,Meeting was called to order at 10: 05 a. m. in the Mayor's Conference
Room.
I,
Old Business: Motion was made by Mr. Henderson, and seconded by
Mr. MOore, to recommend that the recommendation for waiver of CIS for
Deerwood Apartments be rescinded. Motion carried.
Item 1: Motion was made by Mr. Henderson, and seconded by Mr. Moore,
tnat the request for waiver of CIS for Island Estates Villas be with-
drawn at the request of the developer. Motion carried.
Item 2: Mr. Henderson stated that an easement will be required for
drainage to and around the retention pond on the Family Mart site.
Mr. Henderson questioned Mr. Cotton, Family Mart representative, as
. to whether it was understood that the City of Clearwater will not be
resp~nsible for putting in sewers, and that a Certificate of Occupancy
,will not be issued for the building until the sanitary sewer lines are
ins~alled. Mr. Cotton stated that there was a contractual agreement
,providing that U.S. Homes was responsible for the installation of sewer
lines.

Mr. Moore asked Mr. Cotton whether provision had been made for the
planting of shrubs, and suggested that irrigation measures be taken.
Mr. Cotton assured the Committee that this was being done.
The Forestry Division concurred with the foregoing and made no further

At this point, copies of the Island Estates site plan were passed to
each Department representative for their review.
Item 3: According to a memo written by the City Attorney, a waiver
of cIS cannot be granted to Charlie Harris Pontiac. The conditions
which must be met for such a waiver are:
1. A substantial reduction of density in zoning is,
required, and
2. A CIS having previously been submitted within six months.
This was not done.
A short discussion followed regarding a general waiver procedure being
formulated in light of information distributed by the City Attorney.
A 'motion was made by ~~. Healey and amended by Mr. Paroby that the
"applicant be informed of the two provisions for waiver which permit
the ROC to consider'granting a waiver of CIS. If the applicant does
not meet those two provisions, then his recourse is to the City Commis-
'sion, and the RDC will not consider a waiver in those cases. This
motion was seconded by Mr. Henderson and unanimously carried.
