Motion was made by Mr. Rende, seconded by Mr. Spier, to recommend denial of (3) above,
without prejudice. Considerable discussion ensued. Upon vote being taken, motion was
defeated. Notion was then made by Hr. Butler, socond..ad by Hr. Spier, to reconuncnd
approval of \'(3) above, pointing out thnt this is another aftcr-the..fllct condition, with
the hope tho. t the City Commi s sion wi 11 e stab li sh a po Hey for the guidance 0 f thi s Bo urd
for future action r~lativc to such situations. Motion passed unanimously. (Applicant
was.not present at the public hearing.)
Chairman Kruse was excused at 3:00 PM to attend another meeting. Vice Chairman Mylander
presided during remainder of meeting.
Considerable discussion ensued re (4) above. Motion was mode by ~lr. Mylandcr, seconded
by Mr. Butler, to recommend dc.ninl without prejudice due to the .distance from the present
property to the nearest City property ~lich is considered to be excessive and, in effect,
thereby becoming a ballooning annexation and, also, on the basis that the applicant is not
being denied or dwnaged in any way because of the ability to secure sewer service under
the present arrangement with the City whereby County properties can secure City sewer
service on the fee basis. Motion carried. Mr. Spier voted "no". M6tion was made by
Mr. Spier to rescind the previous motion and, in lieu thereof, recommend annexation of
(4) above, establishing R-1D zoning classification. Mr. Reade seconded the motion.
Discussion ensued concerning sewer extension and the acceleration of the development
of vacant lots with this extension, possibly encouraging requests for City services and
annexation. Motion carried unanimously. Zoning requested is in accordance with area
development trend and the Comprehensive Plan.
Item #5 abo~e was withdrawn by the applicant.
Items to be Included in an Ordinance Amending the City Zoning Laws:
1. Amend paragraphs (3) and (6), Section 26-17, Board of Adjustment & Appeal, to
authorize City Conmission to pass resolution setting charges for hearings before
the Board of Adjustment & Appeal to the City Commission.
. 2. Amend paragraph (b), Section 26-33, Procedure for amending zoning provisions, to
authorize Ci~y Commission to set fees by resolution for amending zoning pro-
visions.
..Motion was made by Mr. Dutler, seconded by Mr. Schutzendorf, to recommend approval of
(1) and (2) above inasmuch as there were no objections from the public at the public
hearing of this Board on May 18) 1971. Motion carried unanimously.
Motion was made and seconded to recornnlend approval of revised Master Plan for Skycrest
Greens Subdivision. Motion carried unanimously. (Master Plan docs not require a public
hearing but must be approved by the City Commission.)
Mr. Spier was excused at 3~20 PM.
