Peterson, Inc. ./ The meeting was called to order at 10:10 AM in the Mayor's Conference Room. MOtion was made by Mr. Henderson, seconded by Mr. Kenton, that Dave Healey chair the meeting. " Motion carried unanimously. MOtion was made by Mr. Henderson, seconded by Mr. Kenton, that the U. S. Home Corp. items be acted 'upon first, in accord with their request, providing those in attendance for Agenda Item #1 had no objection. There being no objection, motion carried unani- mously. Item 41 - u. S. Home Corp. - Countryside - Tract 16 - CIS and Site Plnn Review (Cont'd. from RDClmeeting of July 28, 1978) 'L" ,I Mr. Bodziak requested continuance of Tract 16 CIS and Site Plan for two weeks to allow U. S. Home Corp. time to rectify setback problems. Motion was made by Mr. Henderson, seconded by Mr. Young, to continue consideration of Tract 16 to the ROC meeting of August 25, 1978. Motion carried unanimously. Item in - u. S. Home Corp. - Countryside - Tract 4 - CIS and Site Plan Review .,. d. Above tract is located in the northern sector of Countryside (second tract from U. S. 19). Said tract is zoned RM-24 but proposed to be developed con8idera~1y leas intensively, i. e., 11.7 dwelling units per acre. Development will be one story villa . type complex similar to Village-on-the-Green. (Area was brought into the City prior to tbe CIS.) Hr. Henderson stated no problems with the CIS. Tempora~J drainage ditch will be relocated and the sanitary sewer flows to the Dynaflow Plant. Mr. Crawford stated he is not on favor of a divided driveway and that the alignment with North- side Dr. was poor. However, problem can be resolved and will be reviewed at the time parking lot comea in. Messrs. Wilson, Kenton, Young, Lewisand Alexander had no comments. Mr. Rettig questioned whether dumpster locations were shown on the plan and noted separate water meter for each building would be required. Mr. Healey suggeoted larger prints of the site plan be provided for review prior to action on the site plan. Motion WdS made by Mr. Wilson, seconded by Mr. Henderson, to approve the CIS with an addendum or corroction to the vegetation statement and that the site plan be considered at the subsequent meeting. Motion carried unanimously. Discussion ensued whether the CIS could be waived by the Commission or perhaps consolidated into a single report. Mr. Healey reported it was the Legal Deparbment's opinion that the CIS ~rovision could not be waived. It would be up to the Committee to accept a consoli- dated report. Hr. Bodziak indicated this would not be advantageous at this point and questioned whether CIS could be waived 8S it applied to portion of Countryside approved under Master Plan prior to CIS requirement. Mr. Healey stated that he will have an answer to this question by the next meeting of the RDC. Item 13 - Sunset Poillt Nursing Center - CIS and Site Plan Review (Cont'd. from ROC meetin~ of July 28. 1978) Sandy Lloveras stated revised site plan had been submitted earlier in the week and revisions were made per staff comments; among them: ligustrum hedge shown on east boundary, grubbing and tree permit put on the site plan, additional fire hydrant on the northeast corner of property adjacent to the parking lot, meter shown on the south side of the building, north side of Sunset Point Road re drainage noted and drainage shown on the plan. Mr. Henderson stated that most of the items of concern to his Depar~ent have been taken care of. Mr. Lloveras indicated legal description had been corrected and proof of ownership has been provided. Mr. Wilson had no comments but reiterated Mr. Tracy's.comments that removal of myrtle and chinaberry trees over certain size will require a tree removal permit. Fire Department inquired if the developer could build in extra line. Mr. Lloveras indicated this would be done. Messrs. Alexander and Kenton had no comments. Mr. Healey stated no difficulty with the CIS ..