout the City.

waIver of the-ClS. Mr. Corbett answered that the philosophy of a CIS is to
determine whether a sIte will JustIfy a certain number of unIts, whether the
community can support a certaIn number of unIts with regard to utilities, traffic,
ete., and all those things are already fixed so in his opinion a CIS Is totally
superfluous at this particular site.
Cecil Henderson - Doesn') really see any reason for a CIS at thIs time.
Paul Rettig - Paul also dldn't see much advantage to requIring a CIS, however
he believed that there should be'a motton on the waIver of the CIS.

of the settlement, It would negate the requirement for a CIS.

precludes the necessIty for a CIS. Marshall Deason, Counselor tor Cheezum Land
COrporation, answered that what the committee had to decIde was whether It would
causa a threat to the health, safety, welfare or morals of the community If a
CIS was not submItted. He then read the sentence and Judgment from the lawsuit
settlement as follows:

should not cause any backlog of traffic.

tIre hydrants are shown, they do not appear on this proposed site plan. We
need to get together and dIscuss addltlonal hydrants on sIte. He also asked
If fIre hydrants shown on plans are constructed and tn place.

which goes a long way In reducing energy consumptIon.
Dave Healy ~ Would like sJte plan to show percentage of building coverage and
percentage of open space. Wanted to know if the 10' easement access was
taken care of. Cfted two problems that he saw:
I. The gatehouse seems to be tn what would be a vista or clear space
requ I rement .
2. The set-back requIrements for bul Idfngs do not meet current water-
front requirements.
There was consIderable drscuss[on on Mr. Healy's comments by Mr. Corbett,
Dave Healy, Roy Ayres, Marshal I Deason, Paul Rettig, and George Buhmeyer.
Paul Rettig - Outcome of the above dIscussion Is that you have your oplnfon
of the legal Interpretatlons, and the Committee wi II have to get the advJce
of the CIty Attorney. As to the UtilIty Cepartment, you don't show the site
cof the water meters, and Mr. RettIg would lIke you to be aware that there Is
a gas maIn avaIlable for use. Mr. Corbett responded by goIng through the plan,
'stating that ~e felt al I things brought up would be taken care of as part of the
plans for permanent appl Icatton. Mr. Rettig responded that normally plans would
be approved, subject to these small changes, but in this case, would have to
,walt ,for InterpretatIon from the CIty Ai'torney.
MOTION: Dave Healy moved to continue consfderation of'the sIte plan subject to
the Interpretation of the CIty Attorney.
Mike Campbell seconded the motIon relattve to settlement agreement and current
zoning requirements, and subject to fu,.ther Infonnatlon befng provided on
vegetatIon coverage and water retentIon areas.
Motion carried unanimously. To be continued at such time as the CommIttee
, hears from the CI ty Attorney.
