were a part of the motion to approve the CIS, and the Chai rman expressed
agreement with Mr. Heal ey.

a difference of opinion between himself and the developer, as to whether
;bank and restaurant use would fall under commercial zoning.
Ceci 1 Henderson asked if Mr. Heal ey had asked the St'at e for thei r int erpre-
t a.t ion and Mr. Heal ey Bai d the developer's on! y committment is to the
City because the developer is not submitting a DRI to the Stat e. !Vir. Henderson
said that his concern had been that the City might be protecting the State's
i nt erest and not the City's.
Jer:r'{ Sheets stated that he had a letter giving the Lane Companyl s position
(attached). to present to the COlnmittee. He added that the cleveloper will
not. change the s1 te pl an and gave a bri ef expl anat ion as to why.
The Chai rman poi nt ed out that the mot ion to approve the CIS incl uded
recognition of the bank and restaurant uses as cor.ntnercial. Mr. Mazur
stated that under PS (professional services) zoning banking is included.
Mr. Heal ey point cd out that the property was zoned CP (commerci at

Mr. Ret tig asked Mr. Sheet s if the devel aper was cert ai n a bank wonl d

parking.. He, the Chai rman, and Ceci 1 Henderson di 8cussed the at at un
of the CIS. Mr. Heal ey poi nt ed out that the applicant had been gi ven
the opportuni ty to redesignat e the proposed cat agori as of use and they waul d
not -- in essence the Committee had not approved the CIS. Mr.
Henderson indL cat ed that he thought the CIS shaul d go to the City
Commiesi on.

heen moved in order to get it away from a tl"ee that Mike Kent on had
pointed out. All buildings now have a 40-foot setbaclt. Adjacent to
U.S.. Highway 19, the 40...foot setback applies to the easement, not the
right of way. Parking areas, pavement J etc. have been moved 5 feet
away from the 40.foot easement in order to have a landscaped area.
Note #12 was added to clarify what they mean by offices. Bus loading
and un! oadi ng areas we re added. Not as st atil:1g that offices waul d be
individually metered, and handicapped spaces making a total of 27 or
28 spaces, were added.
Kei t h Crawford observed t hat on U. S.. Highway 19, one dri veway was

Eaul Rettifrwas satisfied with the PSP. He mentioned that when th.e

for them to meet with the Utilities Department re metering. Mr. Rettig
encouraged the developer to use met ered gas and the developer indi cat ed
that they woul d. The developer is to provi de gas fad Uties.

Sheet 8 answered that there waul d g round cover as well as a covered

Davi d Heal ey moved to deny the PSP for Tract B 45, 72, 73 and 74,
Count rysi de, the reason bei ng that the PSP does not recogni ze the condi t ion on
whi ch the CIS was approved. Mike Campbell seconded the mot ion.
Mr. Rettig asked if there were at her probl ems with the si te pI an and Mr.
Heal ey answered that the commerci al square foot age was the pri ncipa 1
reason and hi s secondary concern was that the p:roj ect layout was unsat i B-
factory.. There was some discussion. Motion carried unanimously.

the parking requi rement s woul d be different. Mr. Crawford poi nt ed
out that there is some confus! on about treat ment . of townhouses and

Ream 1Vilson asked the developer about the bicycle easement. Mr.
John Herri ck sai d the hi eyel e easement was 101 of the 75' drainage
eas ement . Mr. Wilson had no obj ect ions.
Paul Ret tig poi nt ed out that unde l' Sanita ry Sewe 1', item 1# 8, the daily
average was low. Thi s woul d not be a probl em. H developer chooses
to use dumps.t ers he waul d like for them to work with the Sani tat ion

Mike Campbell said that under "Topography and Drainage" it was stated that
the banks of AIUgat or Creek are at a 20-f oat e1 evat ion. He asked how
deep the exi st ing swal e was that ran along the west end of the propert y,
and Mr. Herri ck answered that it waul d be from one foot to five feet.
Mr. Campbell st at ed that the ret ent ion area woul d be locat ed in Wauchul a
soil which is very wet two to three months of the year, and, because they
are three feet deep, he bel ieves there will be wat er in them for ext ended
peri ods. He suggest ed the developer take the wat er int 0 consi derat ion in
thei r comment about the grass, as grass may not be abl e to grow. Also,
under "Veget at ion" there will be an invent ory requi red on the veget at ed
. area near Alligat or C reek and an eval uat ion of the averag e and tot al val.ue
of the trees is requi red for the CIS. He asked how the swal e was
veget at ed and the deve! oper answered that it was brush.
Cecil Henderson queried as to whether the developer would he clearing
the area adj aceot to the Creek. Mr. Herri ck responded that they woul d leave
it as a buffer.
Mr. Campbell Baid that Wlder lITraffic and Parking, II on page 3, it wa.8
st at ed that the developer waul d address an al ternat e aur! ace of porous
asphal t pavement. He asked if the developer had explored furl her, and
mentioned a type of bri ck that allows grass to grow. Thi s bri ck can be
used for parking areas and the brick would be good around some of the
t Tees that may be close to pavi ng.

He did not agree with the developer's statement that the proj ect could
retain sewer to 250/0 of the proj ect. Mul ti..family cannot be approved.

and the fence, and all the set backs had been ind! cat ed.
