A. Bergmann, Planning Director, due to illness A pUblic hearinr, was held at 1:30 PM on Decemher 30, 1969 re application for rezoning of items to be included in an Ordinance amending the City Zoning Laws. Major LeCouris, Police Dept., was in attendance in addition to the above. Tape of hearing is on file in Planning Dept. Due to length of the public hearing, the Planning & Zoning Board meeting was held on January 2, 1970. Minutes of December 2, 1969 were approved as written on motion by Mr. Schutzen- dorf, seconded by Mr. Galloway. Mr. Wolle was Acting Director in Mr. Bergmann's absence. Re application for rezoning public hearing to be held January 12, 1970, the Planning & Zoning Board recommended as follows:" 1. Northerly 85 ft. MOL of Lot 82, Northerly 110 ft. MOL of Lot 83, Northerly 130 ft. MOL of Lot 84, and Tract A, Sunset Highlands, Uni t 3 (Lynn) From R-lt (Single Family) to R~~D (Multi-family) () Opposition appeared at public hearing re drainage problem. All parcels except Tract A are ~lithin drainage easements. Applicant desires property for recreational purposes (occupants of apartments to the north). Motion was made by Hr. Galloway, seconded by Mr. Harries, that the request be denied, without prejudice; the Board's reason being that the drainage easement must be vacated prior to the Board's receiving the matter again for rezoning. Should the easement be vacated, the Board would recommend a change of zoning to R-3 instead of R-4D. Motion carried unanimously. 2. Lots 1 to 5 incl., S 30 ft. of Lot 6, all of Lots 9, 10, Block E, Suburb Beautiful (Turner Brandon Post #7, Inc.) From R-IE (Single Family) to R-2 (Duplex) Motion was made by Vice-Chairman Mylander, seconded by Mr. Butler, to recommend denial of the request. Mr. Galloway abstained. Motion carried. The upland portions of property kno~ln as Sand Key, together with sur- rounding water areas more particularly described as follows: bounded on the W by the territorial limits of the State of Florida, bounded on the S by a line 500 ft. MOL Northerly of the S line of Section 19-29-15 and S line of Section 20-29-15, on the E by the center line " of the Int~acoastal Waterway and on the N by Clearwater Pass. Said area lying'ln and being parts of Sections 17, IS, 19 and 20, Town- ship 29 S, Range 15 E, together with all abutting streets (U.S. Steel) From B (Business) to PUD-CR (Planned Unit Development-Commercial- Residential) Considerable discussion was held on the above. Mrs. David read into the record a clipping from the Clearwater Sun of January 1, 1970, as follows: "Nodine also asked the Planning & Zoning Board to postpone its preliminary hearing, but the Board took the stand that, having received no word of any postponement of the public hearing, it must fulfill its responsibilities to the Commission and have a recommendation ready by January 12." Mr. Wolle stated that staff recommended PUD-CR, with the reserva- tion that we are aware of this zoning's causing a full master plan to be pre- , 'sented and that a time condition of two years would be allowed for 60% of it ':', :~to be comple!ed. . Minor adjustments may be made that would be considered "workable." Mr. Wolle read two letters from the attorney for U. S. Steel -- one to the City Commission and one to the Planning & Zoning Board -- wherein U. S. Steel requested consideration proposing rezoning of Sand Key be postponed until further consideration be given to the matter for reasons set forth until "preliminary plans can be prepared and opportunity for preliminary plans for ,consideration and zoning appropriate thereto. Following further discussion~ Vice-Chairman Mylander made the motion, seconded by Mr. Morris, that the Board has received a request from the at- torney for U. S. Steel, in addition to a copy of a letter from the attorney for U. S. Beginning at SW corner of NW l/q of SW 1/4 of Section 12-29-15, run E 564.ll ft., N 928.95 ft., W 1177.52 ft., S 916.30 ft., E 605.89 ft. to P.C.B. (City) From R-IE (Single Family) to R-3 (LD) (Multi-family low density) Considerable discussion was held re above request. Opposition at the pUblic hearing was based on fear of increased traffic generated by a multi-family project and fear of low-cost housing. The point re traffic situation was answered by Major LeCouris and by consideration of long-term improvements of Keene and Airport Roads. Future use of this airpark was discussed; i. e., total development proposed, including airpark improvements and golf course usage. If tract comes under private ownership, low density multi-family zoning would provide ..9,partment occupancy abutting a community acti vi ty and other public-oriented 'facilities and would have access to shopping and transit facilities. De- velopment of this parcel would then eliminate two airfield approaches pro- viding safer occupancy for a portion of existing residential area to the west and southwest. Realignment of paved runway would be northwest-southeast with a 500 ft. additional safety zone provided at each end. <,'0 " " Mr. \.Jolle stated that staff recommended R-3 zoning provided that :i:" adequate right of way be acquired for Keene and Airport Roads. (It was !'. , felt that Keene Road should be extended.) " General discussion followed re the condition of the airport and its worth to the residents of the city. Motion was made by Vice-Chairman Mylander, seconded by Mr. Harries, that R-3 zoning for the request be approved. Vote was 3 - 3 with 2 ab- staining. Motion defeated. After further discussion, another motion was made by Vice-Chairman Mylander, seconded by Mr. Harries, that the request for R-3 zoning be ap- proved. Upon vote being taken, there were 6 "ayes", l"no" and 1 "abstaining." Motion carried. 9. Lot 20, Block 1, Knollwood Replat (Sidner) From R-1E' (Single Family) to PRS (Professional & Related ,Services) Motion was made by Hr. Schutzendorf, seconded by Mr.' Spier. to approve the reque~t.
