'WtldI ~ It \olilS ill BO rccomll\cnd~d that the ahove pare€! 3. be dcsig- f*' natod as Firc Distx'ict' No. ? clHssification. ,,---,' , , Such zoning recommendation was based on the following considerations: Mrs. Libecap, applicant, appeared and explained her need for City sewer services in order to be able to build on or to sell her property, stating that sewer was available within 100 feet, A Mrs. Calvina, 1401 Nursery Rd" requested information,as to the use of the property, as she seemed to have been given the idea that under R-IE zoning other than a single residence might be per- mitted. She was assured tnat the zone requested would not permit any other development than single family residence. There were no objectors. Lot and portion of lot of request are zoned R-3, Single Family Residential, in the County and adjoin a City R-1E subdivision. Zoning requested is consistent 'with R-IE zoning for prior annexa- ~ions of single lots in other blocks of Sunny Park Groves Subdivi- sion. Property is surrounded by single family homes and proposed zoning conforms to usage intended. It was noted that existing platted right-of-way for adjoining Nursery Road and Sunny Park Road is standard 60 foot. Item #2 Sh~mpion Developers, Inc. A statement was made for the record by applicantts representatives that the appli- cant has the property between Union Street and the area to be annexed under contract and that, in the future development of this tract, provision would be made for a street extending north to Union Street so as to relieve some of the traffic on Highland Ave. generated by this annexation. Mr. Charles Landenberger, 1927 Souveni~ Drive, appeared in opposi- tion, presenting a letter of objcction signcd by him as Committee Chairman of the Sunset Lake Estates Association. ..--. , It was revealed to the Board that building foundation pe~mit has already been issued by the County and that construction under this permit is underHay. The County zoning for 'this property is R-5, 'comparable to the City's R-ll. It was assumed in this regard that the County has taken under consideration the matter of the sewage disposal through a privately operated disposal plant. It was also understood that plans for these apartments have had some prelimi- nary ~eview by the Building Dcpa~tment of the City, with the intent by the applicant that if the property is annexed the building plans would be acceptable to the City. Under these circumstances, and the fo~egoing commitments by the applicant as, to height limitation and a projected ~raffic outlet to Union Street, the recommendation of the Board to approve the request for annexation seemed justi- fied. There are undeveloped properties to the north and east of this area. Due to the orientation of the single family residences in the area to the South of this property, it was felt that 2-story buildings properly dispersed for low density would not adversely affect the property values of the single family area. It was noted that any needed dedication for adjoining Highland Ave. half right-of-Hay will be obtained by the Engineering Department at the time of annexation. Mr. Walter Straman, 2357' Michael Lane, appeared to express con- cern that width of entranc~ streets might he inadequate as ac- cess to the proposed development. , .AI though this reque,st will require a "balloon" annexation of Sunset Point Road west from U. S. Highway 19, reco~nition that maintenance responsibility of the City on this road will not be involved as it is a State highway. This propel~ty lies immediately t-lest of the "Top of the ~.jorldn, Which is a multi~story apartment development, a~d the proposed use would be comnatihle to the area. It is understood that other properties in this vi.cinity fronting on Sunset Point Road are giving consideration to be annexed to the City so as to obtain utilities, It was noted that the adjoining right-of-way of Sunset Point Road (St. Road 588) is full 100 feet. The Board continued its discussion of the above request. Informa- tion from Mr. Reade was that he had knowledge that the Planner was op- posed to the vacation because of the need for access and for parking at the back of~the school. Mr. Reade said that he thought it would be better if instead of vacating Palm Avenue the church were permitted to bridge the street, as he understood they didn't want to build on the right-of-way. Hr. Horris suggested that if refuse trucks, service trucks etc. use the alley they probably enter from Palm Ave. and the \ street vacation might cause more congestion. Mr. Rettie reported that .