- that it was adequate in terms of the facility it addreased. However, he could not support approval of site plan ahead of zoning change needed to enable it to be legitimately con- sidered. Mr. Lloveras stated that he h~d met with Mr. Rankin and the abutting property owners and they are in favor of the project. Mr. Henderson questioned whether the Committee should be reviewing the site plan when it doesn't have the zoning. Discussion ensued. Motion was made by Mr. Henderson, seconded by Mr. Kenton, to recommend approval of the CIS. Motion carried unan~ously. MOtion was made by Mr. Henderson, seconded by Mr. Wilson, to communicate to the appropriate boards that the Committee has com- pletely reviewed the site plan and hos no problems with it but has withheld approval pending appropriate zoning for the property. MOtion carried unanimously. Item #4 - Perkins' Cake and Steak - CIS and Site Plan Review ,Mr. Kami Targal stated that above restaurant would have minimal impact. Mr. Henderson stated that flood control and sewage control are adequately covered and he sees no problems in this regard. Mr. Crawford stated that driveway on Gulf-to-Bay Blvd. shows slender taper to get people in and out; U. S. 19 driveway cannot be provided on property line but must be at least 5 feet away; parking spaces should be separated from the drive- ~ay by planters (at ends of driveway) as 8 distinct separation is necessary. Mr. Wilson bad no comments. However, speaking for Mr. Tracy, he stated that there were 114 parking spaces requiring 1520 sq. ft. of planting and planting 1s not shown. There is a great' necessity to preserve the camphor tree as it is recognized by the Arbor Association and is on the National Registry. Also, there are 4 s~ble palms on the property which, if removed, would require a tree permit. Fire Department representatives stated they require one on-site fire hydrant, preferably at the southerly mid~line area (8'" line dead-end). Mr. Kenton again stressed the importance of the preservation of the camphor tree and its root system. Mr. Rettig stated the developer should contact the Sanitation Department re putting in ~ dumpster. Mr. Crawford expressed his concern with reducing the number of spaces in this manner. Mr. Healey also inquired. whether any consideration had been given to the restaurant being located on the northeast corner of the property and suggested that the present location be re- viewed by tbe architeet. MOtion was made by Mr. Henderson, seconded by Mr. Rettig, to recot1'llDend approval of the CIS. Motion carried unanimously. Motion was made by Mr. Henderson, seconded by Mr. Lewis, td defer final approval of the site plan to the next meeting (August 25,1978). Motion carried unanimous 1y. No tion was made by Mr. Wilson, seconded by Mr. Alexander, that the ROC Committee make a recommendation to the City Manager that someone be designated to contact the owner where the camphor tree is located and that a fence be constructed around the tree to protect it from ' .vandalism and damage. at the City's expense, to be done immediately and prior to construction of the restaurant and tbat the appropriate funds be allocated for that purpose. Motion carried unanimously. Item #5 - Highland Center - Preliminary Plan Review in Conjunction with Annexation (Cont'd. from ROC meetin~ of July 289 1978) Annexatio~ haB been approved by the City Co~ssion subject to approval,of the site plan by RDC. Mr. Smoyer was absent and had not contacted any of the members of the various departments since the last meeting ~s had been indicated. We still do not have proof of ownership. Construction of the project is underway under a COlmty permit. Motion was made by Mr. Henderson. seconded by Mr. Kenton, that the Committee notify the City Manager that Mr. Smoyer and his group appeared at the meeting of July 28, 1978 and indicated they would do anything that the Committee desired but did not contact them and that, in the meantime, constroction is going on. The County criteria they are building under does not meet the City of Clearwater's requirements and strong action . .should be taken to advise the applicant of the need to comply with the terms of Commission action on the annexation as well as to reconcile what is an on-going problem with the County. Motion carried unanimously. J( '\( Mr. Healey stated that he bad received a letter from K. L. King & Associates requesting a waiver of the CIS for Northwood Villas based on the anticipated downzoning of the tract (now RM-28). They contemplate building less than the 16 dwelling units.per scre to,~hich'the property is now covenanted. Mr. Healey ntated that the Committee will re- ceive additional copies of the site plan and address both waiver of the CIS and the preliminary site plan at the next meeting (August 25, 1978).
